Removing Restrictions against Alienation of Native Land.


PLUNKET, Governor.

WHEREAS application has been made to the Governor
by the owners of the land described in the Schedule
hereto, praying that the restrictions on the alienation of
the said land contained in the Land Transfer certificate
of title (Vol. 24, folio 239) bearing date the twenty-second
day of June, one thousand eight hundred and eighty-
two, may be removed: And whereas inquiry has been duly
made by the Native Land Court, and the said Court has
recommended that such restrictions be removed:

Now, therefore, His Excellency the Governor of the
Colony of New Zealand, in pursuance and exercise of the
powers conferred upon him by the fifty-second section of
“ The Native Land Court Act, 1894,” and in accordance with
the recommendation of the Native Land Court, doth hereby
order and declare that all restrictions imposed by the said
Land Transfer certificate of title on the alienation of the said
land are hereby removed.


SCHEDULE.

ALL that piece or parcel of land, situate in the Auckland
District, containing 73 acres, more or less, known as Allot-
ment No. 14, Parish of Puniu, being the land comprised in
Land Transfer certificate of title (Vol. 24, folio 239) dated
the 22nd day of June, 1882, in favour of Waana Gage, and
containing the following restrictions: “Inalienable by gift,
sale, lease, or mortgage, except with the consent of the
Governor being previously obtained to any such gift, sale,
lease, or mortgage.

As witness the hand of His Excellency the Governor,
this fifth day of December, one thousand nine
hundred and five.

Rural Lands in Nelson Land District open for Selection on
Lease in Perpetuity.


PLUNKET, Governor.

IN pursuance and exercise of the powers and authorities
conferred upon me by section one hundred and thirty-
six of “ The Land Act, 1892,” and section two of “ The Bush
and Swamp Crown Lands Settlement Act, 1903,” I, William
Lee, Baron Plunket, the Governor of the Colony of New
Zealand, do hereby declare and provide as follows, that is to
say,--

  1. The rural lands described in the Schedules hereto are
    hereby set apart for disposal by way of selection on and after
    the seventh day of February, one thousand nine hundred
    and six, at the rentals specified in the said Schedules.

  2. The said lands may be selected on lease in perpetuity
    only, as provided by section one hundred and twenty-one of
    “ The Land Act, 1892,” as they contain, or are supposed to
    contain, metal, mineral, or valuable stone, and shall not
    be purchased for cash.

  3. For the purposes of “ The Bush and Swamp Crown
    Lands Settlement Act, 1903,” the land enumerated in the
    First Schedule hereto shall be deemed to be “ heavy-bush
    land,” and the land in the Second Schedule shall be deemed
    to be “ light-bush land.”

  4. No general rate shall be levied or collected by any local
    authority from the said lands for the period of four years
    in the case of heavy-bush land, and three years in the case
    of light-bush land, from the date from which in each case
    respectively such lands are disposed of, and no local authority
    shall have power to levy or collect any such rate from such
    lands during such period.

  5. After the first half-year’s rent has been paid by the
    selector the further instalments of rent payable by him for
    a period of four years in the case of heavy-bush land, and
    three years in the case of light-bush land, shall not be de-
    manded: provided that if at any time during the first five
    years of his occupancy the selector disposes of his interest in
    the land the rent so conceded shall be paid by him in full,

and thereupon the Land Board may remit such instalments
of rent payable by the incoming tenant, not exceeding in the
aggregate the amount of rent previously conceded to the
selector, as the Board shall think fit.

GENERAL DESCRIPTION OF HEAPHY BLOCK.

This block is situated on the west coast of Nelson Land
District, between the Heaphy River and Gunner Creek on the
north and the Kohaihai River on the south. It is well and
permanently watered.

The soil is generally rather poor, but it is good along the
coast and within a mile back from the Heaphy River. The
formation is principally granite, but there are good limestone
outcrops at Kohaihai Bluff and generally within a mile of
the Heaphy River.

The land is forest-clad, the timber consisting principally
of brown- black- and silver-birch, kamahi, and a little totara
and rimu, but not in sufficient quantity to make it of value
for milling purposes.

The altitude of the country varies from sea-level to about
3,500 ft.

The land when cleared and grassed will be suitable for
pastoral purposes.

The climate is remarkably even and temperate, rather
humid in winter, and considerably hot in summer, although
the heat is tempered by the sea-breeze. The rainfall is pro-
bably less than at Karamea, and considerably less than at
Westport.

Access to the northern portion of the block is from Colling-
wood, a distance of about fifty-seven miles along a well-formed
bridle-track. Access from the south is from Karamea via the
beach by horse or vehicle at low spring tide to the mouth of
the Kohaihai River, a distance of 10¼ miles. At ordinary
low tides, however, horses can only be taken along the beach
for about nine miles.

The hotel nearest to the block is at Karamea, and the
nearest settler (at whose place horses may be left) is Mr.
G. T. Harris, who occupies Section No. 4, Block I., Oparara,
about eight miles from Karamea. Mr. Harris has a hut with
bunks therein, which can probably be made available for the
temporary accommodation of people wishing to inspect the
land. There is another settler—Mr. J. R. Simpson—who
occupies Section No. 15, Block V., Oparara, he and Mr.
Harris being the only residents along the beach north of the
Oparara River.

Good coal has been found in Gunner Creek, and fair-quality
ligneous coal has been found on the high ground along the
Collingwood and Heaphy Track.

The River Heaphy is navigable by small steamers, and
about a quarter of a mile up the river from the mouth there
is a good anchorage.

The nearest school to the Heaphy Block is situated on the
left bank of the Oparara River near the bridge.

It is proposed to form bridle-tracks from the Kohaihai
River up the coast and up the Gunner Creek.

hundred and five.
