"The Council of the City of Wellington hereby resolves that the provisions of section three of "The Public Works Act, 1903," shall not apply to the streets fronting the lands owned by the Corporation under the provisions of "The Wellington Reclaimed Land Act, 1871":

And whereas the streets described in the Schedule hereto front on to lands owned by the said Corporation in pursuance of the last-mentioned Act, and are those referred to in the resolution of the City Council as aforesaid:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and in exercise of the powers conferred by "The Public Works Act, 1905," and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby approve of the said resolution.

SCHEDULE.

ALL those streets in the City of Wellington known as Waring Taylor Street, Johnston Street, Brandon Street, Panama Street, and the portions of Featherston Street and Customhouse Quay fronting the lands owned by the Corporation of the City of Wellington under the provisions of "The Wellington Reclaimed Land Act, 1871"; as the said streets are more particularly delineated on the plan marked R. 5660, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured with a red border.

Validating the Public Notification of the Special Order relating to the Loan of £5,000 for the Erection of Abattoirs, applied for by the Dannevirke Borough Council.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this third day of March, 1906.

Present:

THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.

WHEREAS the Dannevirke Borough Council lately proposed to raise a loan of five thousand pounds, under "The Local Bodies' Loans Act, 1901," and "The Slaughtering and Inspection Act, 1900," for the purpose of providing for the purchase of land and cost of erection of an abattoir thereon: And whereas the public notification of the special order making the special rate was published in the Advocate newspaper for four weeks, but was not published once in each full week intervening between the meeting at which the special order was passed and the subsequent meeting at which the said special order was confirmed, as required by subsection three of section seventy-three of "The Municipal Corporations Act, 1900": And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the said notification:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred by section ten of "The Local Bodies' Loans Amendment Act, 1902," and acting by and with the consent of the Executive Council of the said colony, doth hereby declare that such public notification of the special order shall be deemed and taken to be as valid as though the said notification had been properly published, and that the proceedings relative to the said loan shall not be called in question by reason only of the irregularity aforesaid, nor shall the said special order be deemed invalid by reason of any want of formality in the form thereof.

Notice of Intention to change the Purpose of a Portion of a Reserve in the Nelson Land District.

PLUNKET, Governor.

WHEREAS by "The Public Reserves Act, 1881," it is, amongst other things, enacted that the Governor may declare his intention to change or alter the dedication of any public reserve now or hereafter vested in His Majesty or the Governor for any of the purposes named in Class II of the Schedule to the said Act, whether the same be granted or not; and if it shall, in the opinion of the Governor, be expedient to change the purpose of such reserve or any part thereof from the purpose or presumed purpose for which it was set apart to any other purpose, the Governor may, by notice gazetted, declare his intention to make such change, and in such notice declare the manner and terms in which the same is intended to be so made:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, do hereby, in exercise and pursuance of the powers and authorities vested in me by "The Public Reserves Act, 1881," aforesaid, declare my intention to change the specific purpose of the portion of the reserve described in the second column of the Schedule hereto from that named in the first column of the said Schedule to that named in the third column of the said Schedule respectively.

SCHEDULE.

Description and Purpose of Original Reserve. Portion which it is intended to change. Intended Purpose.
All that area in the Nelson Land District, containing by admeasurement 1 acre, more or less, being Section No. 178, City of Nelson. Reserved for public utility in Nelson Provincial Gazette No. 9, of the 16th June, 1855, page 55. All that area in the Nelson Land District, containing by admeasurement 29 perches, more or less, being portion of Section No. 178, City of Nelson. Bounded towards the north by St. John Street, 91·9 links; towards the east by Harley Street, 196·9 links; towards the south by other portion of said Section No. 178, 92·2 links; and towards the west by a public right-of-way, 196·3 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked S.G. 54539, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured red. Site for a drill-shed.

As witness the hand of His Excellency the Governor, this twenty-fourth day of February, one thousand nine hundred and six.

Removing Restrictions against Alienation of Native Land.

PLUNKET, Governor.

WHEREAS application has been made to the Governor by the owners of the land described in the Schedule hereto, praying that the restrictions on the alienation of the said land contained in the Land Transfer certificate of title (Vol. 119, folio 227) bearing date the tenth day of July, one thousand eight hundred and ninety-nine, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has recommended that such restrictions be removed:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred upon him by the fifty-second section of "The Native Land Court Act, 1894," and in accordance with the recommendation of the Native Land Court, doth hereby order and declare that all restrictions imposed by the said Land Transfer certificate of title on the alienation of the said land are hereby removed.

SCHEDULE.

ALL that piece or parcel of land, situate in the Otago District, containing 45 acres 1 rood 4 perches, more or less, known as Section 42, Block XII, Waikouaiti Native Reserve, being the land comprised in Land Transfer certificate of title (Vol. 119, folio 227) dated the 10th day of July, 1899, in favour of Teone Ellison and others, and containing the following restrictions: "Inalienable, except with the consent of the Governor, by sale or mortgage, or by lease for a longer period than twenty-one years."

As witness the hand of His Excellency the Governor, this first day of March, one thousand nine hundred and six.
