Provided that if the number of pupils in the secondary department of a district high school would otherwise be less than 20, the Board may at its discretion also admit to such secondary department any pupil who has gained a certificate of competency in Standard VI; but in no case shall the attendance of any pupil be included in the yearly average attendance for the secondary department, unless he has obtained at least a certificate of competency in Standard VI.
- If, in any of the three cases hereinafter in this clause set forth, the average daily attendance in the secondary department of a district high school shall increase as described therein, the Board may at its discretion make such addition to the staff as will bring it into accord with the staff prescribed in Part VI of the Schedule for a department in the grade to which it shall be advanced.
(a.) A secondary department having on the 1st January a yearly average attendance of not over 30 which at the beginning of any subsequent quarter has had an average attendance of—
41 for the quarter immediately preceding, or
36 " two quarters "
shall, subject to clause 19, be reckoned to have an average attendance exceeding 30, but not exceeding 50.
(b.) A secondary department having on the 1st January a yearly average attendance of not over 70, or not over 105, or not over 140, in which at the beginning of any subsequent quarter the average attendance has risen above 70, or above 105, or above 140, as the case may be, by
20 for the quarter immediately preceding, or by
10 " two quarters "
shall, subject to clause 19, be reckoned to have the average attendance of the grade next higher than that so exceeded.
(c.) A secondary department having on the 1st January a yearly average attendance of not over 175, or not over 210, or not over 245, or not over 280, in which at the beginning of any subsequent quarter the average attendance has risen above 175, or above 210, or above 245, or above 280, as the case may be, by
40 for the quarter immediately preceding, or by
20 " two quarters "
shall, subject to clause 19, be reckoned to have the average attendance of the grade next higher than that so exceeded.
- If, in any of the three cases hereinafter in this clause set forth, the average daily attendance in the secondary department of a district high school shall decrease as described therein, the Board shall reduce the staff so as to make it accord with the staff prescribed in Part VI of the Schedule for a department in the grade to which it shall be lowered.
(a.) A secondary department having on the 1st January a yearly average attendance of over 30 which at the beginning of any subsequent quarter has had an average attendance below—
24 for the quarter immediately preceding, and below
27 " two quarters "
shall, subject to clause 19, be reckoned to have an average attendance of less than 31.
(b.) A secondary department having on the 1st January a yearly average attendance of more than 70, or more than 105, or more than 140, in which at the beginning of any subsequent quarter the average daily attendance has fallen below 70, or below 105, or below 140, as the case may be, by—
16 for the quarter immediately preceding, and by
8 " two quarters "
shall, subject to clause 19, be reckoned to have the average attendance of the grade next lower than that fallen short of.
(c.) A secondary department having on the 1st January a yearly average attendance of more than 175, or more than 210, or more than 245, or more than 280, in which at the beginning of any subsequent quarter the average attendance has fallen below 175, or below 210, or below 245, or below 280, as the case may be, by—
30 for the quarter immediately preceding, and by
15 " two quarters "
shall, subject to clause 19, be reckoned to have the average attendance of the grade next lower than that fallen short of.

Clauses 17 and 18 shall affect the average attendance for a secondary department only during the quarter prescribed and any subsequent quarter in the same year. On the 1st January following such department shall (in accordance with clause 2 hereof) be placed in the grade corresponding with the yearly average attendance thereat; and, further, nothing in the said clauses shall be deemed to affect the average attendance upon which is computed the salary of any member of the staff of such department who shall not have been appointed or removed thereunder.

In the case of the establishment of a new district high school, the average attendance of the primary and secondary departments thereof shall be found in accordance with clause 8 of these regulations in the same way as if such primary and secondary departments respectively were new schools.

The teachers of the secondary department in any district high school shall not be employed in the primary department of such school, except in so far as it may be necessary for one or more of them to give instruction during the time that the head teacher is giving instruction in the secondary department; nor shall any teacher in the primary department other than the head teacher devote any part of the ordinary school hours to the instruction of the secondary department.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-seventh day of February, 1906.
Present:
His Excellency the Governor in Council.
IN pursuance and exercise of the powers and authorities conferred upon him by “The Education Act, 1904,” and of all other powers and authorities him enabling in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby, in respect of the regulations made by Orders in Council dated the fourteenth day of February, one thousand nine hundred and two, the fourth day of June, one thousand nine hundred and three, and the fourth day of July, one thousand nine hundred and four, under the authority of the Act first hereinbefore mentioned, revoke clauses forty-five, sixty, and sixty-seven, also clauses seventy-seven to seventy-seven (j) inclusive, thereof, and in lieu of the said clauses doth make the regulations set forth in the Schedule hereto; and with the like advice and consent doth declare that this Order shall come into force on the date of the publication thereof in the New Zealand Gazette.
SCHEDULE.
II.—SPECIAL AND ASSOCIATED CLASSES.
- CLASSES for commercial instruction to be approved by the Minister as “technical classes” must provide for regular instruction in such subjects as may properly be included in one or other of the following courses:—
(1.) Commercial correspondence and précis-writing. Office routine (as for correspondence clerks).
(2.) Commercial or actuarial arithmetic. Book-keeping (as for accountants).
(3.) Mercantile and commercial practice (as for shipping
(4.) Mercantile and commercial law { and other clerks.
(5.) Other similar courses, or combinations of courses (1) to (4).
Capitation at the rate prescribed for technical classes will not be paid on account of the attendances of any student who has not attended regularly throughout the year classes for instruction in the subjects included in his course of commercial instruction.
V.—GRANTS IN AID OF BUILDINGS, FITTINGS, FURNITURE, AND PERMANENT APPARATUS.
- All grants for buildings, fittings, furniture, and permanent apparatus will be subject to the appropriation of moneys by the General Assembly for that purpose, and the Minister may, if he deem fit, pay the whole or part of the amount for which application is made, or he may decline to make any grant whatever. Grants in aid of buildings, fittings, furniture, and permanent apparatus will be paid to the controlling authority of the classes.
VI.—GRANTS IN AID OF MATERIAL.

Under the head of “Material” may be included the material necessary for demonstrations and for individual practical work in classes for instruction in art, science, or technology (see clause 43 hereof), and also apparatus and appliances for use in connection with such classes and requiring to be replaced from year to year.

(a.) The following, among others, may be regarded as material—lead, timber, chemicals, modelling-clay, foodstuffs—but not articles included under the head of stationery.
