KIWITEA ROAD BOARD.

SPECIAL order made on the 16th September, 1893, and con-
firmed on the 21st October, 1893:-
"That the by-laws attached hereto be adopted as the by-
laws of the Birmingham Cemetery."
I hereby certify that the above special order has been duly
made in accordance with the provisions of "The Road Boards
Act, 1882."

RULES OF THE BIRMINGHAM PUBLIC CEMETERY.

  1. SUCH portion of the Birmingham Cemetery now fenced
    in and laid out into blocks shall be from time to time divided
    into burial-plots, measuring 10ft. by 5ft. The following shall
    be the burial charges: viz., For every single interment
    in ordinary grave or vault, per adult, 10s.; children under
    twelve years, 7s. 6d.; for reopening grave or vault for inter-
    ment, adult or child, 15s.

  2. Any person desiring to have the exclusive right of burial
    in perpetuity in any plot or plots can have the same on the
    payment to the Trustees of the sum of 15s. sterling for the
    first plot-10ft. by 5ft.-and 10s. each for every additional
    plot purchased at the same time.

  3. Grants of exclusive right of burial in perpetuity shall
    be made out in the form marked A annexed to these regu-
    lations, and shall only be made out in the name of one
    particular person, to be named therein.

  4. Any purchaser of exclusive right of burial in perpetuity
    in any plot or plots of ground in the cemetery in which no
    interment shall have taken place may, by permission of the
    Trustees, transfer his or her interest in the said plot or plots
    to any other person upon payment being made to the
    Trustees of a transfer-fee of 2s. 6d. for every such transfer,
    and on production to the Trustees of the original grant.

  5. On the death of any person holding a grant of exclusive
    right of burial in perpetuity, the grant may be transferred to
    any other person applying to the Trustees for such transfer
    on payment of a fee of 2s. 6d., on production of the original
    grant, and on their producing sufficient and satisfactory evi-
    dence of their authority to apply for the said transfer.

  6. If at any time a grant of exclusive right of burial should
    be lost or accidentally destroyed, a duplicate grant may be
    obtained on application, in writing, made to the Trustees,
    and on payment of a fee of 5s. Persons applying for a
    duplicate grant must give satisfactory written evidence of
    the loss or destruction of the original grant, and of their
    authority to apply for a duplicate grant. Should the ori-
    ginal grant be at any time found after the issue of a dupli-
    cate, the duplicate must be at once returned to the Trustees.

  7. Parties applying for grants of exclusive right of burial,
    or for transfers or duplicates of the same, must, at their own
    cost, provide all necessary duty stamps.

  8. A sexton will from time to time be appointed by the
    Trustees, whose duty it will be to dig all graves required in
    the cemetery; and no other person will be allowed to dig
    any grave therein without express permission in writing
    from the Trustees.

  9. All graves must be dug at least 6ft. deep on the
    shoal side, for which a charge of 12s. 6d. per adult and
    7s. 6d. for children under twelve years will be made; but in
    the event of any person requiring a greater depth, an extra
    charge of 2s. will be made for every additional foot: no part
    of a coffin to be within 4ft. 6in. of the surface.

  10. The Trustees shall keep or cause to be kept a book in
    which shall be entered from time to time the number of
    every plot disposed of for the exclusive right of burial, the
    name of the purchaser, and date of disposal. They shall
    also keep a record of every plot of ground used for the
    purpose of interment, the name of the person interred, and
    the date of burial.

  11. The record-book and plan of cemetery, when prepared,
    shall be open for inspection to the public any day, Sundays
    and holidays excepted, between the hours of 10 a.m. and
    3 p.m., on payment of a fee of 1s. The fee for inspection
    will be remitted in the case of persons applying for and
    taking out a burial warrant.

  12. In all cases of intended interment, the persons having
    management or control of the same shall apply for a burial
    warrant to the Trustees or other person appointed to issue
    the same. The warrant shall be in the form marked B
    annexed to these regulations, and shall be given to the
    party applying for the same upon payment of fees before-
    mentioned.
