  1. The company shall be liable for any injury which the said wharf or slip may cause through any default or neglect on its part.
  2. In case the company shall—
    (1.) Commit or suffer a breach of the conditions hereinbefore set forth, or any of them;
    (2.) Cease to use or occupy the said wharf or slip for a period of thirty days;
    (3.) Be in any manner wound up or dissolved; or
    (4.) Fail to pay the sums specified in clause four of these conditions;
    then and in any of the said cases this Order in Council, and every license, right, power, or privilege, may be revoked and determined by the Governor in Council without any notice to the company or other proceedings whatsoever; and publication in the New Zealand Gazette of an Order in Council containing such revocation shall be sufficient notice to the company, and to all persons concerned or interested, that this Order in Council, and the license, rights, and privileges hereby granted to the company, have been revoked and determined.
  3. The erection of the wharf and slip, or either of them, by the company under the conditions hereinbefore set forth shall be deemed to be an acceptance by such company of all such conditions, and to be an agreement on the part of the company to observe the same.

Regulations under the Fisheries Conservation Act.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fourth day of July, 1894.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by “The Fisheries Conservation Act, 1884” (hereinafter termed “the said Act”), it is, among other things, enacted that the Governor in Council may from time to time make, alter, and revoke regulations for the purposes therein mentioned, which regulations shall have force and effect only in any waters and places specified therein:
And whereas it is expedient to make the regulations hereinafter set forth with respect to indigenous fish inhabiting the waters of the colony herein mentioned:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred upon him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations, and, with the like advice and consent, doth order that these regulations shall have force and effect in all waters in the colony.

REGULATIONS.

  1. WHEN a person is lawfully engaged in setting or placing his nets for the purpose of taking indigenous fish, no person shall impede him by the process known as “blocking,” whereby another person sets or places his nets outside, or round, or partly round the nets of the person first setting or placing his nets, so as to prevent fish getting through to such last-mentioned nets.
  2. Any person committing a breach of the above regulation shall be liable to a penalty not exceeding fifty pounds, to be recovered as by “The Fisheries Conservation Act, 1884,” is provided.

Vesting a Reserve in the Rangiora Borough Council.
GLASGOW, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fourth day of July, 1894.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS the land mentioned in the Schedule hereto was permanently reserved for plantation and river-protection purposes on the twenty-first day of June, one thousand eight hundred and ninety-four:
And whereas, in the opinion of the Governor, it is expedient to vest the said land in the Rangiora Borough Council:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that from and after the day of the date hereof the reserve mentioned in the Schedule hereto shall become vested in the Mayor, Councillors, and Burgesses of the Borough of Rangiora in trust for plantation and river-protection purposes.

SCHEDULE.
CANTERBURY LAND DISTRICT.
All that parcel of land in the Land District of Canterbury, containing by admeasurement 16 acres 2 roods, more or less, being Section No. 3036, in red, formerly parts of Reserves 1380, 1921, and 2431, Block VI., Rangiora Survey District, and bounded as follows: On the northward by other portions of said reserves; on the eastward by a line parallel to, and 300 links distant from, the centre line of railway; on the southward by a road-line forming the northern boundary of Sections Nos. 1684, 2674, and 4216; on the westward by a line in continuation of the western boundary of Section No. 4216, being a strip of land 200 links wide: be all the aforesaid linkages more or less; as the same is delineated on the plan deposited in the office of the Chief Surveyor, Christchurch.

Powers delegated to the Carleton Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fourth day of July, 1894.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the ninth day of August, one thousand eight hundred and ninety-two, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present Order, delegate, but only with respect to the pieces or parcels of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Carleton Public Domain Board, namely,—

JOHN CROSS,
JOHN SKURR,
HENRY DAVIDSON,
JOSEPH INCH, and
HENRICK STEFFENS
(hereinafter referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the third Wednesday in each month, at eight o'clock p.m., at Carleton, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Wednesday, the fifteenth day of August, one thousand eight hundred and ninety-four.
  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days' notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.
  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.
  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the third Wednesday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.
  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.
  6. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.
  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.
