Excepting Land from the Operation of Section 117 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of August, 1905.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bona fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act:

And whereas the Maniapoto-Tuwharetoa District Maori Land Council, by a recommendation made on the eighteenth day of November, one thousand nine hundred and four, and received on the sixteenth day of May, one thousand nine hundred and five, has recommended His Excellency the Governor to except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of lease, the block or parcel of land, containing six hundred and thirty-six acres two roods, more or less, being part of the land known as Taumatatotara No. 1a:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section four of “The Native Land Laws Amendment Act, 1895,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of lease for any period not exceeding twenty-one years, the block or parcel of land, containing six hundred and thirty-six acres two roods, more or less, situate in the Auckland Land District, being part of the land known as Taumatatotara No. 1a, and part of the land comprised in partition order of the Native Land Court dated the second day of September, one thousand nine hundred and three, in favour of Pango Hoone and others.

Notifying Land in Auckland for Sale by Public Auction.

PLUNKET, Governor.

IN pursuance of the powers and authorities conferred upon me by the one-hundred-and-thirteenth section of “The Land Act, 1892,” I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, do hereby appoint Wednesday, the eleventh day of October, one thousand nine hundred and five, as the time at which the land described in the Schedule hereto shall be sold by public auction; and I do hereby fix the price at which the said land shall be sold as that mentioned in the said Schedule hereto.


SCHEDULE.

AUCKLAND LAND DISTRICT.—CITY OF AUCKLAND.

Lot 37, Section 36: Area, 12·5 perches; upset price, £182 6s. 8d.

Situated at the corner of Alexandra and Lynedoch Streets, having 45 ft. 7 in. frontage to Alexandra Street and 74 ft. 5 in. frontage to Lynedoch Street.

As witness the hand of His Excellency the Governor, this twenty-fourth day of August, one thousand nine hundred and five.

Appointing [Commissioners to classify Pastoral Runs in Southland Land District.

IN exercise and pursuance of the powers and authorities vested in me by the one-hundred and eighty-ninth section of “The Land Act, 1892,” I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, do hereby appoint

ANDREW KINROSS

Commissioners to classify and report to me upon the rural lands in the Southland Land District known as Runs Nos. 398 and 447, 251, 329, 149, 207, 420, and 133, as provided by section one hundred and eighty-nine of “The Land Act, 1892.”

As witness the hand of His Excellency the Governor, this twenty-fourth day of August, one thousand nine hundred and five.

Notifying Small Grazing-runs in Wellington Land District under “The Bush and Swamp Crown Lands Settlement Act, 1903.”

PLUNKET, Governor.

IN pursuance and exercise of the powers and authorities conferred upon me by “The Bush and Swamp Crown Lands Settlement Act, 1903,” I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, do hereby declare that the small grazing-runs enumerated in the Schedule hereto shall be subject to the provisions of section two of the said Act, the said lands having previously been set apart for leasing under Part V. of “The Land Act, 1892”; and I do further declare that for the purposes of “The Bush and Swamp Crown Lands Settlement Act, 1903,” the runs in the said Schedule shall be deemed to be “heavy-bush land.”

WELLINGTON LAND DISTRICT.—RANGITIKEI COUNTY.—SMALL GRAZING-RUNS.

Sections Nos. 1 and 2, Block XIV., Pukeokahu Survey District; and Section No. 2a, Block II., Ruahine Survey District: Area, 4,558 acres 1 rood 37 perches.

Section No. 2, Block II., Ruahine Survey District: Area, 2,510 acres.

As witness the hand of His Excellency the Governor, this twenty-seventh day of August, one thousand nine hundred and five.

IN pursuance and exercise of the powers and authorities vested in me by the sixth section of “The Cemeteries Act, 1882,” I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, do hereby appoint

ALBERT GUNN and
WILLIAM NOBLE

to be Trustees, in the place of Thomas Gunn and George Gillingham, deceased, to provide for the maintenance and care of the Cobden Public Cemetery, in conjunction with the other persons previously appointed by His Excellency the Governor.

As witness the hand of His Excellency the Governor, this twenty-fourth day of August, one thousand nine hundred and five.
