Governor of the Colony of New Zealand, and as his duly-
appointed Deputy, do hereby proclaim the block of land
described in the Schedule hereto as set apart for settlement.
SCHEDULE.
Maniototo No. 2 Loan Block.
All that area in the Otago Land District containing by
admeasurement 6,916 acres 1 rood 31 perches, more or
less, and being Sections 33, 34, 35, 36, 38, 41, and 42 of
Block II.; 21, 22, 23, and 24 of Block III.; 19, 20, and 21 of
Block VI.; 20 and 22 of Block VII.; and 1, 2, 3, 4, 6, 7,
and 9 of Block XVII., Maniototo Survey District.
Given under the hand of the Honourable Sir James
Prendergast, Knight, Chief Justice, for and on
behalf of His Excellency the Governor, and as his
duly-appointed Deputy in and over Her Majesty's
Colony of New Zealand and its Dependencies;
and issued under the seal of the said Colony, at
the Government House, at Wellington, this fifth
day of February, in the year of our Lord one
thousand eight hundred and ninety-five.

A PROCLAMATION.
WHEREAS by the second section of "The Government
Loans to Local Bodies Act Amendment Act, 1891"
(herein termed "the said Act"), it is, amongst other things,
enacted that, before certain moneys therein mentioned shall
be expended upon any block of land, it shall be necessary
that the same be proclaimed as set apart for settlement:
Now, therefore, in pursuance and exercise of every power
and authority enabling me in this behalf, and for the pur-
poses of the said Act, I, James Prendergast, Knight, Chief
Justice, in the name and on behalf of His Excellency the
Governor of the Colony of New Zealand, and as his duly-
appointed Deputy, do hereby proclaim the block of land
described in the Schedule hereto as set apart for settlement.

Naseby No. 2 Loan Block.
All that area in the Otago Land District containing 2,444
acres 2 roods 20 perches, more or less, and being Sections 6
of Block VII., 12 of Block X., 12 of Block XI., and 3, 4, and 5
of Block XII., Naseby Survey District.
Given under the hand of the Honourable Sir James
Prendergast, Knight, Chief Justice, for and on
behalf of His Excellency the Governor, and as his
duly-appointed Deputy in and over Her Majesty's
Colony of New Zealand and its Dependencies;

A PROCLAMATION.
WHEREAS the lands mentioned in the Schedule hereto
are required to be taken, under "The Public Works
Act, 1894," and its amendments, for a certain work, to wit,
the construction of a drain in the Waiuku Road District:
And whereas the Waiuku Road Board has laid before the
Governor a memorial, accompanied by a map, and also the
statutory declaration, required by the said Act:
Now, therefore, I, James Prendergast, in the name and on
behalf of His Excellency the Governor of the Colony of New
Zealand, and as his duly-appointed Deputy, in exercise and
pursuance of the powers and authorities in me vested by
"The Public Works Act, 1894," and of every other power
and authority in anywise enabling me in that behalf, do hereby
proclaim and declare that, from and after the date of the
publication hereof in the New Zealand Gazette, the lands
mentioned in the Schedule hereto are hereby taken for the
purposes of the construction of a drain.

Licensing Messrs. Garton Brothers to use and occupy a Part
of the Foreshore of Mongonui Harbour.

ORDER IN COUNCIL.
At the Government House, at Wellington, this eleventh day
of December, 1894.
Present:
His Excellency the Governor in Council.
WHEREAS, there being no Harbour Board empowered
to grant the license hereinafter mentioned, George
Garton and Arthur Robert Garton, of Mongonui, trading under
the style or title of "Garton Brothers" (hereinafter called
"the licensees"), have applied to the Governor in Council for
a license under "The Harbours Act Amendment Act, 1883"
(hereinafter called "the said Act"), to occupy a part of the
foreshore of Mongonui Harbour, in order to erect and main-
tain thereon a warehouse, and, in accordance with the one
hundred and fifty-sixth section of "The Harbours Act, 1878,"
have deposited plan in the office of the Marine Department,
at Wellington (marked M.D. 1969), showing the place where
it is intended to erect such warehouse, the area of foreshore
to be occupied for such purpose, and the manner in which it
is proposed to erect the warehouse: And whereas it has been
made to appear to the Governor in Council that the proposed
work will not be or tend to the injury of navigation; and the
said plan has, prior to the making of this Order in Council,
been approved by the Governor in Council, without modifica-
tion or addition: And whereas it is expedient that a license
under the said Act, for the purpose aforesaid, should be
granted and issued to the licensees on the terms and con-
ditions hereinafter expressed:
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in pursuance and exercise of the power and
authority vested in him by the said Act, and of all other
powers and authorities enabling him in that behalf, and by
and with the advice and consent of the Executive Council
of the said colony, doth hereby approve of the purpose or
object for which the said license is required by the licensees
as aforesaid; and, in further pursuance and exercise of the
said power and authority, and with the like advice and con-
sent as aforesaid, doth hereby license and permit the licensees
to use and occupy that part of the foreshore edged red on the
plan marked M.D. 1969, for the erection of a warehouse in
accordance with the plan marked M.D. 1969, and which said
license shall be held and enjoyed by the licensees upon and
subject to the following terms and conditions, that is to
say,β

In these conditions the term "Minister" means the
Minister having charge of the Marine Department, as de-
fined by "The Shipping and Seamen's Act, 1877;" and
includes any officer, person, or authority acting by or under
the direction of such Minister. -
The concessions and privileges conferred by this Order
in Council shall extend and apply only to the part of the
foreshore edged red and marked "New warehouse" on plan
marked M.D. 1969, and deposited in the office of the Marine
Department as aforesaid. -
In consideration of the concessions and privileges granted
by this Order in Council the licensees shall, on being supplied
with a copy of this Order in Council, pay to the Minister the
