Rural Land in Nelson Land District open for Sale or Selection.

PLUNKET, Governor.

IN pursuance and exercise of the powers and authorities conferred upon me by section one hundred and thirty-six of “The Land Act, 1892,” and section two of “The Bush and Swamp Crown Lands Settlement Act, 1903,” I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, do hereby declare and provide as follows, that is to say:—

  1. The rural land enumerated in the Schedule hereto is hereby set apart for disposal by way of sale or selection on and after the thirtieth day of January, one thousand nine hundred and seven, at the respective prices specified in the said Schedule.
  2. The said land may be purchased for cash, or be selected for occupation with right of purchase, or on lease in perpetuity: provided that in the case of land containing or supposed to contain any metal, mineral, or valuable stone, it shall be selected on lease in perpetuity only and shall not be purchased for cash.
  3. For the purposes of “The Bush and Swamp Crown Lands Settlement Act, 1903,” the land enumerated in the said Schedule hereto shall be deemed to be “scrub land.”
  4. No general rate shall be levied or collected by any local authority from the said land for the period of two years from the date from which such land is disposed of, and no local authority shall have power to levy or collect any such rate from such land during such period.
  5. After the first half-year’s rent has been paid by the selector the further instalments of rent payable by him for a period of two years shall not be demanded: provided that if at any time during the first five years of his occupancy the selector disposes of his interest in the land the rent so conceded shall be paid by him in full, and thereupon the Land Board may remit such instalments of rent payable by the incoming tenant, not exceeding in the aggregate the amount of rent previously conceded to the selector, as the Board shall think fit.

All steep hills and gullies, surrounding Mount Thomas; limestone formation; covered on the western side fronting the Motueka River with heavy scrub and fern, a little birch bush remaining on the eastern slopes. Distant about two miles from Pokororo Post-office and school, and accessible by a branch road about one mile and a half long, which leaves the Motueka Valley Road near the Pokororo Footbridge, and is formed as far as Mr. Holmwood’s, a distance of about a quarter of a mile, thence along an unformed track for another mile and a quarter.

Removing Restrictions against Alienation of Native Land.

PLUNKET, Governor.

WHEREAS by section fourteen of “The Maori Land Laws Amendment Act, 1903,” it is enacted that, notwithstanding anything to the contrary in any Act, or in any Crown grant or other instrument of title, the Governor may, on the recommendation of the Board, remove any restriction on the alienation of land owned by Maoris: Provided that the decision of the Governor on any recommendation of the Board shall be given within six months from the date of the receipt of such recommendation:

And whereas the Aotea District Maori Land Board, by a recommendation made and passed by the said Board on the twenty-sixth day of September, one thousand nine hundred and six, and received on the twenty-fourth day of October, one thousand nine hundred and six, recommended the Governor to remove and revoke the restrictions against alienation contained in the instrument of title of the block of land known as Subdivision 12 of Section 16, Hutt, so far as to permit the said land to be sold:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred upon and vested in me by the said Act, and of all other powers and authorities me thereunto enabling, and in accordance with the recommendation of the Aotea District Maori Land Board aforesaid, do hereby remove and revoke the restrictions now existing against the alienation of the land particularised and set out in the Schedule hereto, so far as to permit the said land to be sold by public auction, with a reserve price of eight hundred and fifty pounds.

SCHEDULE.

ALL that piece or parcel of land, containing 2 acres 1 rood 6 perches, more or less, known as Subdivision 12 of Section 16, Hutt, and comprised in certificate of title, Vol. 31, folio 233, in the Land Transfer Office, at Wellington, containing the following restriction: “Inalienable by sale, or by lease for a longer period than twenty-one years, or by mortgage, except with the consent of the Governor being previously obtained to every such sale, lease, or mortgage.”

As witness the hand of His Excellency the Governor, this nineteenth day of November, one thousand nine hundred and six.

Removing Restrictions against Alienation of Native Land.

WHEREAS application has been made to the Governor by the owner of the land described in the Schedule hereto, praying that the restrictions on the alienation of the said land contained in a Crown grant bearing date the twenty-second day of November, one thousand eight hundred and sixty-nine, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has recommended that such restrictions be removed:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred upon him by the fifty-second section of “The Native Land Court Act, 1894,” and in accordance with the recommendation of the Native Land Court, doth hereby
