Prescribing Dues and Rates for the County Wharf at Kohukohu.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of June, 1906.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Hokianga County Council was, by Order in Council dated the fourteenth day of August, one thousand eight hundred and eighty-six, and issued under “The Harbours Act Amendment Act, 1883,” licensed and permitted to use and occupy a part of the foreshore and of the land below low-water mark at Kohukohu, in Hokianga Harbour, for the purpose of constructing or erecting thereon a wharf, in accordance with plans marked M.D. 1222 and 1223, which plans were, in pursuance of the provisions of section one hundred and fifty-six of “The Harbours Act, 1878,” approved by the Governor in Council on the said fourteenth day of August, one thousand eight hundred and eighty-six: And whereas dues for the use of the said wharf were prescribed by Order in Council dated the twenty-seventh day of February, one thousand eight hundred and eighty-eight: And whereas it is desirable to revoke the said dues and to prescribe others in lieu thereof, as hereinafter provided:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in pursuance and exercise of the power and authority granted to him by the said Act, and of all other powers and authorities enabling him in that behalf, doth revoke, as from the first day of July next, the dues prescribed by Order in Council dated the twenty-seventh day of February, one thousand eight hundred and eighty-eight, and doth hereby prescribe that, from and after the first day of July next, the dues and rates set forth in the Schedule hereto shall be charged and taken for the use of the said wharf.

SCHEDULE.

  1. THE dues and rates hereby prescribed shall apply to the wharf so constructed by the County Council of the County o Hokianga as aforesaid.

  2. Every person who shall use the said wharf with any vessel shall pay to the County Council of the County of Hokianga, or to its officer or other person appointed or authorised by it to receive the dues and rates hereby prescribed, for the use thereof, as follows, that is to say,—

For every vessel lying alongside the wharf—

(a.) One halfpenny per ton per day or part of a day for every ton register up to 100 tons.

(b.) Exceeding 100 tons, ½d. per ton per day or part of a day for the first 100 tons, and ¼d. per ton per day or part of a day for every ton over 100 tons.

Every person who shall use the wharf for landing goods, or whose goods are stored in any shed on the wharf, shall pay wharf-dues in respect of the landing, storage, receiving, and delivering such goods, as follows, that is to say,—

Domain Board appointed to have Control of the Whakatane Domain.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of June, 1906.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the power and authority conferred by “The Public Domains Act, 1881,” and the amendments thereof (including “The Domain Boards Act, 1904”), His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke a certain Order in Council, dated the sixteenth day of September, one thousand eight hundred and ninety, delegating powers to the Whakatane Domain Board, and doth hereby appoint

The Chairman of the Whakatane County Council, ex officio, and

EDWARD CLAY,
GEORGE CREEKE,
NEWTON HENRY GOULSTONE,
GEORGE SIMPKINS, and
WILLIAM GORDON WHITE,

to be the Whakatane Domain Board, having, subject to the said Acts, control of the lands described in the Schedule hereto, which lands are a public domain, and shall be called the Whakatane Domain; and also doth hereby appoint Wednesday, the eighteenth day of July, one thousand nine hundred and six, at two o’clock p.m., as the time when, and the Whakatane County Council Chambers, Whakatane, as the place where, the first meeting of the said Board shall be held.

SCHEDULE.

ALL that area in the Auckland Land District, containing by admeasurement 40 acres 2 roods 18 perches, more or less, being Sections Nos 285 and 286, Parish of Waimana, Block II, Whakatane Survey District. Bounded towards the north by a road, 1430 links; towards the east by a road, 1399 links; again towards the north by the termination of a road, 100 links; towards the east and north by the western and southern boundaries of Section No. 263, 576 and 400 links respectively; towards the north by the southern boundary of Section No. 263a, 241 links—all of the Parish of Waimana aforesaid; towards the east by a road, 630 links; towards the south by a road, 1712 links; towards the west by a road, 375 links; again towards the south by a road, 530 links; again towards the west by Section No. 287,
