SCHEDULE.

ALL that parcel of land in the Canterbury Land District,
containing by admeasurement 7 acres 2 roods, more or less,
being Section No. 2808 (in red), formerly part of Reserve
No. 361, situate in Block V., Mairaki Survey District.
Bounded northwards by a line parallel to the road north of
Section No. 4643, and 1250 links distant therefrom, 1000
links; towards the eastward, southward, and westward by
Section No. 15239, 750, 1000, and 750 links: be all the afore-
said linkages more or less; as the same is delineated on the
plan deposited in the District Survey Office, Christchurch.

Also all that parcel of land in the Canterbury Land Dis-
trict, containing by admeasurement 6 acres 1 rood, more or
less, being Section No. 2858 (in red), formerly part of Reserve
No. 361, and situate in Block V., Mairaki Survey District.
Bounded northward by a line parallel to the road north of
Section No. 4643, and 555·6 links distant therefrom, 900
links; eastward by a right-of-way, 694·4 links; southward by
Reserve No. 2808, 900 links; and westward by Section
No. 15239, 694·4 links: be all the aforesaid linkages more or
less; as the same is more particularly delineated on the plan
deposited in the Survey Office, Christchurch.

"The Education Act, 1877."—Payments to Education
Boards.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fourth
day of July, 1894.

Present:

His Excellency the Governor in Council.

IN exercise and pursuance of the powers and authorities
vested in him by "The Education Act, 1877," His
Excellency the Governor, with the advice and consent of the
Executive Council of the colony, doth hereby make the
regulation hereto annexed regarding certain payments of
capitation allowance to Education Boards; and, with the
like advice and consent, doth hereby prescribe that this
order shall come into force on the date of the first publica-
tion thereof in the New Zealand Gazette.

REGULATION.

NOTWITHSTANDING anything to the contrary contained in an
Order in Council made on the 5th day of January, 1888,
under the provisions of "The Education Act, 1877," relating
(inter alia) to attendance registers and returns, the payment
of capitation allowance to Education Boards for the quarter
ending on the 30th day of September, 1894, shall be accord-
ing to the working-average attendance of the quarter ending
on the 30th day of June, 1894, as working average is defined
by Order in Council dated the 5th day of July, 1887, and
made under the provisions of the before-mentioned Act.

Rural Lands in the Auckland Land District open for Sale
or Selection.

GLASGOW, Governor.

IN pursuance and exercise of the powers and authorities
conferred upon me by the one hundred and thirty-sixth
section of "The Land Act, 1892," I, David, Earl of Glasgow,
the Governor of the Colony of New Zealand, having received
the report of the Surveyor-General in this behalf, as in the
said section is provided, do hereby declare that the rural lands
described in the Schedule hereto shall be open for sale or
selection on and after the nineteenth day of September, one
thousand eight hundred and ninety-four; and also that the
lands mentioned in the said Schedule may, at the option of
the applicant, be purchased for cash, or be selected for occu-
pation with right of purchase or on lease in perpetuity, or,
in respect of any lands containing or supposed to contain
any metal, mineral, or valuable stone, be selected on lease
in perpetuity only; and I do hereby also fix the prices
at which the said lands shall be sold, occupied, or leased, as
mentioned in the said Schedule hereto, and do declare that
the said lands shall be sold, occupied, or leased under and
subject to the provisions of "The Land Act, 1892."

SCHEDULE.

AUCKLAND LAND DISTRICT.—WHAKATANE COUNTY.
Unsurveyed Second-class Land.

ALL that parcel of land in the Auckland Land District,
situate in the Parish of Waiotahi, and containing approxi-
mately 6,050 acres. Bounded towards the north-east by
Sections Nos. 483, 399, and 393 of the Parish of Waiotahi,
and by a road reserved along the banks of the Wairoeka
River; towards the south-east generally by Sections Nos.
459 and 481 of the Parish of Waiotahi aforesaid, by a road
reserved along the banks of the Wairoeka River, by Section
No. 461 of the same parish, again by a road reserved along
the banks of the Wairoeka River, by the Ruahema Stream,
and by Section No. 480 of the parish aforesaid; towards the
south by Block II., Wairoeka Survey District; towards the
west generally by a public road; and towards the north-west
by Section No. 479 of the Parish of Waiotahi aforesaid, to
the point of commencement.

Description of land: All very rough, broken, forest land,
situate about eight miles south of Opotiki Town.

Cash price, 10s. per acre; occupation with right of pur-
chase, 6d. per acre; lease in perpetuity, 4·8d. per acre.

All that parcel of land in the Auckland Land District,
situate in the Parish of Waimana, and containing approxi-
mately 13,300 acres. Bounded towards the north by Small
Grazing-runs Nos. 4 and 5 of the Subdivision of Section
No. 245 of the Parish of Waimana; towards the north-east
generally by Sections Nos. 312 and 313, of the same parish,
by a mineral springs reserve, again by Section No. 313, by
a public road, by Sections Nos. 315 and 314 of the same
parish, and by the Waingarara Stream; towards the east
generally by the Nukuhou River and Sections Nos. 183, 184,
185, 186, 187, 188, 189, 190, 191, 192, 193, 194, 197, 198, 199,
and 200 of the Parish of Waimana aforesaid; towards the
south by Sections Nos. 203, 202, 201, and 307 of the same
parish; and towards the west generally by the Waimana
River and by Sections Nos. 310, 280, 281, and 311 of the
Parish of Waimana aforesaid, to the point of commence-
ment: save and except Sections Nos. 316, 317, and 318 of
the parish aforesaid from the area hereinbefore described.

Description of land: About two-thirds broken forest land,
of good quality; remainder open land, fern and tea-tree,
indifferent soil. Situate three to four miles south of Ohima
Harbour.

Cash price, 10s. per acre; occupation with right of pur-
chase, 6d. per acre; lease in perpetuity, 4·8d. per acre.

As witness the hand of His Excellency the Governor,
this thirteenth day of July, one thousand eight
hundred and ninety-four.

Warrant authorising the County Council of Raglan to
establish a Ferry over the Waikato River at Huntly,
and apportioning the Cost of the Ferry between the said
Council and the Waikato County Council.

GLASGOW, Governor.

WHEREAS by section fifteen of "The Public Works
Acts Amendment Act, 1889" (hereinafter termed
"the said Act"), it is, inter alia, enacted that, in any case
where the local authority of any district desires to establish
a ferry in any position that will, in its opinion, be of advan-
tage and benefit to the whole or any considerable portion of
the inhabitants of an adjacent district or districts, as well
as to the inhabitants of its own district, and where it is, in
the opinion of such local authority, reasonable that the local
authority or local authorities of such district or districts
whose inhabitants are to be so benefited, should contribute
to the cost of establishing the said ferry, the provisions in
the said section mentioned shall have effect:

And whereas the County Council of Raglan, being desirous
of establishing the ferry mentioned in the Schedule hereto,
under the provisions of the said Act, prepared plans, specifi-
cations, and estimates of the work of establishing the said
ferry, and sent a copy of same to the office of the County
Council of Waikato, and to the Minister for Public Works,
together with a notice from the said Council to the said
County Council of Waikato, as required by the provisions of
section fifteen of the hereinbefore in part recited Act:

And whereas, the County Council of Waikato having lodged
an objection to the said ferry being established, a Commis-
sioner was appointed to inquire into and report on the
matter, in terms of the hereinbefore in part recited Act:

And whereas the aforesaid Commissioner has reported that
he is of opinion that the said ferry should be established by
the County Council of Raglan, and that the cost of esta-
blishing the said ferry should be borne proportionately by the
said County Council of Raglan and the said County Council
of Waikato:

And whereas the Governor is of opinion that the work
should be done:

Now, therefore, I, David, Earl of Glasgow, Governor of the
Colony of New Zealand, in pursuance and in exercise of the
power and authority vested in me by the said Act, do hereby
authorise the County Council of Raglan to establish the said
ferry; and I do hereby declare that a proportion of two-
thirds of the cost of establishing the said ferry shall be
