Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of the hereinbefore-recited power and authority, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations:—
REGULATIONS.
-
Before leaving a port the master of every British ship shall satisfy himself that his ship is properly and sufficiently ballasted, that the ballast is properly levelled down, and, in cases where it consists of coal, sand, shingle, or other material liable to shift, that it is secured from one side to the other by proper fore-and-aft shifting-boards.
-
The master shall, before his ship leaves port, give a certificate to the principal officer of Customs at the port that he is satisfied that his ship is properly and sufficiently ballasted, and that the ballast has been properly secured as required by clause one of these regulations; and the principal officer of Customs may withhold the ship’s clearance and detain her until he receives such certificate.
-
After the ballast is taken in and secured, it shall not be discharged until the ship reaches the port to which she is bound.
-
Without limiting or affecting the foregoing clauses of these regulations, it is hereby declared that a principal officer of Customs or a Surveyor of Ships may detain a British ship at any port if, in his opinion, she is improperly or insufficiently ballasted as required by these regulations, and in such case the ship shall not proceed to sea until the master is notified in writing by the officer who detained her that she may do so.
-
