Removal of Restrictions on Alienation of Native Land.

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this eighteenth day of December, 1893.

Present:

THE HONOURABLE SIR P. A. BUCKLEY, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS application has been made to the Governor in Council by Wiremu te Pea and Ripeka te Pea, the Native owners of the land described in the second column of the Schedule hereto, praying that the restrictions on the alienation of such land contained in the Land Transfer certificate bearing date the twenty-ninth day of November, one thousand eight hundred and eighty-two, described in the first column of the said Schedule, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has reported that the provisions of the law in that behalf have been complied with: And whereas it appears expedient to grant such application:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred on him by "The Native Land Act, 1888," and acting with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that all restrictions imposed by the said Land Transfer certificate on the alienation of the said land are hereby removed.

FIRST COLUMN. SECOND COLUMN.
Particulars of Grant or Instrument containing Restrictions. Description of Land.
Land Transfer certificate, Vol. xxix., folio 155, dated the 29th November, 1882, and containing the following restrictions: "Inalienable by sale, lease, or by mortgage for a longer period than twenty-one years without the consent of the Governor being previously obtained." All that parcel of land, containing 50 acres, situate in the Provincial District of Auckland, being Section 34, Block XII., Te Aroha Survey District.

Negotiations for acquiring Native Lands entered into by Her Majesty.

GLASGOW, Governor.

IN pursuance of the provisions of "The Native Land Purchases Act, 1892" (hereinafter termed "the said Act"), it is hereby notified that negotiations by Her Majesty the Queen for the purchase or acquirement of the blocks of Native land which are more particularly described and mentioned in the Schedule hereto were entered into prior to the passing of the said Act, and are still subsisting; and notice is hereby further given that, from and after the date of the publication hereof, it shall not be lawful for any person other than Her Majesty to purchase or acquire from the Native owners any right, title, share, or interest in the lands above mentioned until this notice shall have been formally withdrawn.

SCHEDULE.

MOHAKATINO-PARININIHI NO. 1.

All that parcel of land, situated in the County of Clifton, in the Tainui, Mokau, Mimi, and Wairo Survey Districts, in the Provincial District of Taranaki, known by the name of Mohakatino-Parininihi No. 1 Block, containing by admeasurement 62,000 acres, more or less. Bounded towards the north by the Mohakatino River and the Waiarara Block, 56,000 links; towards the south by the confiscation-line and Mohakatino-Parininihi No. 3 Block, 165668.4 links; and towards the west by Mohakatino-Parininihi No. 2 Block and the Tasman Sea.

TE PUJA (PORTION OF WAIPIRO).

All that parcel of land in the County of Waipu, in the Mata Survey District, in the Provincial District of Auckland, containing by admeasurement 836 acres, more or less, being a portion of the Waipiro Block, known by the name of Te Puja, and lying between the Makarika and Waikau Streams. Bounded towards the north, south-east, and south-west by a series of right lines commencing at a point on the right bank

of the Makarika Stream about 1 chain above the confluence of that stream with the stream that forms the outlet from Lake Ratahiti, the bearings and lengths of the right lines referred to being respectively as follows: 89° 40', 2915 links; 86° 28', 2930 links; 92° 33', 6161 links; 197° 18', 2826 links; 215° 6', 978 links; 245° 15', 9096 links; 302° 20', 4506 links; and 291° 15', 1062 links, to the Makarika Stream aforesaid; and towards the north-west by the said Makarika Stream: be all the aforesaid linkages more or less.

Defining Limits of the Harbour of Port Robinson.

GLASGOW, Governor.

IN pursuance of the power and authority in me vested by the ninth section of "The Harbours Act, 1878," I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, do hereby define the limits of the harbour of Port Robinson, in the said colony, to be those set out and described in the Schedule hereto.

SCHEDULE.

All that area to seaward of high-water mark, and within the arc of a circle having a radius of two nautical miles, the centre of which arc is a point at high-water mark in the middle of the landing-slip in Gore Bay; as the same is delineated on the plan, signed by the Governor, marked M.D. 1913, and deposited in the Marine Department, at Wellington.

As witness the hand of His Excellency the Governor, this sixth day of January, one thousand eight hundred and ninety-four.

IN exercise and pursuance of the powers and authorities vested in me by the one hundred and eighty-ninth section of "The Land Act, 1892," I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, do hereby appoint

CHARLES WILLIAM ADAMS, Esq., Chief Surveyor for the Land District of Otago;
ANDREW MCKERROW, Esq.; and
HENRY CLARK, Esq.,

Commissioners, to classify and report to me upon the rural lands in the Land District of Otago known as Runs 199A, 199B, 204, 204A, 236E, 236H, 261A, 262A, and 478; Sections 8 to 19, Block II.; Section 20, Block II.; Sections 4 to 6, Block III., Cairnhill Survey District; Sections 11 to 14, Dunback District; Sections 1 to 3, Block I., Hummock Survey District; Sections 11, 14, and 14A, Block VII., Waihemo Survey District: as provided by section one hundred and eighty-nine of "The Land Act, 1892," aforesaid.

As witness the hand of His Excellency the Governor, this twenty-third day of December, one thousand eight hundred and ninety-three.
