ninety (hereinafter called “the said regulations”), shall not
prevent fishing, with nets of the regulation size or sizes, for
flounders, or mullet, or other indigenous fish, in Lake Elles-
mere, outside a radius of one mile from the middle of the
Rivers Selwyn and Irwell, Hall’s Creek, and Halswell and
Kaituna Streams, at the places where those rivers, streams,
and creek flow into the said lake at low water ordinary
spring-tides. And for the purpose of the said regulations the
mouth of the River Heathcote shall be deemed to be at the
Heathcote Swing-bridge, situate on the main road between
Christchurch and Sumner; and the mouth of the River Avon
shall be deemed to be at the southern end of the island in
that river lying opposite section numbered 11212 in the
Christchurch Survey District. Nor shall they apply to that
portion of the River Waimakariri east of a straight line drawn
at right angles to the course of the said river and across the
said river from the eastern corner of rural section numbered
1393 in the Mandeville Survey District, the said corner of
rural section numbered 1393 being two miles or thereabouts
in an easterly direction from the main bridge over the River
Waimakariri and the Town of Kaiapoi.

Validating Taking of Ballot, Akiteo Road Board.

ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day
of August, 1896.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS, in pursuance of a ballot taken at a meeting
of the Akiteo Road Board held on the twenty-third
day of April, one thousand eight hundred and ninety-six,
John Stewart Handyside and William Groves Speedy, two
of the members of the said Board, retired therefrom: And
whereas the ballot should have taken place on the seventh
day of May, one thousand eight hundred and ninety-five;
but, through misadventure, was not taken until the date
first above mentioned, and it is expedient to validate the
said ballot:
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, by and with the advice and consent of the
Executive Council of the said colony, and in exercise of the
powers vested in him by “The Road Boards Act, 1882,”
doth hereby order and declare that the ballot held on the
twenty-third day of April, one thousand eight hundred and
ninety-six, for two members of the said Akiteo Road Board
to retire shall be deemed to have been properly taken, and
all proceedings consequent thereupon shall be as valid and
effectual as if the irregularity hereinbefore mentioned had
not taken place.

Southland High Schools Board to be subject to the Provisions
of “The Public Bodies’ Powers Act, 1887.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day
of August, 1896.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section four of “The Public Bodies’
Powers Act, 1887” (hereinafter termed “the said
Act”), it is provided that the Governor, by Order in Council,
may from time to time declare that any leasing authority
shall be subject to the provisions of the said Act, but that no
such Order shall have any effect unless it be issued at the
request or upon the recommendation of the leasing authority
on whose behalf such Order is issued:
And whereas it has been made to appear that the Board
of Governors of the Southland Boys’ and Girls’ High Schools
are a leasing authority within the meaning of the said Act,
and have requested that they may be brought under the pro-
visions thereof:
Now, therefore, His Excellency David, Earl of Glasgow,
the Governor of the Colony of New Zealand, by and with
the advice and consent of the Executive Council of the said
colony, and in pursuance and exercise of the powers and
authorities conferred on him by the said Act, doth hereby
order and declare that from and after the date hereof the
Board of Governors of the Southland Boys’ and Girls’ High
Schools shall be subject to the provisions of “The Public
Bodies’ Powers Act, 1887.”

Regulations as to Whitebait Fishing, Westland County.

ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day
of August, 1896.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by “The Sea-fisheries Act, 1894” (herein-
after termed “the said Act”), it is amongst other
things enacted that the Governor in Council may from time
to time make regulations for the purposes therein men-
tioned, which shall have general force and effect throughout
the colony, or particular force and effect only in any waters
or places specified therein:
And whereas it is expedient to make the regulations
hereinafter set forth with respect to the indigenous fish
known as “whitebait,” inhabiting the waters of the colony
herein mentioned:
Now, therefore, His Excellency the Governor of the
Colony of New Zealand, in pursuance and exercise of the
powers conferred upon him by the said Act, and by and
with the advice and consent of the Executive Council of the
said colony, doth hereby make the following regulations,
and with the like advice and consent doth order that these
regulations shall have force and effect in all waters in the
County of Westland.
REGULATIONS.

No scrim or whitebait net shall be used as a set-net, or
be set or placed in openings made in the banks of rivers or
streams, or in dams constructed therein; and no scrim
hand-net having an opening of more than five square feet
shall be used for the purpose of catching whitebait: Pro-
vided that nothing in this regulation shall render it unlawful
to take whitebait by means of set-nets having an opening of
not more than seven square feet during the period from the
fifteenth day of September to the twenty-fourth day of
October in each year. -
Any person committing a breach of the above regula-
tion shall be liable to a penalty of not less than one pound
and not exceeding twenty pounds. -
Nothing in these regulations contained shall be deemed
or construed to affect or interfere with the operation of any
regulations for the time being in force under “The Fisheries
Conservation Act, 1884,” in relation to the taking or fishing
for salmon or trout in the said waters.

issued.

IN pursuance and exercise of the powers and authorities
conferred upon me by the nineteenth section of “The
Mining Act, 1891,” I, David, Earl of Glasgow, the Governor
of the Colony of New Zealand, do hereby appoint the Post-
office at the under-mentioned place to be a post-office at
which miners’ rights and business licenses respectively may
be issued by the Postmaster in charge of such post-office,
viz.:-

As witness the hand of His Excellency the Governor,
this seventh day of August, one thousand eight
hundred and ninety-six.

Notice of Appointment of Members of Board of Conciliation
for the Northern Industrial District.
GLASGOW, Governor.
WHEREAS at the first election of members of the
Board of Conciliation for the Northern Industrial
District, held the twenty-seventh day of February, one
thousand eight hundred and ninety-six, the prescribed
number of members was not duly elected as provided by
“The Industrial Conciliation and Arbitration Act, 1894”:
Now, therefore, in pursuance and exercise of the powers
and authorities vested in me by section six of “The Indus-
trial Conciliation and Arbitration Act Amendment Act,
1895,” I, David, Earl of Glasgow, the Governor of the
Colony of New Zealand, do hereby, for the purpose of
making up the prescribed number, appoint the following
persons, that is to say,-
JOHN McEffer SHERA, of Remuera, Sharebroker; and
JAMES JOB HOLLAND, of Auckland, Builder,
to be members of the Board of Conciliation for the said
district.
As witness the hand of His Excellency the Governor,
this tenth day of August, one thousand eight
hundred and ninety-six.
