regulation hereto annexed regarding certain payments of
capitation allowance to Education Boards; and, with the
like advice and consent, doth hereby prescribe that this
Order shall come into force on the date of the first publica-
tion thereof in the New Zealand Gazette.
REGULATION.
Notwithstanding anything to the contrary contained in
an Order in Council made on the 5th day of January, 1888,
under the provisions of "The Education Act, 1877," relating
(inter alia) to attendance registers and returns, the payment
of capitation allowance to Education Boards for the quarter
ending on the 31st day of December, 1896, shall be according
to the working-average attendance of the quarter ending on
the 30th day of September, 1896, as working average was
defined by Order in Council dated the 5th day of July, 1887,
and made under the provisions of the before-mentioned Act.

Declaring Cool-stores under "The Dairy Industry Act,
1894."—Notice No. 458.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-sixth
day of October, 1896.
Present:
His Excellency the Governor in Council.
IN pursuance and exercise of the power and authority
conferred upon him by section three of "The Dairy
Industry Act, 1894," His Excellency the Governor of the
Colony of New Zealand, acting by and with the advice and
consent of the Executive Council of the said colony, doth
hereby order and declare the buildings described in the
Schedule hereto to be cool-stores for the purposes of the
said Act; and it is hereby declared that this Order in
Council shall come into force from and after the date of
the publication hereof in the New Zealand Gazette.

Varying Close Season for Oysters in Manukau Harbour.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-
sixth day of October, 1896.
Present:
His Excellency the Governor in Council.
WHEREAS it is enacted by the fifth section of "The
Sea-fisheries Act, 1894" (hereinafter called "the
said Act"), that the Governor in Council may from time to
time make regulations which shall have general force and
effect throughout the colony, or particular force and effect
only in any waters or places specified therein, for, amongst
other things, prescribing a close season during which it
shall be unlawful to take oysters, and extending or varying
any close season so prescribed:
And whereas a close season for oysters in Manukau Har-
bour was prescribed by the Governor in Council on the
thirtieth day of March, one thousand eight hundred and
ninety-six:
And whereas it is expedient to vary the said Order in
Council by providing that the said close season shall not
extend to the oyster-beds in the said harbour for which
licenses are issued under regulations which were made by
the Governor under the said Act on the fourteenth day of
May, one thousand eight hundred and ninety-six, and pub-
lished in the New Zealand Gazette, No. 36, of the twenty-
first day of the same month:
Now, therefore, His Excellency the Governor of the
Colony of New Zealand, in pursuance and exercise of the
power and authority conferred upon him by the said Act,
and by and with the advice and consent of the Executive
Council of the said colony, doth hereby make the following
regulation:—
REGULATION.
The close season for oysters in Manukau Harbour, pre-
scribed by regulations made by the Governor in Council on
the 30th day of March, 1896, shall not apply to, or have
force and effect within, the areas within Manukau Harbour
for which licenses for the exclusive right of taking oysters
are granted under the regulations for such licenses which
were made by the Governor under the provisions of the said
Act on the 14th day of May, 1896, and published in the New
Zealand Gazette, No. 36, of the 21st day of the same month.

*Fixing the Date for Payment of Land-tax under "The
Land-tax and Income-tax Act, 1896."
GLASGOW, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-
sixth day of October, 1896.
Present:
His Excellency the Governor in Council.
IN pursuance and exercise of the power and authority
vested in him under "The Land-tax and Income-tax
Act, 1896," His Excellency the Governor of the Colony of
New Zealand, by and with the advice and consent of the
Executive Council of the said colony, doth hereby order and
determine that the respective duties leviable under the said
Act by way of land-tax and of further graduated land-tax
shall be paid in one sum on Thursday, the twenty-sixth day
of November, one thousand eight hundred and ninety-six.
And in further pursuance and exercise of the power and
authority aforesaid, and with the like advice and consent as
aforesaid, His Excellency doth also determine that the place
where the said duties of land-tax shall be paid shall be the
Office of the Commissioner of Taxes, at the Government
Buildings, Wellington, and that notice to the foregoing effect
shall be given by the said Commissioner accordingly.

Fixing Sittings of District Courts.
GLASGOW, Governor.
IN pursuance and exercise of the power and authority in
this behalf enabling me, I, David, Earl of Glasgow, the
Governor of the Colony of New Zealand, do hereby fix and
appoint that sittings of the District Courts of Ashburton,
Timaru and Oamaru, Otago Goldfields, Western Otago, and
Westland, for civil and criminal business, shall be held as
follows, from and after the first day of January next, in lieu
of those previously fixed and appointed:—
Ashburton District.
In the Courthouse, Ashburton, for civil business only, on
8th January, 12th March, 14th May, 9th July, 10th Sep-
tember, and 12th November.
Timaru and Oamaru District.
In the Courthouse, Timaru, for civil business only, on 13th
January, 17th March, 19th May, 14th July, and 15th Sep-
tember. For civil and criminal business, on 17th November.
In the Courthouse, Oamaru, for civil business only, on
19th March, 21st May, 17th September, and 19th November.
For civil and criminal business, on 15th January and 16th
July.
Otago Goldfields District.
In the Courthouse, Lawrence, for civil and criminal busi-
ness, on 1st June and 30th November.
In the Courthouse, Queenstown, for civil and criminal
business, on 27th January and 27th July.
In the Courthouse, Naseby, for civil and criminal business,
on 31st March and 22nd September.
Western Otago District.
In the Courthouse, Invercargill, for civil business only, on
20th January, 24th March, 26th May, and 22nd July. For
civil and criminal business, on 24th November.
Westland District.
In the Courthouse, Westport, for civil business only, on
20th April, 16th August, and 21st December. For civil and
criminal business, on 23rd February, 14th June, and 26th
October.
In the Courthouse, Greymouth, for civil business only, on
14th April, 25th August, and 15th December. For civil and
criminal business, on 17th February, 23rd June, and 20th
October.
In the Courthouse, Hokitika, for civil business only, on
19th February, 16th April, 27th August, and 22nd October.
For civil and criminal business, on 25th June and 17th
December.
In the Courthouse, Reefton, for civil business only, on
15th February, 12th April, 21st June, 23rd August, 18th
October, and 13th December.
Provided that in case any of the days so fixed as aforesaid
shall happen to be a holiday, then the Court appointed for
that day shall be holden on the first day thereafter not being
a holiday.
As witness the hand of His Excellency the Governor,
this twenty-first day of October, one thousand
eight hundred and ninety-six.
