most corner of Allotment No. 137 of Section No. 10,
Suburbs of Auckland, to a point in line with the northern
side of Valley Road; thence by a right line to the northern
side of the said Valley Road, and by that road to the
northernmost corner of Lot No. 46 of Allotment No. 5 of
Section No. 10, Suburbs of Auckland; thence towards the
south-east by the said Lot No. 46, Lots Nos. 24, 39, and 23
of Allotment No. 6, and by Allotments Nos. 103, 102, 101,
100, 99, 98, 97, 96, 95, 94, and 93 of Section No. 10 aforesaid;
thence towards the south-west by Mount Roskill Road
District, as described in the New Zealand Gazette No. 42, of
the 18th May, 1883; and towards the north-west by the
Mount Albert Road District aforesaid.

Bounded towards the north-east by No. 2 Ward herein-
before described; towards the south-east by the Epsom
Road District, as described in the New Zealand Gazette
No. 42, of the 18th May, 1883; towards the south-west by

the north-west by No. 3 Ward hereinbefore described.

The Drury Road District declared to be a District to which
the Provisions of “The Birds Nuisance Act, 1902,” shall
apply.—Notice No. 1049.

A PROCLAMATION.

WHEREAS by section fifteen of “The Birds Nuisance
Act, 1902” (hereinafter termed “the said Act”), it
is enacted that the Governor may, in the event of any local
authority of any district in the North Island by resolution
requesting him so to do, by Proclamation, declare that the
said Act shall apply in any such district:

And whereas the Drury Road Board has by resolution
requested the Governor to make such declaration with
respect to the Drury Road District:

Now, therefore, I, William Lee, Baron Plunket, Governor
of the Colony of New Zealand, in pursuance and exercise of
the powers and authorities conferred upon me by the said
Act, do hereby proclaim and declare that, from and after
the date of the publication hereof in the New Zealand Gazette,
the provisions of “The Birds Nuisance Act, 1902,” shall
apply in the Drury Road District.

A PROCLAMATION.

IN pursuance and exercise of the powers and authori-
ties conferred upon me by the sixth section of “The
Land Act, 1892,” and of every other power and authority
enabling me in that behalf, I, William Lee, Baron Plunket,
the Governor of the Colony of New Zealand, do hereby
revoke the Proclamation of the twenty-first day of February,
one thousand nine hundred and two, in so far as it relates
to the lands described in the Schedule hereto, and do declare
that, from and after the day of the date hereof, the said lands
are hereby withdrawn from Te Kuiti Village Settlement.

a Hospital or Sanatorium near Otaki, in Titokitoki and
Waitohu Blocks, Block IX, Waitohu Survey District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-
third day of July, 1906.

Present:

His Excellency the Governor in Council.

WHEREAS the lands mentioned in the Schedule hereto
are required to be taken for a public work, to wit,
for the purpose of establishing a hospital or sanatorium for
the cure of consumptive patients in Titokitoki and Waitohu
Blocks, Block IX, Waitohu Survey District:

And whereas the said lands are held or occupied by Native
owners under a title which is not derived from the Crown:

And whereas a map in duplicate has been prepared of the
said lands, as required by the eighty-ninth section of “The
Public Works Act, 1905”:

Now, therefore, in pursuance and in exercise of the powers
vested in him by the eighty-ninth section of the said Act,
and of all other powers in anywise enabling him in this
behalf, His Excellency the Governor of the Colony of New
Zealand, acting by and with the advice and consent of the
Executive Council of the said colony, doth hereby declare
that the lands shown upon such map, and described in the
Schedule hereto, shall be deemed to be taken for the pur-
pose of the establishment of the said hospital or sanatorium
for the cure of consumptive patients; and the said lands
shall vest in the District of Wellington Hospital Board as
from the fifth day of September, one thousand nine hun-
dred and six.
