VIII.—FREE PLACES.
- Notwithstanding anything to the contrary in any regulations as to scholarships made under “The Education Act, 1877,” the Education Board of any district may, if it see fit, allow scholarships granted under the said Act to be held at any educational institution approved by the Minister, at which instruction is given in technical, commercial, or agricultural subjects, provided that such instruction is higher than that which is given in public schools in school classes under the Act.
JUNIOR FREE PLACES.

(a.) Subject to these regulations, a pupil shall be qualified to be a junior free pupil or the holder of a junior free place under the Act if, being not under thirteen years of age, he is the holder of an Education Board Scholarship, a National Scholarship, a Queen’s Scholarship, or any other scholarship that the Minister shall approve for the purpose: Provided that the value of any such scholarship is not greater than £40 per annum in the case of any pupil who is obliged to live away from home in order to attend the technical school, or than £10 per annum in any other case; or if he has qualified for an Education Board Scholarship, or for a free place in the examination for Junior National Scholarships, or in the special examination for junior free places held by the Education Department; or if he has obtained a certificate of proficiency as defined under “The Education Act, 1904.”

(b.) Subject to these regulations, the following payments, in addition to the capitation payable under the Act, shall be made to the controlling authority of classes under the Act on account of each junior free pupil admitted to such classes, namely:—
(i.) For each attendance at a recognised technical class in any of the subjects named in clauses 43, 45, and 47 of these regulations, a payment of 3d.:
(ii.) For each attendance at a recognised continuation class in any of the subjects named in division (2), (3), (4), or (5) of clause 40 of these regulations, or in book-keeping or shorthand, a payment of 3d.:
Provided that no such payment shall be made on account of a junior free pupil for any class in which he has made less than twenty hour-attendances during the year: Provided further that under this clause not more than £5 shall be paid on account of any one junior free pupil in each year.
- (c.) Every holder of a junior free place granted under these regulations shall receive in each year instruction in—
(i.) English of a standard higher than that required for Standard VI of the public-school syllabus, or in one of the languages named in division (3) of clause 40 of these regulations; the English to include English composition and a study of one or more than one of the works of some standard author or authors—not less than 600 lines of poetry and 100 lines of prose in a year.
(ii.) Arithmetic as for Standard VII of the public-school syllabus, or mathematics, or commercial or actuarial arithmetic. (See divisions (4), (5), and (6) of clause 40 of these regulations.)
He must receive the instruction referred to in (i) and (ii) at classes established by the controlling authority, at each of which he must make not less than twenty hour-attendances during each year.
He must also attend in each year one or more technical classes in subjects named in clauses 43, 45, and 47 of these regulations, and must make in respect of each class so attended not less than twenty hour-attendances during the year.
The instruction he receives during the two years that he holds a junior free place must have reference to a definite course of technical instruction. No capitation under clause 77, (b), hereof will be paid in respect of attendances at classes which have not a bearing on such course.
- (d.) A junior free place is tenable for two years from the 1st January preceding the actual date of admission as a free pupil, but a pupil shall cease to hold a junior free place if he fails to make in either year of his tenure the minimum number of hour-attendances at each of the classes prescribed in clause 77, (c), hereof; and, further, shall not be eligible to hold any other free place, whether at a technical school, a secondary school, or a district high school, unless such failure was caused by illness or other sufficient cause.
SENIOR FREE PLACES.
- (e.) A pupil shall be qualified to be the holder of a senior free place if he has been the holder for two years of a junior free place, and has passed such examination as the Minister may approve in the subjects in which he has received instruction as a junior free pupil, or if he is the holder of an Education Board Scholarship, a National Scholarship, or any other scholarship that the Minister may approve for the purpose: Provided that the value of any such scholar-
ship is not greater than £40 per annum in the case of any pupil who is obliged to live away from home in order to attend the technical school, or than £10 per annum in any other case; or if he has passed the Matriculation Examination, or the Civil Service Junior Examination, or the special examination for senior free places held by the Education Department; or has qualified for an Education Board Scholarship.

(f.) Subject to these regulations, a payment of 3d. for each hour-attendance at a recognised technical class in any of the subjects named in clauses 43, 45, and 47 hereof, in addition to the capitation payable under the Act, shall be made to the controlling authority of classes under the Act on account of each senior free pupil admitted to such classes: Provided that no such payment shall be made on account of a free pupil for any class at which he has made less than twenty hour-attendances during the year: Provided further that under this clause not more than £5 shall be paid on account of any one free pupil in each year.

(g.) Every holder of a senior free place granted under these regulations shall take up a definite course of technical instruction, which course shall be determined by the director of the technical school, due regard being had to the calling or profession which the pupil is following or has in view. The instruction must be of a more advanced character than that given to holders of junior free places.

(h.) A senior free place shall be tenable for three years from the 1st January preceding the actual date of admission as a senior free pupil, but a pupil shall cease to hold a senior free place if he fails to make in any year of his tenure the minimum number of hour-attendances at a class in any subject included in his course of instruction; and, further, shall not be eligible to hold any other free place, whether at a technical school, a secondary school, or a district high school, unless such failure was caused by illness or other sufficient cause.
GENERAL.

(i.) Any holder of a free place who after his admission to a technical school shall remove more than five miles from the technical school at which his free place is held may continue to hold his free place at any other technical school on the same terms as if he had remained at the first named school, or at a secondary school, or at a district high school, subject to the regulations governing free places at such school: Provided that, except in the case of such removal, the holder of a free place at a technical school shall not be entitled to continue to hold his free place at a secondary school or at a district high school.

(j.) Free railway tickets will be granted where necessary to holders of junior or senior free places.

(k.) If on a report from the controlling authority or from the Inspector-General of Schools it shall appear to the Minister that the attendance, conduct, diligence, or progress of any free pupil is not satisfactory, the payment on account of such pupil shall cease at the end of the term or quarter in which such report is received.

(l.) These free places are open to boys and girls alike.

(m.) These free places are not tenable with any other scholarships or free places, except as provided in clauses 77, (b), and 77, (e), hereof.

(n.) As soon as possible after the commencement of the instruction in each year the controlling authority shall forward on forms supplied by the Department a return of all free pupils admitted to classes under the control of such authority. No capitation under clause 77, (b), hereof will be paid on account of the attendances of any free pupil not included in such return.

IN exercise and pursuance of the powers and authorities vested in him by “The Education Act, 1904,” the Governor, with the advice and consent of the Executive Council of the colony, doth hereby make the regulations hereto annexed respecting free places in secondary schools and district high schools; and, with the like advice and consent, doth prescribe that this Order shall come into force on the date of the first publication thereof in the New Zealand Gazette.
