WAIMEA COUNTY BY-LAWS.
IN pursuance of the powers conferred by “The Public Works Act, 1894,” and every other Act or Acts amending the same, the Council of the County of Waimea makes the following by-laws :—
PART III.—LIGHTING, ETC.
- (a.) No person shall drive any vehicle or permit the same to be driven or to stand upon any road, or ride any bicycle or tricycle upon any road, during the night between the hours of half an hour after sunset and one hour before sunrise, unless such vehicle shall have two proper lamps, one on either side thereof, and each bicycle or tricycle shall have one lamp attached thereto, alight, and plainly visible to any person approaching or being approached by such vehicle or bicycle or tricycle.
(b.) No person shall ride any bicycle or tricycle, or ride or drive any animal or vehicle, upon any footpath or across any bridge within the county intended for foot-passengers only.
BRIDGES.
- No person shall cause, conduct, or procure to be conducted across any bridge within the county,—
(a.) The passage of any animal or vehicle faster than at a walking pace ;
(b.) The passage of any vehicle which together with the load thereon exceeds six tons in weight ;
(c.) The passage of any animal or vehicle which together with the load thereon exceeds the limit defined in any public notice relating to the same, and a copy of which shall have been posted thereon or adjacent thereto.
PART IV.—WHEEL-TIRES.
- (a.) No person shall use or drive upon any road any four-wheeled vehicle which together with the load thereon weighs over four tons, but is under five tons, unless the tires upon the wheels of such vehicle shall be at least four inches in width.
(b.) No person shall use or drive upon any road any four-wheeled vehicle which together with the load thereon weighs five tons or more than five tons unless the tires upon the wheels of such vehicle shall be at least five inches in width.
PART V.—LICENSING OF VEHICLES.
- Every four-wheeled vehicle used upon any road for the transportation of goods which together with the load thereon weighs four tons or over shall be licensed by a license issued by and under the hand of the Clerk.
- Before any such license shall be issued, an application shall be made to the Council, in the appointed form, signed by the person applying for such license, and giving all such information as shall be required by or provided for in such form, and the fee payable in respect of such license shall be deposited with the application.
- The Council, upon any reason which it may consider sufficient being shown, may, in respect of any vehicle, refuse to authorise the issue of a license, or to renew any license, and may at any time, by notice in writing under the hand of the Clerk, delivered to the owner or left at or posted by registered letter to his last known place of abode or business, cancel or suspend any such license.
- The Clerk may renew any license against which no objection has been lodged or conviction recorded, and no written application shall be necessary: provided that the Clerk may require any applicant for a renewal of such license to submit his application in writing, and may reserve the same for the next meeting of the Council to be held thereafter.
- Every license shall be registered in a book to be kept by the Clerk in the appointed form.
- A license fee of ten pounds sterling per annum shall be paid by the owner of such vehicle to the Clerk in respect of every such license issued or renewed : provided that
Licenses may be issued for three, six, or nine months, with a proportionate reduction in the license fee. - Licenses shall date from the first day of the month in which they are issued.
- No person shall cause, conduct, or procure to be conducted any traffic upon any road by means of any four-wheeled vehicle which together with the load thereon weighs four tons or over, a license in respect of which has not been issued or renewed or which has been cancelled or suspended.
- No person shall use or procure to be used upon any road any licensed vehicle unless the said vehicle shall have painted upon some conspicuous place on the off side thereof the name and address of the owner, the registered number of the license, and the weight of such vehicle.
PART VII.—LICENSING AND REGULATING THE TRAFFIC OF ENGINES.
- The Council may authorise the issue of a license in respect of any engine used or kept within the county.
- Every license shall be registered in a book kept by the Clerk in the appointed form.
- The owner of every engine kept or used within the county shall, in the first week in January in each year, or within ten days after bringing any engine into the county, make application to the Council for a license in respect of such engine on the appointed form, and giving all such information as may be required by or provided for in such form.
- Every license in respect of an engine shall be issued by and under the hand of the Clerk.
- A license fee of one pound sterling, to be deposited with the application, shall be paid by the owner of such engine in respect of every such license issued or renewed.
- Upon the appointed form being filled in by the owner the Clerk may renew any license against which no objection has been lodged or conviction recorded; provided that he may reserve such application for the next meeting of the Council to be held thereafter.
- No person shall use any engine upon any road, or keep any engine within the county, unless and until such engine shall have been licensed by a license issued by and under the hand of the Clerk as hereinbefore provided.
- The exact and true weight of every engine, and the registered number of the license pertaining thereto, together with the name and address of the owner, shall be painted or affixed to the off side on some conspicuous part of such engine.
- The driver of every engine shall give every possible space on the roadway for the passage of other traffic.
- No person being in charge of any engine shall drive, or cause or permit to be driven, such engine along any road in the county at a speed exceeding five miles an hour, nor through any town or village in the county at a speed exceeding three miles an hour, nor over any bridge in the county at a speed exceeding two miles an hour.
- No person shall blow off steam or water from any engine upon any road for any purpose whatsoever, nor shall any person allow the steam of any engine to attain a pressure such as to exceed the limit fixed by the safety-valve.
- No person being in charge of any engine shall allow such or any carriage attached thereto to be stopped or to remain stationary upon any bridge or culvert in the county for any purpose whatever.
- No person shall take any engine or carriage attached thereto on to any bridge in the county while any person with a horse, or vehicle drawn by a horse, or any stock, is on or about to come upon the said bridge.
- No person shall discharge ashes or other refuse from any engine upon any road within three chains of any bridge or culvert, or upon the formation of any road, or in any ditch or drain pertaining thereto.
- The person in charge of an engine using any road shall give immediate notice to the County Engineer, Overseer, or Clerk of any damage or injury done by such engine, or vehicle attached thereto, to any road or to anything pertaining to such road, and, in addition to giving such notice as aforesaid, shall, if a danger to the travelling public has been created, place, and maintain for such time as the County Engineer or Overseer may direct, such protection and signals as shall be sufficient to give warning to all persons using the road by day or by night of the existence of such danger.
- No person being in charge of any vehicle which together with the load thereon shall be of any weight less than four tons shall allow such vehicle to be drawn by any engine upon any road unless the tires upon the wheels of such vehicles shall be at least four inches in width.
- No person being in charge of any vehicle which together with the load thereon weighs four tons or over shall allow such vehicle to be drawn by any engine upon any road unless the tires upon the wheels of such vehicles shall be at least five inches in width.
- No person in charge of any engine shall cause or allow such engine to draw upon any road any carriage or vehicle which together with the load thereon shall exceed six tons in weight.
- The driver shall be considered to be the person in charge of the engine, and he will be responsible under these by-laws for his own acts and omissions, and for the acts and omissions of his subordinates, or other persons accompanying the engine; and if the owner also be present he likewise will be held responsible, but his presence shall not exonerate the driver.
- The transportation of or passage of any engine over any road or bridge shall be considered to be “extraordinary traffic” within the meaning of section 138 of “The Public Works Act, 1894,” and the person in charge, together with the owner, will be held liable for any damage arising out of such traffic.
