Proclaiming Wangapeka River, together with its Tributaries, in the Provincial District of Nelson, to be Watercourses.

A PROCLAMATION.

WHEREAS by the one hundred and fifty-second section of “The Mining Act, 1891” (hereinafter termed “the said Act”), it is enacted that the Governor in Council may from time to time, by Proclamation published in the Gazette, proclaim and declare that any watercourse shall be a watercourse into which tailings, mining débris, and waste water of any kind used in, upon, or discharged from any claim or licensed holding shall be suffered to flow or be discharged:

And whereas not less than ninety days’ notice has been published, in the manner provided by the said section, that application has been made to the Governor to proclaim the watercourse hereinafter mentioned, and its tributaries, to be watercourses for the purposes of the said section mentioned:

And whereas His Excellency the Governor has decided to exercise the powers conferred upon him by the said Act:

Now, therefore, His Excellency Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby proclaim and declare that the Wangapeka River and all its tributaries, in the Provincial District of Nelson, shall be watercourses into which tailings, mining débris, and waste water of every kind used in, upon, or discharged from any claim or licensed holding adjacent to such watercourses shall be suffered to flow or be discharged: and, with the like advice and consent, His Excellency doth hereby prescribe that this Proclamation shall take effect on and after the seventh day of April, one thousand eight hundred and ninety-eight.

NELSON PROVINCIAL DISTRICT.

That river known as the Wangapeka River, which flows easterly for a distance of about twenty miles, from its source near Wangapeka Pass to its junction with the Motueka River; and also the several tributaries thereof.

Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Commander of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twenty-seventh day of December, in the year of our Lord one thousand eight hundred and ninety-seven.

Powers delegated to the Cambridge Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-seventh day of December, 1897.

Present:

His Excellency the Governor in Council.

IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twelfth day of October, one thousand eight hundred and ninety-six, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present Order, delegate, but only with respect to the pieces or parcels of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Cambridge Public Domain Board, namely,—

EDWARD HEWITT,
The MAYOR of the BOROUGH of CAMBRIDGE, and
The CHAIRMAN of the PUKEKURA ROAD BOARD

(hereinafter referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the first Saturday in each month, at four o’clock p.m., at the Town Board Office, Cambridge, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Saturday, the fifth day of February, one thousand eight hundred and ninety-eight.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Saturday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  6. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

SCHEDULE.

ALL that parcel of land in the Parish of Hautapu, Cambridge Survey District, Auckland Land District, known as the Cambridge East Town Belt, and comprising all the land lying between the granted boundaries of Rural Sections Nos. 161, 1, 18, 184, 195, 196, 209, 210, 215, 216, 230, and 235, Parish of Hautapu, and the sections comprised in the Town of Cambridge East proper, containing 426 acres, more or less.

Also, all that parcel of land, containing by admeasurement 41 acres 2 roods, more or less, being Lot No. 576 of the Town of Cambridge East, Parish of Hautapu, Cambridge Survey District, Auckland Land District.

Also, all that parcel of land, containing by admeasurement 347 acres, more or less, being called or known as the Town Belt of Cambridge West, in the Parish of Pukekura, Cambridge Survey District, Auckland Land District.

Also, all that parcel of land, containing by admeasurement 5 acres 1 rood 17 perches, more or less, being called or known as Allotments Nos. 359, 360, 361, 361A, 367, and 581 of the Town of Cambridge East, Cambridge Survey District, Auckland Land District.

Also, all that parcel of land in the Auckland Land District, being Allotment No. 578 of the Town of Cambridge East, and containing by admeasurement 1 acre 3 roods 8 perches, more or less.

Also, all that parcel of land in the Auckland Land District, being Allotment No. 579 of the Town of Cambridge East, and containing by admeasurement 2 acres and 30 perches, more or less.

Also, all that parcel of land in the Auckland Land District, being Allotments Nos. 363, 363A, 364, 365, 366, and 368 of the Town of Cambridge East, containing by admeasurement 6 acres 1 rood 36 perches, more or less.

Also, all that parcel of land in the Auckland Land District, being Allotment No. 370 of the Town of Cambridge East, containing by admeasurement 3 roods 36 perches.

As the several parcels of land are delineated on the official maps deposited in the District Lands and Survey Office, Auckland.
