And whereas it is expedient to revoke such Order in Council:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of every power and authority enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the aforesaid Order in Council of the fifteenth day of August, one thousand eight hundred and ninety-eight, delegating certain powers under “The Public Domains Act, 1881,” in respect of the land described in the Schedule hereto to

SCHEDULE.

SOUTH MALVERN DOMAIN.

ALL that area in the Canterbury Land District, containing by admeasurement 22 acres 3 roods, more or less, being Reserve No. 1388 (in red), Block VII., Hororata Survey District Bounded towards the north-east by Section No. 328x; towards the east by Section No. 12371, 940 links; towards the south by the Selwyn River; and towards the west by the road forming the eastern boundary of Section No. 35327, 2100 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked S.G. 38516, deposited in the Head Office of the Department of Lands and Survey, at Wellington, and thereon bordered red.

Amendment of Regulations for the Inspection and Examination of Schools.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of August, 1905.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN exercise and pursuance of the powers and authorities vested in him by “The Education Act, 1904,” the Governor, with the advice and consent of the Executive Council of the colony, doth hereby revoke clause twenty-two of the regulations made by Order in Council dated the twentieth day of April, one thousand nine hundred and four, under the provisions of “The Education Act, 1877,” and in lieu thereof doth substitute the clause set forth in the Schedule hereto, and with the like advice and consent doth prescribe that this Order shall take effect on the first publication thereof in the New Zealand Gazette.

SCHEDULE.

  1. THE standard of attainment for a certificate of proficiency shall be the same in all schools. No one shall receive a certificate of proficiency unless he—

(a.) Obtains at least 40 per cent. of the possible marks in English (including not less than 40 per cent. in each of the branches reading and composition), and at least 40 per cent. of the possible marks in arithmetic;

(b.) Obtains at least 60 per cent. of the possible aggregate marks in the following compulsory subjects—viz., English, arithmetic, geography, and drawing; and

(c.) Satisfies the Inspector that he has received sufficient instruction in the other compulsory subjects and in the additional subjects, as prescribed by these regulations.

In the compulsory subjects named in (b), the possible marks shall be in the following proportions, viz.: English, 400; arithmetic, 200; geography, 100; drawing, 100:

Provided that, if the Board of Education thinks fit, the marks to be obtained in any subject named above or in the aggregate may, until the 1st day of January, 1906, be those prescribed by clause 22 of the Order in Council of the 20th day of April, 1904.

Validating Election of Two Members of the Board of Wharehine Road District, County of Rodney.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of August, 1905.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the ratepayers of the Wharehine Road District failed to elect two members of the Board within the time prescribed by the “The Road Boards Act, 1882,” and such members were not elected for the said district until the fourth week in July last, and it is expedient to validate such election:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers vested in him by the said “Road Boards Act, 1882,” doth hereby validate the above-mentioned election, and doth declare that the two persons elected during the fourth week of July last as members of the Board of the said Wharehine Road District shall be members of the Board of the said district in the same manner as if such election had been regularly held.

“The Land Titles Protection Act, 1902.”—Consenting to an Application to the Chief Judge of the Native Land Court in pursuance of Section 39 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of August, 1905.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by an order of the Native Land Court made the twenty-sixth day of September, one thousand eight hundred and eighty-three, purporting to determine the successors to the share or interest of Arapata Hakiwai, deceased, in the land known as Ngatarawa No. 2, Horiana Taituha was declared to be one of the successors to the said share or interest: And whereas it is alleged that the said order was made in pursuance of an informal will made by the said Arapata Hakiwai, and that on the true interpretation of the said will it was the intention of the said Arapata Hakiwai that the said Horiana Taituha should take an estate for her own life in the said share or interest, with remainder to the children of the said Arapata Hakiwai, and that by some error, mistake, or omission the said order purports to vest in the said Horiana Taituha an estate of inheritance:

And whereas application has been made to His Excellency the Governor in Council to consent to the making of an application to the Chief Judge of the Native Land Court, in pursuance of the provisions of section thirty-nine of “The Native Land Court Act, 1894,” to amend the said order for the purpose of rectifying the said alleged error, mistake, or omission:

And whereas on inquiry held in pursuance of the provisions of “The Land Titles Protection Act, 1902,” the Governor is satisfied that a prima facie case has been established, and that it would be inexpedient to dispose of it by remedial legislation or any other procedure which would obviate litigation:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of all powers and authorities in that behalf vested in him by “The Land Titles Protection Act, 1902,” and of every other power and authority enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the making of an application to the Chief Judge of the said Court in accordance with the provisions of section thirty-nine of “The Native Land Court Act, 1894,” for the purpose of rectifying the said alleged error, mistake, or omission, and that the said order of the said Court made the twenty-sixth day of September, one thousand eight hundred and eighty-three, may be the subject of an order of the said Chief Judge under the said section thirty-nine of “The Native Land Court Act, 1894.”
