one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of lease, for a period not exceeding fourteen years, all that block or parcel of land, situate in the Provincial District of Wellington, containing one hundred and seventy-nine acres, more or less, known as Pakaraka No. 1k, and being the land comprised in partition order of the Native Land Court dated fourteenth December, one thousand nine hundred, in favour of Riwai Rimitiriu and another.

Vesting a Reserve in the Waipa County Council.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of December, 1903.

Present:

THE HONOURABLE SIR J. G. WARD PRESIDING IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto has been permanently set aside as a gravel reserve: And whereas, in the opinion of the Governor, it is expedient to vest the said land in the Waipa County Council:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that from and after the day of the date hereof the reserve mentioned in the Schedule hereto shall become vested in “The Chairman, Councillors, and Inhabitants of the Waipa County,” in trust, for gravel purposes.


SCHEDULE.

ALL that area in the Auckland Land District, containing by admeasurement 2 acres, more or less, being Section No. 286 (Block XIII., Komakorau Survey District), Parish of Pukete. Bounded towards the north-east by the Waikato River, towards the south-west by a public road, and towards the north-west by Section No. 34, Pukete Parish: as the same is delineated on the plan marked S.G. 50722, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon bordered red.

Withdrawing Land from the Operation of “The Kauri-gum Industry Act, 1898.”

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of December, 1903.

Present:

THE HONOURABLE SIR J. G. WARD PRESIDING IN COUNCIL.

WHEREAS by “The Kauri-gum Industry Amendment Act, 1902” (hereinafter termed “the said Act”), it is enacted that the Governor may by Order in Council declare that land set apart under “The Kauri-gum Industry Act, 1898” (hereinafter termed “the principal Act”), as a kauri-gum reserve, and which is no longer required for the purpose of gum-digging, shall be no longer subject to the principal Act, and shall thereafter be dealt with by the Land Board as ordinary Crown land; provided that such Order in Council shall only be issued in pursuance of a resolution of the Land Board, supported by such independent evidence as the Governor in Council deems necessary:

And whereas the Land Board of the Auckland Land District has duly passed a resolution recommending that the portion of the Ngapipito Kauri-gum Reserve described in the Schedule hereto be excepted from the operation of the principal Act, and it is expedient to give effect to such recommendation:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in pursuance of the power and authority conferred upon me by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, do hereby order and declare that the portion of the Ngapipito Kauri-gum Reserve described in the Schedule hereto shall be no longer subject to the provisions of the principal Act, and shall hereafter be dealt with by the Land Board as ordinary Crown land.


SCHEDULE.

ALL that area in the Auckland Land District, situate in Block V., Motatau Survey District, Bay of Islands County, containing by admeasurement 1,375 acres, more or less,

being portion of Ngapipito Kauri-gum Reserve, set apart by Order in Council dated 14th March, 1900, and published in the New Zealand Gazette No. 23, of 22nd March, 1900, page 592. Bounded towards the north by part of the southern boundary of Block I., Motatau Survey District; towards the east generally by unadjudicated Native land; towards the south-west by the Punakitere Stream; and towards the west by unadjudicated Native land, to the point of commencement: as the same is delineated on the plan marked S.G. 51290, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon bordered red.

THE HONOURABLE SIR J. G. WARD PRESIDING IN COUNCIL.

WHEREAS by section twenty-nine of “The Public Works Act, 1894” (hereinafter termed “the said Act”), it is enacted that if it is found that any land held, taken, or acquired at any time under that Act, or any other Act or Provincial Ordinance, or otherwise howsoever, for any public work, is not required for such public work the Governor may, by an Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act:

And whereas the parcels of land described in the Schedule hereto are not now required for a public work—that is to say, for road purposes—and the Minister for Public Works has recommended that this Order in Council should be issued authorising such parcels of land to be sold:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise and pursuance of the powers and authorities aforesaid, do hereby authorise the land described in the Schedule hereto to be dealt with and sold in the manner and subject to the conditions of the twenty-ninth and following sections of the said Act.


SCHEDULE.

ALL that road, in length about 62 chains, and containing about 6¼ acres, bounded on the south-west by Sections Nos. 40 and 41, and on the north-east by Sections Nos. 34 and 36, all in Block VII., Clifford Bay Survey District: also all that road, in length about 74 chains, and containing about 7½ acres, bounded on the south-west by Section No. 32, Block VII., and on the north-east by Section No. 31, Block VIII., in the Clifford Bay Survey District: be the above-mentioned distances and areas either more or less: all in the Land District of Marlborough: as the said roads are delineated on the plan marked P.W.D. 20363, deposited in the office of the Minister for Public Works, at Wellington, in the Provincial District of Wellington, and thereon coloured red.

IN pursuance and exercise of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the eighteenth day of April, one thousand eight hundred and ninety-eight, making delegation of certain powers in manner as therein appears; and doth hereby, with the like advice and consent, and in respect of the land hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten
