sum of five pounds, and thereafter an annual sum of two
pounds, dating from the first day of December, one thousand
eight hundred and ninety-four; the first of such annual pay-
ments to be made on the licensees being supplied with a copy
of this Order in Council.

  1. Her Majesty, or the Governor, and all officers in the
    Government service, acting in the execution of their duty,
    shall at all times have free ingress, passage, and egress into,
    through, and out of the said warehouse without payment.

  2. The licensees shall complete the erection of the said
    warehouse, in accordance with the approved plan marked
    M.D. 1969, within six calendar months from the date of this
    Order in Council.

  3. The licensees shall maintain the above-mentioned ware-
    house in good order and repair.

  4. Any person authorised by the Minister may at all
    reasonable times enter upon the said warehouse and view
    the state of repairs thereof; and upon such Minister leaving
    at or posting to the last known address of the licensees, or
    either of them, a notice in writing of any defect or want
    of repair in such warehouse, requiring them, within a
    reasonable time, to be therein prescribed, to make good the
    same, they shall, with all convenient speed, cause such de-
    fect to be removed or such repairs to be made, as the case
    may be.

  5. Nothing herein contained shall authorise the licensees
    to do or cause to be done anything repugnant to or incon-
    sistent with any law relating to the Customs, or any regula-
    tion of the Commissioner of Trade and Customs, or with any
    provisions of "The Harbours Act, 1878," or its amendments,
    or any regulations made thereunder, and that are now or
    may hereafter be in force.

  6. The rights, powers, and privileges conferred by or under
    this Order in Council shall continue in force for fourteen
    years from the date hereof, unless in the meantime such
    rights, powers, and privileges shall be altered, modified, or
    revoked by competent authority; and the licensees shall not
    assign, charge, or part with any such right, power, or privi-
    lege without the written consent of the Minister first ob-
    tained.

  7. The said rights, powers, and privileges may be at any
    time resumed by the Governor, without payment of any
    compensation whatever, on giving to the licensees three
    calendar months' previous notice in writing. Any such
    notice shall be sufficient if given by the Minister, and deli-
    vered at or posted to the last known address of the licensees,
    or either of them.

  8. The licensees shall be liable for any injury which the
    said warehouse may cause any vessel or boat to sustain
    through any default or neglect on their part.

  9. In case the licensees shall—
    (1.) Commit or suffer a breach of the conditions herein-
    before set forth, or any of them;
    (2.) Cease to use or occupy the said warehouse;
    (3.) Become bankrupt, or be brought under the opera-
    tion of any law in force for the time being re-
    lating to bankruptcy,
    then and in either of the said cases this Order in Coun-
    cil, and every license, right, power, or privilege thereby
    conferred, may be revoked and determined by the Governor
    in Council without any notice to the licensees or other pro-
    ceeding whatsoever; and publication in the New Zealand
    Gazette of an Order in Council containing such revocation
    shall be sufficient notice to the licensees, and to all persons
    concerned or interested, that this Order in Council, and the
    license, rights, and privileges thereby granted and conferred,
    have been revoked and determined.

  10. The erection of the warehouse shall be sufficient proof
    of the acceptance by the licensees of the conditions of this
    Order in Council.

Regulations under "The Sea-fisheries Act, 1894."

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eleventh day
of December, 1894.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS, by "The Sea-fisheries Act, 1894" (herein-
after termed "the said Act"), it is, among other
things, enacted that the Governor in Council may from time
to time make regulations for the purposes therein mentioned,
which shall have general force and effect throughout the
colony, or particular force and effect only in any waters or
places specified therein:

And whereas certain regulations were made by the Governor
in Council on the tenth day of January, one thousand eight
hundred and eighty-eight, under "The Fisheries Conserva-
tion Act, 1884," and "The Fisheries Conservation Act 1884
Amendment Act, 1887":

And whereas it is expedient to revoke certain of the said
regulations which were made by the Governor in Council on
the tenth day of January, one thousand eight hundred and
eighty-eight, and to make the regulations hereinafter set
forth prescribing a close season for the fish of the species of
Mugil known as mullet or kanae, inhabiting the waters of
the colony hereinafter described:

Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in pursuance and exercise of the powers
conferred upon him by the said Act, and of all other powers
enabling him in that behalf, and by and with the advice and
consent of the Executive Council of the said colony, doth
hereby revoke that part of the first regulation made by the
said Order in Council of the tenth day of January, one
thousand eight hundred and eighty-eight, commencing
with the word "Maori" and ending with the word
"community," and also the regulation numbered three
made by the said Order in Council; and in pursuance and
exercise of the said powers, and with the like advice and
consent, His Excellency the Governor of the colony doth
hereby make the following regulations, to have force and
effect within the waters hereafter specified in the said
regulations:—

REGULATIONS.

  1. The period from the twentieth day of December in one
    year to the twentieth day of March in the next succeeding
    year, both days inclusive, is hereby prescribed a close season
    in respect of the fish of the species of Mugil known as mullet
    or kanae, during which close season it shall be unlawful for
    any person to take any such fish contrary to the provisions
    of the said Act.

  2. These regulations shall have force and effect in all
    waters, as defined by the said Act, in the North Island of New
    Zealand bounded by a line commencing at Cape Wiwiki, and
    proceeding seawards on a bearing of N. 45° E. for a distance
    of three miles; thence running generally parallel to and
    three miles distant from the coast-line to a line bearing
    N. 45° E. from the North Cape; thence along the said line
    in the direction of the North Cape to the high-water mark of
    the sea; and thence along a line following the high-water
    mark of the sea along the coast to Cape Wiwiki, and
    following the said high-water mark up the tidal rivers, and
    crossing such rivers at the points where the tidal effect
    terminates.

  3. Any person committing a breach of these regulations
    shall be liable to a penalty not exceeding twenty pounds nor
    less than twenty shillings, to be recovered as is by the said
    Act provided.

Warrant authorising the Borough Council of Pahiatua to
construct a Bridge over the Mangatainoka River between
the Borough of Pahiatua and the Pahiatua County, and
apportioning the Cost of the Bridge.

GLASGOW, Governor.

WHEREAS by section one hundred and thirteen of
"The Public Works Act, 1894" (hereinafter termed
"the said Act"), it is, inter alia, enacted that, in any case
where the local authority of any district desires to construct
a bridge in any position that will, in its opinion, be of ad-
vantage and benefit to the whole or any considerable portion
of the inhabitants of an adjacent district, as well as to the
inhabitants of its own district, and where it is, in the opinion
of such local authority, reasonable that the local authority
of such adjacent district should contribute to the cost of
constructing or establishing the said bridge, the following
provisions in the said section mentioned shall have effect:

And whereas the Borough Council of Pahiatua has made
application to the Governor to authorise the construction of
the bridge mentioned in the Schedule hereto (hereinafter
referred to as "the said bridge"), and to apportion the cost
of constructing the said bridge between the said Council and
the Pahiatua County Council:

And whereas the said Borough and County Councils have
agreed that the erection of a bridge over the Mangatainoka
River at the Mangahao Road is necessary to both districts,
and the plans and estimated cost of the said bridge and pro-
tective works have likewise been agreed upon, and the
relative proportions of cost determined, and no objection
made thereto by the Pahiatua County Council:

And whereas the Governor is of opinion that the work
should be done:

Now, therefore, I, David, Earl of Glasgow, Governor of the
Colony of New Zealand, in pursuance and in exercise of the
power and authority vested in me by the said Act, do hereby
authorise the Borough Council of Pahiatua to construct the
said bridge; and I do hereby declare that a proportion of
the cost of constructing the said bridge—namely, seven
