Altering the Boundaries of the Land Registration Districts of Auckland and Taranaki.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of December, 1903.

Present:

THE HONOURABLE SIR J. G. WARD PRESIDING IN COUNCIL.

WHEREAS by section three of “The Land Transfer Act, 1885,” it is enacted that the Governor may, by Order in Council, from time to time alter the boundaries of any land registration district: And whereas it is desirable to alter the boundaries of the Auckland and Taranaki Land Registration Districts in manner hereinafter appearing:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred on me by the hereinbefore-in-part-recited Act, and by and with the advice and consent of the Executive Council of the said colony, do hereby order that from and after the date hereof the boundaries of the Land Registration Districts of Auckland and Taranaki shall be as described in the Schedule hereto.


SCHEDULE.

AUCKLAND LAND REGISTRATION DISTRICT.

Bounded towards the north and north-east generally by the ocean from Cape Maria Van Diemen to the north-eastern corner of Whangaparaoa No. 2 Block: thence towards the south-east generally by the Hawke’s Bay Land District, as described in the New Zealand Gazette No. 30, 28th April, 1898, to the Ngaruroro River: thence towards the south-west generally by the Wellington Land District, as described in the New Zealand Gazette No. 30, 28th April, 1898, to the confluence of the Wanganui and Ongaruhe Rivers; thence by a line along the middle of the Ongaruhe River to its confluence with the Waimēha Stream; thence by a line along the middle of the Waimēha Stream to a point bearing south 45° east from the source of the Mokau River; thence by a right line to the source of the said Mokau River, and by a line along the middle of that river to the ocean: and thence towards the west and south-west generally by the ocean to the place of commencement: including the adjacent islands and the Kermadec Islands.

TARANAKI LAND REGISTRATION DISTRICT.

Bounded towards the north-west and north generally by the Auckland Land District, hereinbefore described, from the mouth of the Mokau River to the Waimēha Stream; thence towards the east generally by the said Auckland District to the confluence of the Wanganui and Ongaruhe Rivers; thence by the Wellington Land District, as described in the New Zealand Gazette No. 30, 28th April, 1898, to the ocean; and thence towards the south-west and west generally by the ocean to the place of commencement.

ORDER IN COUNCIL.

WHEREAS by “The Deeds Registration Act, 1868,” section four, it is enacted that the Governor may, by Order in Council, from time to time define and alter the limits of any deeds registration district under the said Act: And whereas it is desirable to alter the boundaries of the Auckland and Taranaki Deeds Registration Districts in manner hereinafter appearing:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred on me by the hereinbefore-in-part-recited Act, and by and with the advice and consent of the Executive Council of the said colony, do hereby order that from and after the date hereof the boundaries of the said Auckland and Taranaki Deeds Registration Districts shall be as described in the Schedule hereto.

Excepting Land from the Operation of Section 117 of “The Native Land Court Act, 1894.”

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of December, 1903.

Present:

THE HONOURABLE SIR J. G. WARD PRESIDING IN COUNCIL.

WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bona fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act:

And whereas Riwait Rimitiriu, of Wanganui, in the Colony of New Zealand, being an owner of the block or parcel of land known as Pakaraka No. 1k, has applied to be allowed to lease the same: And whereas the Aotea District Maori Land Council has recommended that the said land be excepted from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of lease as aforesaid:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred by section four of “The Native Land Laws Amendment Act, 1895,” and by and with the advice and consent of the Executive Council of the said colony, doth hereby except from the operation of section
