EKETAHUNA ROAD BOARD.
THE Eketahuna Road Board hereby resolves (by way of special order) that the following by-law regulating “heavy traffic” on all roads, bridges, ferries, and fords under the care, control, or management of the Board be and the same hereby is made by the said Board, and that the common seal be affixed thereto:—
A BY-LAW of the Eketahuna Road Board, made under the Authority of “The Public Works Act, 1894,” “The Public Works and Government Railways Act Amendment Act, 1885,” and “The Road Boards Act, 1882,” and the Acts amending the same, and every other Power enabling it in that Behalf, for regulating Heavy Traffic within the Eketahuna Road District.
The Eketahuna Road Board, in respect of all roads, bridges, ferries, and fords under its care, control, or management, in pursuance of every power thereto it enabling, doth make and ordain the following by-law regulating heavy traffic:—

In the construction of this by-law the words “heavy traffic” shall, unless inconsistent with the context, mean the transportation of any vehicle, engine, or machine which shall itself, or together with any thing or things being transported thereon, weigh more than one and a half tons avoirdupois to each pair of wheels.

The width of the tires of all vehicles engaged in heavy traffic, whether plying for hire or not, shall not be less than 5 in.

It shall not be lawful for any person to conduct any heavy traffic with or by means of any vehicle, whether plying for hire or not, of which the tires are of a less width than 5 in.

No goods of a weight greater than shall, with the weight of the vehicle wherein the same shall be carried, weigh more than one and a half tons avoirdupois to each pair of wheels shall be carried in any vehicle the tires of which are of a width less than 5 in.

No timber, or logs, or firewood shall be carried, either separately or together with any other kind or wood or goods, in or upon or by means of any vehicle or machine which shall, together with the load, weigh more than three tons avoirdupois to each pair of wheels.

A yearly license-fee shall be paid to the Eketahuna Road Board on every vehicle or machine engaged in heavy traffic in cases where timber, or logs, or firewood is or are being transported. In the case of any machine, or of a four-wheeled wagon or other four-wheeled vehicle, or of a two-wheeled junker, the yearly license-fee shall be £25. In the case of a two-wheeled dray or other two-wheeled vehicle (not being a junker) the yearly license-fee shall be £5.

No person shall in any year conduct any heavy traffic where timber, or logs, or firewood is or are being transported with or by means of any vehicle or machine until the license-fee for the current year has been paid to the Eketahuna Road Board in respect of such vehicle or machine.

The person for the time being in charge of any vehicle or machine proceeding or being upon any road or bridge under the care, control, or management of the Eketahuna Road Board shall, whenever required by any officer of the Eketahuna Road Board or by any constable so to do, cause such vehicle or machine to be and remain stopped for a reasonable and sufficient time for the purpose of enabling such officer or constable to inspect, examine, and measure such vehicle or machine and every or any part thereof, and the load being transported thereon. And the person so in charge shall permit such inspection, examination, and measurement to be made accordingly, and no person shall obstruct any such officer or constable in or about making such inspection, examination, or measurement.

Every person guilty of any offence against this by-law shall be liable for each such offence to such penalty not exceeding £5 as the Court inflicting the same shall in its discretion think fit.

This by-law shall apply to all the roads, bridges, ferries, and fords under the care, control, and management of the Eketahuna Road Board, and to heavy traffic thereon, and to vehicles and machines employed in heavy traffic upon such roads, bridges, ferries, and fords, and not beyond or otherwise.
The common seal of the inhabitants of the Eketahuna Road District was affixed to the above written by-law in our presence, pursuant to the above-written special order (which special order was passed on the 29th day of May, 1897).

THE following special order, made by the Pakuranga Road Board, is published in accordance with the provisions of “The Road Boards Act, 1882.”

PAKURANGA ROAD BOARD.
Heavy Traffic By-law.
In pursuance of the powers and authorities conferred upon them by “The Road Boards Act, 1882,” and “The Public Works Act, 1894,” and of all other powers in that behalf enabling them, the inhabitants of the Pakuranga Road District, commonly called “the Pakuranga Road Board,” and hereinafter called “the Board,” do hereby make and ordain the following by-law:—
- Interpretation.
(1.) The word “district” means the Pakuranga Road District.
(2.) The words “special kind of heavy traffic” shall mean any vehicle, engine, or machine which shall itself, or together with any stone, road-metal, gravel, scoria, ash, or sand being transported thereon, weigh more than 1½ tons avoirdupois to each pair of wheels.

No person shall use any bridge, road, or street within the boundaries of the district for any kind of heavy traffic, unless the tire of each wheel is at least 4 in. in width, without the permission in writing of the Board in that behalf first obtained.

No person shall use any bridge, road, or street within the boundaries of the district for any special kind of heavy traffic during the months of May, June, July, August, or September in any year without the permission of the Board in that behalf first had and obtained.

If any person or body corporate shall desire to carry on the said special kind of heavy traffic during the said prohibited months, or to carry on the said special kind of heavy traffic with a lesser width of tire than that hereinbefore specified, it shall be lawful for the Board to authorise him or it so to do on his or its giving security to the satisfaction of the Board that he or it will pay to the Board the sum of 1s. for each separate load coming within the definition “special kind of heavy traffic” which he or it shall pass, or cause to pass, over or along any road, bridge, or street within the boundaries of the district during the ensuing year, by way of compensation for damage likely to occur to any such road, bridge, or street by reason of such traffic.

It shall be lawful for any person acting under the authority of the Board at all times to examine and ascertain the weight of any vehicle, engine, or machine which he believes to be engaged in special kind of heavy traffic within the district, and the contents thereof, and to require from every owner or driver or person in charge of any such vehicle, engine, or machine satisfactory proof of the weight of any such vehicle, engine, or machine and its contents, or of either. If any person so acting shall be dissatisfied with the proof so offered, he may require the owner or driver or person so in charge as aforesaid to drive or convey or permit him to drive or convey such vehicle, engine, or machine and its contents, together with the horses or other motive-power attached thereto, to the nearest public weighbridge, and then have the same weighed. The owner or driver or other person in charge of any vehicle, engine, or machine so requested to have the same weighed as aforesaid shall pay the cost of so doing.

Every person who shall refuse or neglect to produce such proof as aforesaid, or who shall commit any other breach of the provisions of this by-law, shall for every such offence be liable to a penalty not exceeding £5.

This by-law shall come into force and effect within the said district upon the date of its publication in the New Zealand Gazette.
