Powers delegated to the Wangaloa Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-second day of April, 1897.

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.

IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Administrator of the Government of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-fifth day of June, one thousand eight hundred and eighty-nine, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present Order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Wangaloa Public Domain Board, namely,—

WILLIAM SAMSON,
DONALD MITCHELL,
GEORGE KIDD,
PETER HAGGART, and
HUGH HAGGART

(hereinafter referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the first Saturday in each month, at six o’clock p.m., at the Schoolhouse, Wangaloa, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Saturday, the fifth day of June, one thousand eight hundred and ninety-seven.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Saturday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  6. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

SCHEDULE.

ALL that area in the Land District of Otago, containing by admeasurement 32 acres 3 roods 13 perches, more or less, situate in the Coast District, and being part of Section No. 8, Block VII., on the map of the said district. Bounded towards the north-west by other part of the said Section No. 8, reserved for a school, 1280 links, also by a road-line, 840 links; towards the north-east by a road-line, 900 and 1464 links, also by other part of said Section No. 8, reserved for a cemetery, 600 links; towards the south-east by the said Cemetery Reserve, 840 links, also by a road-line, 1320 links; and towards the south-west by Section No. 7, 3389 links: and intersected by a road 50 links wide.

Prohibiting Use of Net-fishing in Part of Wanganui River.

At the Government House, at Wellington, this twenty-second day of April, 1897.

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.

WHEREAS by “The Sea-fisheries Act, 1894,” it is enacted that the Governor in Council may from time to time make regulations which shall have general force and effect throughout the colony, or particular force and effect only in any waters or places specified therein, for, amongst other things, altogether prohibiting the use of nets of any sort:

And whereas it is desirable to altogether prohibit the use of nets of any sort in the portion of the Wanganui River above the Aramoho Railway-bridge:

Now, therefore, His Excellency the Administrator of the Government of the Colony of New Zealand, in pursuance and exercise of the power conferred upon him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations:—

REGULATIONS.

  1. The use of nets of any sort for taking fish in the portion of the Wanganui River above the Aramoho Railway-bridge during the period from the 1st day of May, 1897, to the 30th day of April, 1898, is hereby prohibited.

  2. Any person committing a breach of the above regulation shall be liable to a penalty of not less than £1 and not exceeding £20.

Excepting Land from Operation of Section 117 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-second day of April, 1897.

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.

WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may by Order in Council except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same; or may in like manner make such exception in favour exclusively of any lessee or other person who has been bonâ fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act:

Now, therefore, His Excellency the Administrator of the Government of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred by section four of “The Native Land Laws Amendment Act, 1895,” and by and with the advice and consent of the Executive Council of the said colony, doth hereby except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of mortgage to the Public Trustee, the block or parcel of land known as “Ngawaka-a-kupe 2d¹,” situated in the District of Wairarapa, and shown on the map numbered W.D. 1356A, in the office of the Chief Surveyor at Wellington, as containing 1,668 acres.
