Excepting Land from Operation of Section 117 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this ninth day of July, 1900.

Present:

His Excellency the Governor in Council.

WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bonâ fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred by section four of “The Native Land Laws Amendment Act, 1895,” and by and with the advice and consent of the Executive Council of the said colony, doth hereby except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of lease, all the estate, right, title, and interest of Uru te Angina in the block or parcel of land, situate in the Provincial District of Wellington, containing five hundred and thirty-nine acres one rood twelve perches, more or less, known as Mangatipona West D No. 2, and being the land comprised in a partition order of the Native Land Court, dated the twenty-ninth day of November, one thousand eight hundred and ninety-five, in favour of Aperahama Tipae and others.

Declaring Junction Road from Durham Road to Inglewood, in the Moa Road District, to be a County Road.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this ninth day of July, 1900.

Present:

His Excellency the Governor in Council.

IN pursuance and in exercise of the powers vested in him by section one hundred and two of “The Public Works Act, 1894,” and of all other powers in anywise enabling him in this behalf, His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the road in the Moa Road District and Inglewood Town District described in the Schedule below shall, on and after the date above mentioned, be a county road.


SCHEDULE.

THAT portion of the road known as Junction Road, including all the bridges on the same, which lies between Durham Road and the railway-station at Inglewood: as the same is delineated on the plan marked S.G. 12673A, deposited in the Head Office of the Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon coloured blue.

Shooting Season for Native Game extended.

RANFURLY, Governor.

WHEREAS by notifications under “The Animals Protection Act, 1880,” published in the New Zealand Gazette of the sixteenth day of March, the twelfth day of April, and the ninth day of May, one thousand nine hundred,
it was declared that native game, with certain exceptions, might be taken or killed within the districts specified in the said notifications from the thirty-first day of March, one thousand nine hundred, to the thirtieth day of June, one thousand nine hundred, both days inclusive: And whereas it is expedient to extend the time within which native game may be taken or killed within the said districts:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise of the powers vested in me by the said “Animals Protection Act, 1880,” and the Acts amending the same, do hereby notify and declare that native game, excepting the species mentioned in the Schedule hereto, may be taken or killed until the 31st day of the month of July, one thousand nine hundred, throughout the said several districts, with the exception of the several areas or parts of districts especially exempted in the said notifications respectively.


SCHEDULE.

SPECIES NOT TO BE TAKEN OR KILLED.

In all districts: Tui, huia, white heron, and crested grebe. In Wellington District: Paradise duck and blue mountain-duck. In Marlborough District: Pukeko. In Otago District: Wild geese and bittern. In Southland District: Great kiwi (roaroa), morepork owl (ruru), and bittern.

As witness the hand of His Excellency the Governor, this fifth day of July, one thousand nine hundred.

Rural Lands in the Marlborough Land District open for Selection on Lease in Perpetuity.

RANFURLY, Governor.

IN pursuance and exercise of the powers and authorities conferred upon me by the one-hundred-and-thirty-sixth section of “The Land Act, 1892,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, having received the report of the Surveyor-General in this behalf, as in the said section is provided, do hereby declare that the rural lands described in the Schedule hereto shall be open for selection on and after the twenty-ninth day of August, one thousand nine hundred; and that the land mentioned in the said Schedule may be selected on lease in perpetuity only, in accordance with the provisions of section one hundred and twenty-one of the said Act, as it contains, or is supposed to contain, metals, minerals, or valuable stone; and I do hereby also fix the prices at which the said lands shall be leased, as mentioned in the said Schedule hereto, and do declare that the said lands shall be leased under and subject to the provisions of “The Land Act, 1892.”

Section 9, Block IV.: All bush; fire has been through greater portion; fair soil; well watered; about 50 acres roughly sown with grass. About sixteen miles from Blenheim. Weighted with £22 17s. 6d., valuation for improvements.

Section 10, Block IV.: All bush; fire has been through greater portion; fair soil; well watered; about 60 acres roughly sown in grass. About sixteen miles from Blenheim. Weighted with £18, valuation for improvements.

Section 17, Block VIII.: All bush; fire has been through greater portion; very broken; pastoral; well watered; fair soil. About seventeen miles from Blenheim.
