And whereas a map of the said land has been prepared in duplicate, as required by the eighty-eighth section of “The Public Works Act, 1894
Now, therefore, in pursuance and exercise of the powers vested in him by “The Public Works Act, 1894,” and “The Public Works Act, 1903,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, is hereby taken for the purposes of the public work hereinbefore mentioned; and the said land shall vest in His Majesty the King as from the twelfth day of October, one thousand nine hundred and five.

At the Government House, at Wellington, this eleventh day of September, 1905.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section twelve, subsection one, of “The Public Works Acts Amendment Act, 1900,” it is enacted that a local authority shall not declare any county or district road to be stopped, and such road shall not be deemed to be stopped, until the consent thereto of the Governor by Order in Council gazetted is obtained:
And whereas the Pukekohe West Road Board has applied for such consent in respect to the road described in the Schedule hereto:
Now, therefore, in pursuance and in exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the Pukekohe West Road Board closing the road mentioned in the Schedule hereto.

Validating Public Notifications regarding a Loan applied for by the Eden Terrace Road Board for the Purpose of forming and metalling Greenwood Street and constructing Footpaths.

ORDER IN COUNCIL.
At the Government House, at Wellington, this eleventh day of September, 1905.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS the Eden Terrace Road Board lately proposed to raise a loan for the sum of four hundred pounds for the purpose of forming and metalling a certain street named Greenwood Street within the Eden Terrace Road District and the construction of footpaths in connection therewith: And whereas a special order making a special rate has been made as security for the said loan: And whereas the provisions of section seventy-five of “The Road Boards Act, 1882,” relating to special orders, were not complied with by the said Eden Terrace Road Board, inasmuch as public notice of the intention of the said Road Board to make the said special order although published for four successive weeks was not publicly notified once during each of the four weeks immediately preceding the meeting at which the resolution to make the said special order was proposed: And whereas it appears that the ratepayers have not been misled, and it is expedient to validate such irregularity:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred by section ten of “The Local Bodies’ Loans Amendment Act, 1902,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the said special order shall be deemed and taken to be as valid to all intents and purposes as though the same had been regular in form, and doth hereby declare that the proceedings relative to the said loan shall not be called in question by reason of the irregularity aforesaid.

At the Government House, at Wellington, this eleventh day of September, 1905.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS the Waipipi Road Board lately proposed to raise, under the provisions of “The Local Bodies’ Loans Act, 1901,” a loan of five hundred pounds for the purpose of metalling portions of the main Waipipi Road and Lamb Hill Road, in No. 3 Subdivision, and passed a resolution by way of special order purporting to make and levy a special rate in respect of such loan: And whereas section seventy-five of “The Road Boards Act, 1882,” enacts that the intention to pass a resolution making a special order shall be publicly notified once in each of the four weeks immediately preceding the meeting at which such resolution is to be proposed: And whereas the public notification of the intention to make such special order was published once in each of four consecutive weeks, but not during each of the four weeks immediately preceding the date of the meeting held for the purpose of passing the resolution making such special order: And whereas it appears that the ratepayers of the special-rating district have not been misled, and it is expedient to validate such publication:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise and pursuance of the powers and authorities vested in him by section ten of “The Local Bodies’ Loans Amendment Act, 1902,” doth hereby validate such irregular notification of the said meeting, and doth hereby declare that such meeting shall be deemed and taken to be as valid to all intents and purposes as though the same had been held in strict accordance with section seventy-five of “The Road Boards Act, 1882,” and doth hereby declare that neither the said special order nor the proceedings relative to the said loan shall be called in question by reason only of the irregularity aforesaid.
