THE following special order, made by the Courtenay Road Board, is published in accordance with the provisions of "The Road Boards Act, 1882."

COURTENAY ROAD BOARD, COUNTY OF SELWYN.
SPECIAL ORDER made by the Courtenay Road Board at a Special Meeting held on Tuesday, the 5th day of March, 1901.
The following by-laws, for regulating the conditions on which traction-engines engaged in heavy traffic may be allowed to pass along the public roads within the Courtenay Road District, and providing for a yearly license-fee on any traction-engine engaged in heavy traffic within the said district; for providing that the transportation on roads within the district of traction-engines engaged in heavy traffic shall cease during the months of June, July, August, and September; and for imposing penalties for the breach of the by-laws, be now confirmed and adopted in form of special order, namely:-

BY-LAWS OF THE COURTENAY ROAD DISTRICT.

In pursuance of the powers, provisions, and authorities contained in "The Road Boards Act, 1882," "The Public Works Act, 1894," and the Acts amending the same, and of all other enabling powers, provisions, and authorities contained in any other Acts, or otherwise vested in them, the inhabitants of the Courtenay Road District, by the Courtenay Road Board (hereinafter called the "Road Board"), do hereby make and ordain the following by-laws for regulating the conditions on which traction-engines engaged in heavy traffic may be allowed to pass along the public roads within the said road district, and for providing for a yearly license-fee on any traction-engine engaged in heavy traffic within the said district, and for providing that the transportation on the roads within the said district of traction-engines engaged in heavy traffic shall cease during the months of June, July, August, and September, and for imposing penalties for the breach of the by-laws:-

  1. The term "traction-engine" or "engine," where used in these by-laws, means any locomotive engine, not being used on a railway or a tramway, propelled by steam-power or by any other power applied to engines used for the purpose of hauling or carrying goods.

The term "road" shall have the meaning given to it in section 100 of "The Public Works Act, 1894," and, unless repugnant to the context, shall include everything mentioned or referred to in the said section as being included in the word "road" where used in the said Act.

"District" means the Courtenay Road District.

"Heavy traffic" shall have the meaning given to it by subsection (1) of section 130 of "The Public Works Act, 1894."

"Clerk of the Board" means the Clerk of the Courtenay Road Board.

  1. No person shall use any traction-engine which, of itself or together with any thing or things carried thereon, shall weigh more than one ton and a half avoirdupois to each pair of wheels, on a road within the district, unless such engine shall be duly licensed in manner hereinafter mentioned.

  2. Any person owning or using a traction-engine who shall desire to obtain a license to use the same on roads within the district shall deliver at the office of the Road Board an application in writing, signed by him, pursuant to the form contained in Schedule B to this by-law or to the like effect, describing such engine; and for every such license granted there shall be paid to the Clerk of the Board such sum or sums of money, to be placed to the credit of the Road Board fund, as are respectively specified in Schedule A to this by-law.

  3. Licenses for traction-engines may be in the form contained in Schedule C hereunder, or to the like effect, and shall, except as therein mentioned, continue in force for one year from the date of issue and no longer.

  4. In every such license shall be specified the number and duration of the license, the name and place of abode of the owner of the traction-engine in respect of which the license is granted, the description of the engine, and the weight of the engine when loaded and when unloaded.

  5. No person shall use on a road within the district a traction-engine required by this by-law to be licensed unless such engine shall have painted in some conspicuous place on the off side thereof, in white letters and figures on a black ground, such letters not to be less than 1 in. in length, and such figures not less than 6 in. in length, and of proportionate breadth respectively, the full name of the owner of such engine, and the number of the license which shall then be in force in respect of such engine.

  6. The driver of every traction-engine required by this by-law to be licensed shall have the license for the same in his immediate personal possession, and shall, whenever required by the Clerk of the Board, or by any other person having a general authority in that behalf signed by the Clerk of the Board, or by any officer or constable of the police, produce such license for inspection forthwith. Any driver who shall, on being so required, refuse or fail forthwith to produce such license shall be guilty of a breach of this by-law.

  7. The driver or other person in charge of any traction-engine within the district, as well as the owner and the person in possession of any such traction-engine, shall be liable for any breach of these by-laws.

  8. The haulage or transportation on the roads within the said district of any traction-engine coming under the denomination of heavy traffic within the meaning of clause (a) of section 130 of "The Public Works Act, 1894," during the months of June, July, August, and September in any year shall cease.

  9. Any person committing a breach of or failing to comply with any of the provisions of this by-law shall for each and every such offence be liable to a penalty not exceeding the sum of Β£5.

Schedule A.-License-fee to be paid annually by the Owner of any Traction-engine as mentioned or defined by Section 2 of this By-law.

(a.) For a traction-engine, if and while used only in transporting threshing-machine, chaff-cutting, or saw-bench plant belonging to the person owning or using the said engine 1 0 0

Schedule B.-Application for a License for a Traction-engine.

Now, therefore, I, the Clerk of the said Road Board, by the authority and on behalf of the said Road Board, do hereby license the said traction-engine to be used on roads within the Courtenay Road District for the period of one year from the date hereof and no longer, except during the whole of the months of June, July, August, and September in the said year, subject to the said by-laws and to such other by-laws as may from time to time be in force within the said road district.

  1. These by-laws shall come into force within the district as soon as they shall have been gazetted.
