Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Commander of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this nineteenth day of December, in the year of our Lord one thousand eight hundred and ninety-nine.

A PROCLAMATION.
WHEREAS the Kelburne and Karori Tramway Company (Limited), as the delegate of the Corporation of the Mayor, Councillors, and Citizens of the City of Wellington (being the “local authority” of the said city), has made application, under the provisions of “The Tramways Act, 1894,” “The Public Works Act, 1894,” and “The Wellington High Levels Tramway Act, 1898,” to take the land described in the First Schedule hereto and the subsoil described in the Second, Third, Fourth, Fifth, and Sixth Schedules hereto for the purposes of a public work—namely, the Kelburne and Karori Tramway, authorised to be constructed by an Order in Council made and issued under the first-mentioned Act, and dated the tenth day of July, one thousand eight hundred and ninety-nine:
And whereas all conditions precedent required by law to be observed and performed prior to the issue of this Proclamation have been observed and performed, and it is desirable that the said land and subsoil so applied for as aforesaid should be taken for the purposes of the aforesaid public work:
Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise of the powers and authorities vested in me by “The Public Works Act, 1894,” and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that, from and after the twenty-third day of December, one thousand eight hundred and ninety-nine, the several parcels of land and subsoil respectively specified in the Schedules hereto shall be and the same are hereby taken for the purposes of the aforesaid public work, and also that the said twenty-third day of December, one thousand eight hundred and ninety-nine, shall be the date from and after which, by virtue of section eighteen of “The Public Works Act, 1894,” the said parcels of land and subsoil shall become absolutely vested in the aforesaid Kelburne and Karori Tramway Company (Limited) as such delegate as aforesaid for the public use named in this Proclamation—to wit, the aforesaid public work.

All in the Land District of Wellington: as the same are more particularly delineated on Sheet No. 2 of the plan marked P.W.D. 18762, deposited in the office of the Minister for Public Works, at Wellington, in the Provincial District of Wellington, and thereon coloured as above.
SECOND SCHEDULE.
SUBSOIL TAKEN.
A. So much of the subsoil under the parcel of land specified in paragraph B of this Schedule, as is described in paragraph C of this Schedule.
B. The said parcel of land is part of Section No. 484, in the City of Wellington, and contains by admeasurement 4 perches, more or less, and is bounded as follows: Commencing at its most easterly point on the boundary of Allotment No. 1 of said Section No. 484; thence bounded on the south by a line, 103·68 links, to Wellington Terrace; thence on the west by Wellington Terrace, 43·4 links; thence on the north by a line, 30·68 links; and thence on the north-east by a line, 64·24 links, along the boundary of said Allotment No. 1 to the commencing-point: as the said parcel of land is more particularly set forth on Sheet No. 2 of the plan marked P.W.D. 18762, deposited in the office of the Minister for Public Works, at Wellington, and thereon edged green.
C. The said subsoil is contained in a solid figure, rectangular in cross-section, having a vertical height of 25 ft. and a horizontal width of 25 ft., and lying between parallel planes such that any straight line in either of the lower or upper planes drawn at right angles to the centre line of the tramway shall be horizontal. At the most easterly end of the said solid figure the said lower plane is 52 ft. and the said upper plane is 77 ft. above the level of the Wellington City datum; and at the most westerly end of the said solid figure the said lower plane is 63 ft. and the said upper plane is 88 ft. above the level of the said Wellington City datum: as the said levels are shown on Sheet No. 1 of the said plan marked P.W.D. 18762, deposited in the office of the Minister for Public Works, at Wellington.
THIRD SCHEDULE.
SUBSOIL TAKEN.
A. So much of the subsoil under the parcel of land specified in paragraph B of this Schedule, as is described in paragraph C of this Schedule.
B. The said parcel of land is part of Section No. 460, in the City of Wellington, and contains by admeasurement 14·1 perches, more or less, and is bounded as follows: Commencing at its most easterly point on the west side of Wellington Terrace; thence bounded on the east by Wellington Terrace, 43·4 links; thence on the south by a line, 222·16 links; thence on the west by a line, 37·9 links; and thence bounded on the north by a line, 243·28 links, to the commencing-point: as the said parcel of land is more particularly set forth on Sheet No. 2 of the plan marked P.W.D. 18762, deposited in the office of the Minister for Public Works, at Wellington, and thereon edged red.
C. The said subsoil is contained in a solid figure, rectangular in cross-section, having a vertical height of 25 ft.
