  1. The Secretary of the said society, or his deputy, may issue licenses for the whole season to women for the sum of five shillings each; and to boys under the age of sixteen years for the whole season for the sum of ten shillings each; and to men, on and after the fifteenth day of January in any year, and until the fifteenth day of April in the same year, for the sum of twelve shillings and sixpence each.

  2. Any holder of a license may fish with one rod and line for trout, and may use a landing-net or gaff to secure any trout caught with such rod and line, in all waters within “The Auckland Acclimatisation District,” from the first day of November in any one year to the fifteenth day of April in the year following, both inclusive.

  3. No license shall authorise any person other than the person named therein to fish, and that with natural or artificial fly, insect, worm, or fish only.

  4. No person shall have in his possession any of the salmonidæ or trout between the eighteenth day of April and the thirty-first day of October, which period is hereby appointed a close season for all such fish: Provided always that this regulation shall not apply to fish caught by the officers of the said society for purposes of acclimatisation.

  5. No person shall put, throw, or place, or allow to be put, thrown, or placed, into any river or stream, or at the mouth or entrance of any such river or stream, any dynamite or other explosive substance, or any sawdust or sawmill refuse, or anything of any kind or description whatever poisonous, deleterious, or noxious to fish.

  6. No person shall take, fish for, catch, or kill, in any manner whatever, or have in his possession, any salmon, salmon-parr, or smolts, or the ova, young, or fry of any salmon in any stage whatever; and any of the above-named taken by accident or otherwise shall immediately be returned to the water from whence it was taken.

  7. No person shall fish for trout without a license; and every person fishing shall, on demand of any ranger, constable, member of the said society, or person producing a license, produce and show to such ranger, member, constable, or person his license, and the contents of his creel or bag, and the bait used by him for taking, catching, or killing such trout.

  8. Every trout not exceeding nine inches in length from nose to tip of tail, taken or caught by any person, shall immediately be returned alive into the water from which the same is taken.

  9. No cross-line fishing, stroke-hauling, or any other unsportsmanlike device shall be used for the purpose of taking, catching, or killing trout; nor shall any of the above-mentioned baits be used with any medicated or chemical preparation whatever.

  10. Except as aforesaid, no person shall fish with or use any net or other engine, instrument, or device for taking fish in any river or stream within the district aforesaid, or at the mouth or entrance of any such river or stream.

  11. For the purposes of these regulations, the mouth of every such river or stream shall be deemed to include every outlet of the same and the sea-shore between such outlets, and shall extend over a radius of one-quarter of a mile from the point or line where the waters of such river or stream meet those of the sea or of any harbour at low water.

  12. No person shall buy, sell, or expose or offer for sale, or shall fish for the purpose of obtaining for sale, any salmon, trout, or any part thereof.

  13. The penalty for the breach of any of these regulations shall not be less than forty shillings or more than fifty pounds.

  14. If any person shall be convicted of any offence against these regulations the license (if any) held by the offender shall thereupon become void.

Powers delegated to the Happy Valley Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-third day of October, 1899.

Present:

His Excellency the Governor in Council.

IN pursuance and exercise of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-sixth day of November, one thousand eight hundred and eighty-five, making delegation of certain powers in manner as therein appears; and doth hereby, with the like advice and consent, and in respect of the land hereinafter mentioned, delegate all the powers con-

ferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the under-mentioned persons, who shall be known as the Happy Valley Domain Board, namely,—

MICHAEL MOFFITT, of Waikaia, Gentleman;
COLIN ROBERTSON, of Waikaia, Farmer;
JAMES HANDYSIDE, of Waikaia, Storekeeper;
JOSEPH DAVIDSON, of Waikaia, Farmer; and
JOHN MACK, of Waikaia, Station-manager

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the first Thursday in each month, at half-past seven o’clock p.m., at the office of James Handyside, Wellington Street, Waikaia, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Thursday, the seventh day of December, one thousand eight hundred and ninety-nine.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Thursday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  7. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  8. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

And with the like advice and consent as aforesaid doth hereby also order that this delegation shall take effect in respect of the parcel of Crown lands described in the Schedule hereto.


SCHEDULE.

ALL that parcel of land in the Otago Land District, containing by admeasurement 55 acres, more or less, situate in the Waikaia Survey District, and being Section No. 7, Block III. Bounded towards the north-west by Section No. 10 of the same block, 1900 links; towards the north-east by Section No. 1 of Block X. of same district, 2650 links, also by a road-line 38·8 links; towards the south-east by a road-line, 2333·7 links; and towards the south-west by a road-line, 2096 links and 600 links: be all the aforesaid linkages more or less.

WHEREAS by Order in Council dated the twenty-eighth day of February, one thousand eight hundred and ninety-nine, and published in the New Zealand Gazette of the sixteenth day of March, one thousand eight hundred and ninety-nine, a regulation was made providing for the use of Government telephones on Sundays for the purpose of conversing between certain telegraph-offices within the colony: And whereas it is desirable to alter such regulation so as to provide for such use of Government telephones on other days besides Sundays:
