Land taken for a Native School at Mataora Bay.

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-sixth day of November, 1906.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required for a certain public work, to wit, a Native school:

And whereas the Native owners have agreed to make a free gift of the said land to His Majesty the King, and it has been made to appear that such agreement is sufficient for the purposes intended to be effected thereby:

And whereas by an order of the Native Land Court, made upon investigation of title, and bearing date the twenty-third day of June, one thousand eight hundred and eighty, certain aboriginal Natives are declared to be the owners of the Mataora Block, within which the said land is situated:

And whereas, as required by “The Public Works Acts Compilation Act, 1905,” a map has been prepared showing accurately the position and extent of the said land, and such map is hereto attached:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities conferred by “The Public Works Acts Compilation Act, 1905,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the land shown upon the said map and described in the Schedule hereto is hereby taken for the purposes of the said Native school, and shall vest in His Majesty the King, as from the fourteenth day of January, one thousand nine hundred and seven.

Validating the Public Notification of the Special Orders in connection with the Loans of £2,500, £750, and £300 applied for by the Horowhenua County Council.

ORDER IN COUNCIL.

At the Government House, at Wellington, this tenth day of December, 1906.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Horowhenua County Council did publicly notify the resolutions for making and levying special rates for the purpose of providing the interest and other charges on certain loans authorised to be raised by the Horowhenua County Council, under “The Local Bodies’ Loans Act, 1901,” and the amendments thereof, for the following works:—

(1.) The widening of the Tokomaru Valley Road in the Tokomaru Riding of the said county, loan two thousand five hundred pounds;

(2.) The construction of Nikau, Pukatea, Toitoi, Matipo, and Manuka Streets, at Tokomaru, in the Tokomaru Riding of the said county, loan seven hundred and fifty pounds;

(3.) The construction of a subway underneath the Wellington–Manawatu Railway line on the Muhunoa East Road, at Ohau, in the Wirokino Riding of the said county, loan three hundred pounds:

And whereas the public notification of such resolutions appeared in the Manawatu Farmer newspaper of the sixteenth, nineteenth, twenty-third, and thirtieth days of March, one thousand nine hundred and six, and the sixth day of April, one thousand nine hundred and six, but did not appear once in each of the four weeks immediately preceding the day on which the said resolutions were confirmed, as required by section eleven of “The Counties Act Amendment Act, 1903”: And whereas it appears that the ratepayers have not been misled, and it is expedient to validate such irregularities:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred by section ten of “The Local Bodies’ Loans Amendment Act, 1902,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby validate the public notifications of the said special orders so made as aforesaid, and doth hereby order and declare that the said special orders making the said special rates shall not be called in question by reason only of the irregularities aforesaid.

Declaring certain Roads in the Township of Papatawai, Clutha County, to be Government Roads.

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this tenth day of December, 1906.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1905,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the roads described in the Schedule hereto shall, on and after the date of this Order in Council, be Government roads.

Exempting Clifton Street, Island Bay, City of Wellington, from Provisions of Section 117 of “The Public Works Act, 1905,” subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.

At the Government House, at Wellington, this tenth day of December, 1906.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street, by resolution, declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by section three of “The Public Works Act Amendment Act, 1906,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:
