Extending Time for Election of Member of Wanganui Harbour Board by County of Wanganui.

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighth day of July, 1905.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The Wanganui Harbour Board Act, 1893,” it is, among other things, enacted that the elective members of the Board shall consist, inter alia, of one person qualified to be a member of the County Council of the County of Wanganui, and that on the second Monday in the month of February in every alternate year there shall be an election of the elective members of the Board:

And whereas an election was held on the thirteenth day of February, one thousand nine hundred and five, by the ratepayers of the County of Wanganui to elect a member of the said Board, which said election was on the twentieth day of March, one thousand nine hundred and five, by reason of irregularity, declared void under section fifty of “The Local Elections Act, 1904”:

And whereas a fresh election could not be held within twenty-five days after the date of such declaration as required by section fifty-three of that Act:

And whereas it is enacted by section two hundred and thirty-three of “The Harbours Act, 1878,” that in any case in which, by misadventure or accident, anything is at any time done after the time required by that Act, or is otherwise irregularly done in matter of form, the Governor may, by Order in Council duly gazetted, from time to time make provision for any such case, or may extend the time within which anything is required to be done:

And whereas it is desirable to extend the time within which the ratepayers of the County of Wanganui may elect a member of the Wanganui Harbour Board:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority vested in him by the hereinbefore-recited section of “The Harbours Act, 1878,” and of all other powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said colony, doth hereby extend the time within which the ratepayers of the County of Wanganui shall elect a duly qualified member of the Wanganui Harbour Board until Wednesday, the second day of August, one thousand nine hundred and five.

J. F. ANDREWS,
Acting Clerk of the Executive Council.

Validating the Public Notification in connection with a Loan of £1,500 applied for by the Barrett Road Board.

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighth day of July, 1905.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Barrett Road Board lately proposed to raise a loan of one thousand five hundred pounds for the purpose of forming Devon Road from Belt Road to South Road of the said Road Board district: And whereas a special order making a special loan rate has been made as security for the said loan: And whereas the provisions of section seventy-five of “The Road Boards Act 1882,” relating to special orders were not complied with by the said Board, inasmuch as public notice of such meeting for the purpose of passing the resolution making such special order, although published for four weeks successively, was not published for four successive weeks immediately preceding the day on which the subsequent meeting was held: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the said proceedings:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred by section ten of “The Local Bodies' Loans Amendment Act, 1902,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that such public notification of the special order shall be deemed and taken to be as valid as though the said notification had been properly published, and that the proceedings relative to the said loan shall not be called in question by reason only of the irregularity aforesaid.

J. F. ANDREWS,
Acting Clerk of the Executive Council.
