in Section No. 1 aforesaid; including all adjoining and
intervening places, roads, tracks, rivers, streams, and water-
courses: all in the Provincial District of Auckland: as the
same is delineated on the plan marked P.W.D. 18826, de-
posited in the office of the Minister for Public Works at
Wellington.
Given under the hand of His Excellency the Right
Honourable Uchter John Mark, Earl of Ranfurly;
Knight Commander of the Most Distinguished
Order of Saint Michael and Saint George;
Governor and Commander-in-Chief in and over
Her Majesty’s Colony of New Zealand and its
Dependencies; and issued under the Seal of the
said Colony, at the Government House, at Wel-
ington, this twenty-eighth day of April, in the
year of our Lord one thousand nine hundred.

"The Education Act, 1877."—Payments to Education Boards.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twen-
tieth day of April, 1900.
Present:
THE HONOURABLE J. G. WARD PRESIDING IN COUNCIL.
IN exercise and pursuance of the powers and authorities
vested in him by “The Education Act, 1877,” His
Excellency the Governor, with the advice and consent of
the Executive Council of the colony, doth hereby make the
regulation hereto annexed regarding certain payments of
capitation allowance to Education Boards; and, with the
like advice and consent, doth hereby prescribe that this
Order shall come into force on the date of the first publica-
tion thereof in the New Zealand Gazette.
REGULATION.
Notwithstanding anything to the contrary contained in
an Order in Council made on the 5th day of January, 1888,
under the provisions of “The Education Act, 1877,” relating
(inter alia) to attendance registers and returns, the payment
of capitation allowance to Education Boards for the quarter
ending on the 30th day of June, 1900, shall be according to
the working-average attendance of the quarter ending on the
31st day of March, 1900, as “working average” was defined
by Order in Council dated the 5th day of July, 1887, and
made under the provisions of the before-mentioned Act.

Declaring a Road in the Moa Road District to be a County
Road.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twen-
tieth day of April, 1900.

THE HONOURABLE J. G. WARD PRESIDING IN COUNCIL.
IN pursuance and in exercise of the powers vested in him
by section one hundred and two of “The Public
Works Act, 1894,” and of all other powers in anywise
enabling him in this behalf, His Excellency the Right
Honourable Uchter John Mark, Earl of Ranfurly, the
Governor of the Colony of New Zealand, by and with the
advice and consent of the Executive Council of the said
colony, doth hereby order that the road in the Moa Road
District described in the Schedule below shall, on and after
the date above mentioned, be a county road.
SCHEDULE.
That portion of the road known as Junction Road, including
all the bridges on the same, which commences at Durham
Road, and proceeds in a generally easterly direction to
Tarata Bridge, over the Waitara River; as the same is
delineated on the plan marked S.G. 12673, deposited in the
Head Office of the Department of Lands and Survey, at
Wellington, in the Wellington Land District, and thereon
coloured red.

Vesting a Reserve in the Omaha Road Board.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twentieth
day of April, 1900.

THE HONOURABLE J. G. WARD PRESIDING IN COUNCIL.
WHEREAS the land described in the Schedule hereto
was permanently reserved as a site for a public
library, mechanics’ institute, and athenæum, on the ninth
day of December, one thousand eight hundred and ninety-
nine:
And whereas, in the opinion of the Governor, it is expe-
dient that the said land should be vested in the Omaha Road
Board:
Now, therefore, His Excellency the Governor of the
Colony of New Zealand, acting by and with the advice and
consent of the Executive Council of the said colony, and in
exercise of the powers and authorities vested in him by the
fourth section of “The Public Reserves Act, 1881,” doth
hereby declare that, from and after the day of the date
hereof, the reserve mentioned in the Schedule hereto shall
become vested in “The Inhabitants of the Omaha Road
District,” in trust, as a site for a public library, mechanics’
institute, and athenæum.
SCHEDULE.
All that parcel of land in the Auckland Land District, being
Section No. 156b of the Parish of Omaha, and containing by
admeasurement 2 roods, more or less. Bounded towards
the north-east and south-east by Section No. 156a of the
Parish of Omaha, 250 and 200 links respectively; towards
the south-west by Section No. 156b of the Parish of Omaha,
250 links; and towards the north-west by a public road, 200
links, to the point of commencement: be all the aforesaid
linkages more or less.

Native Land Court Act, 1894.”

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twentieth
day of April, 1900.

THE HONOURABLE J. G. WARD PRESIDING IN COUNCIL.
WHEREAS by section four of “The Native Land Laws
Amendment Act, 1895,” it is enacted that the
Governor may, by Order in Council, except from the
operation of section one hundred and seventeen of “The
Native Land Court Act, 1894” (hereinafter called “the said
Act”), for a limited period or otherwise, and either generally
or for such purposes and subject to such restrictions as shall
be in such Order specified, any land, wheresoever situate,
which is for the time being subject to the operation of the
said section, or any interest therein or right over the same,
or may in like manner make such exception in favour ex-
clusively of any lessee or other person who has been bonâ
fide in occupation of and has made improvements on such
land, or has paid money to Native owners for lease or pur-
chase thereof, prior to the passing of the said Act: Provided
that no Order in Council under the provisions of this section
shall take effect until after the expiration of two months from
the date of the publication thereof in the Gazette: Provided
also that every alienation under the provisions of this sec-
tion shall be confirmed by the Court in terms of section
fifty-three of the said Act:
Now, therefore, His Excellency the Governor of the
Colony of New Zealand, in pursuance and exercise of the
power and authority conferred by section four of “The
Native Land Laws Amendment Act, 1895,” and by and
with the advice and consent of the Executive Council
of the said colony, doth hereby except from the operation
of section one hundred and seventeen of “The Native
Land Court Act, 1894,” for the purpose of alienation by way
of sale, all that block or parcel of land, situate in the Pro-
vincial District of Auckland, containing three hundred and
five acres three roods twenty-four perches, more or less,
known as Okahuatiu No. 1d 2b⁸, and being the land com-
prised in a partition order of the Native Land Court, dated
the sixth day of August, one thousand eight hundred and
ninety-seven, in favour of Peti Aata.
