Now, therefore, His Excellency William Lee, Baron Plunket, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the delegation to the Council of the County of Clutha of the powers conferred upon the Governor by section six of “The Cemeteries Act, 1882,” in respect to the Port Molyneux Public Cemetery, described in the Schedule hereto.

SCHEDULE.
PORT MOLYNEUX PUBLIC CEMETERY.
ALL that area in the Otago Land District, situated in the Town of Molyneux, containing by admeasurement 9 acres 1 rood 23 perches, more or less, and marked “Cemetery Reserve” on the map of the said town. Bounded towards the north-west by Section No. 6, 540 links; towards the north-east by Ives Street, 1700 links; towards the south-east by Ann Street, 540 links; and towards the south-west by Section No. 11, Block I., South Molyneux District, 1700 links: as the same is delineated on the plan marked S.G. 45081, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured red.

Revoking Order in Council fixing Dues for Wharves, Waipu River, and fixing other Dues in lieu thereof.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this fourth day of November, 1905.
Present:
THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.
WHEREAS it is provided by the fourth section of “The Harbours Act Amendment Act, 1879,” that the power granted to the Governor in Council by the seventeenth section of “The Harbours Act, 1878,” in respect of prescribing what dues and rates may be charged on wharves vested in local bodies may be exercised from time to time as occasion may require, and shall not be limited as in the said section is provided:
And whereas the management of two wharves on the Waipu River, Whangarei District, was, by Order in Council dated the twenty-seventh day of May, one thousand nine hundred and three, vested in the Waipu River Board:
And whereas by Order in Council dated the eighth day of March, one thousand nine hundred and four, the dues and rates specified in the Schedule thereto were prescribed for the use of the said wharves:
And whereas it is desirable that the said Order in Council of the eighth day of March, one thousand nine hundred and four, should be revoked, and that other dues and rates should be prescribed for the use of the said wharves:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in pursuance and exercise of the power and authority conferred upon him by “The Harbours Act, 1878,” “The Harbours Act Amendment Act, 1879,” and of all other powers and authorities enabling him in that behalf, doth hereby revoke the said Order in Council of the eighth day of March, one thousand nine hundred and four, and doth hereby prescribe that the dues and rates set forth in the Schedule hereto shall, on and after the date of this Order in Council, be charged and taken by the Waipu River Board for the use of the said wharves.

SCHEDULE.
(1.) THE owner, master, consignee, or agent of every vessel trading regularly to the port and shipping or discharging cargo shall pay the sum of fifteen pounds (£15) quarterly in advance.
(2.) The owner, master, consignee, or agent of every vessel not trading regularly to the port for the shipment or discharge of cargo shall pay the sum of twelve shillings (12s.) for each and every trip made by them.

WHEREAS by an Order in Council dated the twenty-eighth day of February, one thousand eight hundred and ninety-three, and published in the New Zealand Gazette No. 15, of the second day of March in the same year, His Excellency the Governor in Council did, in pursuance of the provisions of “The Harbours Act Amendment Act, 1883,” license the New Zealand Land Association (Limited) to use and occupy a part of the foreshore of Raglan Harbour, in the Provincial District of Auckland, for the purpose of constructing and maintaining thereon a wharf in the position shown on, and in accordance with, plan marked M.D. 1807, and deposited in the office of the Marine Department at Wellington, and upon and subject to the terms and conditions therein set forth:
And whereas the New Zealand Land Association (Limited) aforesaid desire to surrender the said license:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of all the powers enabling him in that behalf, doth hereby revoke and determine the said recited Order in Council of the twenty-eighth day of February, one thousand eight hundred and ninety-three, and every right, power, and privilege conferred thereby or intended so to be.

WHEREAS by an order of the Native Land Court made the twenty-second day of July, one thousand eight hundred and ninety, purporting to determine the successors to the share or interest of Penehamene Napekoi, deceased, in the land known as Allotment No. 60, Parish of Whangape, Nehemia Wetini was declared to be the successor to the said share or interest: And whereas it is alleged that the said order was made through a mistake or error within the meaning of section 39 of “The Native Land Court Act 1894”:
And whereas application has been made to His Excellency the Governor in Council to consent to the making of an application to the Chief Judge of the Native Land Court, in pursuance of the provisions of section thirty-nine of “The Native Land Court Act, 1894,” to amend the said order for the purpose of rectifying the said alleged error, mistake, or omission:
And whereas on inquiry held in pursuance of the provisions of “The Land Titles Protection Act, 1902,” the Governor is satisfied that a prima facie case has been established, and that it would be inexpedient to dispose of it by remedial legislation or any other procedure which would obviate litigation:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of all powers and authorities in that behalf vested in him by “The Land Titles Protection Act, 1902,” and of every other power and authority enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the making of an application to the Chief Judge of the said Court in accordance with the provisions of section thirty-nine of “The Native Land Court Act, 1894,” for the purpose of rectifying the said alleged error, mistake, or omission, and that the said order of the said Court made the twenty-second day of July, one thousand eight hundred and ninety, may be the subject of an order of the said Chief Judge under the said section thirty-nine of “The Native Land Court Act, 1894.”
