ORDER IN COUNCIL.
At the Government House, at Wellington, this twentieth
day of December, 1897.

HIS EXCELENCY THE GOVERNOR IN COUNCIL.

WHEREAS, there being no Harbour Board empowered
to grant the license hereinafter mentioned under
"The Harbours Act Amandment Act, 1883" (hereinafter
called "the said Act"), Hnry Lne, of Opa, Sawmiller
(hereinafter called "the licensee"), has applied to the
Governr in Council for a license under the said Act to
occpy a part of the foreshore and of the land below low -
water mark of Waitkare Inlet, Bay of Isls, in order to
erect a wharf thereon, and, in acordance with the one
hundred and fift - sith section of "The Harbours Act ,
1878 ," has deposited a plan in the office of the Marne
Department at Wellington (markd M.D. 2163) showing the
position in which it is intended to erect such wharf, the area
of foreshore and land below low - water mark intended to be
occpied, and the manner in which it is proposed to erect
the wharf : And whreas the Governr in Council has
approved of the purpse for which the said license is
required : And whreas it is expedit that a license should
be granted and issued to the licensee under the said Act ,
for the purpose aforesaid, on the terms and conditions
hereinafter expressed :

Now, therefore, His Excellency the Governr of the
Colny of New Zealnd, in pursuance and exercise of the
power and authority vstd in him by the said Act, and of
all other powers and authorities enablg him in that behlf ,
and by and with the advice and consent of the Exective
Council of the said colny, doth herby appove of the
object for which the said license is required by the
licensee as aforesaid ; and, in further pursuance and
exercise of the said power and authority, and with the like
advice and consent as aforesaid, doth herby license and
permit the licensee to use and occpy that part of the fore -
shor and land below low - water mark on which the wharf
is to be erectd, as shown on the plan so deposited as afores -
said, for the purpose of erecting and maintaing the said
wharf, such license to be held and enjoyed by the licensee
upon and subject to the following terms and conditions ,
that is to say :β€”

  1. In these conditions the term "Minister" means the
    Minister having charge of the Marne Department, as de -
    fnd by "The Shpping and Seaman's Act, 1877 ," and in -
    clude any officer, person, or authority acting by or under
    the direction of such Minister.

  2. The concessions and privileges conferrd by this Order
    in Council shall extend and apply only to the part of the
    foreshore occpied by the said wharf, as shown on plans
    markd M.D. 2163.

  3. In consideratn of the concessions and privileges
    granted by this Order in Council, the licensee shall, on
    being supplyd with a copy thereof, pay to the Minister the
    sum of two pounds ten shillings, and thereafer an annual
    sum of two pounds, payble on the first day of December ,
    dating from the first day of December, one thousand eight
    hundred and ninty - sev, the first of such annual pay -
    ments to be made on the licensee being supplyd with a
    copy of this Order in Council.

  4. All persons shall at all reasonable times, upon payment
    of the proper dyes, have free and full libery to use the said
    wharf, and all rights of ingrss and egress thereon and
    therefrom.

  5. Her Maajesty, or the Governr, and all officers in the
    Government service acting in the execution of their duty ,
    shall at all times have free ingrss, passge, and egress into ,
    through, and out of the said wharf without payment.

  6. The licensee shall maintain the above - mentioned
    wharf in good order and repair, and shall at all times
    exhibt therefrom and maintain at his own cost suitable and
    necessary lights for the guidanc of vssels : Provided that
    no light shall be exhibited until after it has been approved
    of by the Minister.

  7. Any person authoris by the Minister may at all rea -
    sonable times enter upon the said wharf and view the
    state of repair thereof ; and upon such Minister leaving at
    or posng to the last - know address of the licensee a notice
    in writing of any defct or want of repair in such wharf ,
    requirg him, within a reasonable time, to be therein pre -
    sribd, to repair the same, he shall with all convenint speed
    cause such defct to be removed or such repair to be made.

  8. Nothing herein containd shall authorise the licensee
    to do or cause to be done anything repugant to or in con -
    sistant with any law reling to the Custom, or any regu -
    lation of the Commisioner of Trad and Custom, or with
    any provisns of "The Harbours Act, 1878 ," or its amnd -
    ments, or any regulations made thereunder, and that are
    now or may hereafter be in force.

  9. The ballast of all vssels loading at the said wharf
    shall be taken away by the licensee, and deposited above
    high - water mark, or at such place as may be approved
    of by the Minister, by the Harbourmaster at Russll, or by
    any person appointd by the Minister for that purpose.

  10. The rights, powers, and privileges conferrd by or
    under this Order in Council shall continue to be in force for
    fourteen years from the date hereof, unless in the meantime
    such rights, powers, and privileges shall be alterd, modifd ,
    or revokd by competent authority ; and the licensee shall
    not assign, charge, or part with any such right, power, or
    privilge without the written consent of the Minister first
    obtaind.

  11. The said rights, powers, and privileges may be at any
    time resum by the Governr, without payment of any
    compensatn whatever, on giving to the licensee six calendar
    months' previous notice in writing. Any such notice shall
    be sufficient if given by the Minister, and deliverd at or
    posted to the last - know address of the licensee.

  12. The licensee shall be liable for any injury which the
    said wharf may cause any vssel or boat to sustain through
    any default or neglect on his part.

  13. In case the licensee shallβ€”
    (1.) Commit or suffer a brech of the conditions herein -
    before set forth, or any of them ;
    (2.) Cese to use or occpy the said wharf for a period
    of thity days ;
    (3.) Become bankrt, or be in any manner brought
    under the operation of any Act for the time
    being in force reling to bankruptcy ; or
    (4.) Fail to pay the sums specifd in claus three of
    these conditions ,
    then and in either of the said cases this Order in Council ,
    and every license, right, power, or privilge therby con -
    ferrd, may be revokd and determin by the Governr in
    Council without any notice to the licensee or other pro -
    ceedng whatsover ; and publicatn in the New Zealnd
    Gazzette of an Order in Council containng such revocatn
    shall be sufficient notice to the licensee, and to all persons
    concern or interest, that this Order in Council, and
    the license, rights, and privileges therby granted and
    conferrd, have been revokd and determin.

HIS EXCELENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Raglan County Council, being a
leasig authority within the meaning of "The
Public Bodes' Power Act, 1887" (hereinafter term "the
said Act"), has request that these presnt should issue ,
and it appears expedit to make the Order hereinafter
containd : Now, therefore, His Excellency the Governr
of the Colny of New Zealnd, acting by and with the
advice and consent of the Exective Council of the said
colny, doth herby order and declare that the Raglan
County Council shall, as from the date of the publicatn
hereof in the New Zealnd Gazzette, be subject to the
provisns of the said Act.
