Act, 1882," taking certain lands for the purpose of the pro-
tection and safety of the inhabitants of the Borough of
Napier:

And whereas the said Proclamation is incorrect in the
second clause thereof, namely, the words, "And whereas
the Minister for Public Works has laid before the Governor
the memorial," should read, "the Borough Council of
Napier has laid before the Governor the memorial":

And whereas it is expedient to cancel portion of the said
recited Proclamation, and to make provision in lieu thereof
in manner hereinafter appearing:

Now, therefore, I, David, Earl of Glasgow, the Governor
of the Colony of New Zealand, in exercise and pursuance of
the powers and authorities vested in me by "The Public
Works Acts Amendment Act, 1889," and of all other powers
and authorities in anywise enabling me in this behalf, do
hereby revoke so much of the said recited Proclamation as
refers to the said Minister for Public Works, and in lieu
thereof do hereby proclaim and declare that the words
"the Borough Council of Napier has laid before the
Governor" shall be inserted.

Given under the hand of His Excellency the Right
Honourable David, Earl of Glasgow; Knight
Grand Cross of the Most Distinguished Order of
Saint Michael and Saint George; Governor and
Commander-in-Chief in and over Her Majesty's
Colony of New Zealand and its Dependencies,
and Vice-Admiral of the same; and issued under
the Seal of the said Colony, at Christchurch,
this second day of February, in the year of our
Lord one thousand eight hundred and ninety-
four.

Allocating Lands reserved and taken for a Railway to the
Purposes of a Road in the Avon Road District.

A PROCLAMATION.

WHEREAS the lands mentioned in the Schedule hereto
form part of land taken for the purposes of the
Hurunui-Waitaki Railway, and it is considered desirable
to allocate such lands to the purposes of a road:

And whereas it has been certified by the New Zealand
Railway Commissioners that such lands are not required for
railway purposes: And whereas such lands are situated in
the Avon Road District, the local authority of which has
consented to the issue of this Proclamation:

And whereas His Excellency the Governor is of opinion
that the said local authority can conveniently construct and
maintain the said road:

Now, therefore, I, David, Earl of Glasgow, the Governor
of the Colony of New Zealand, in exercise and pursuance
of the powers and authorities in me vested by section five
of "The Public Works Acts Amendment Act, 1889," and of
every other power and authority in anywise enabling me in
that behalf, do hereby proclaim and declare that the lands
described in the Schedule hereto shall, upon the publication
hereof in the New Zealand Gazette, become a road, and that
the said road shall be under the control of the Avon Road
Board, and shall be maintained by the said Board in like
manner as other public highways are controlled and main-
tained by the said Board.

SCHEDULE.

All that area in the Canterbury Land District, containing
by admeasurement 2 roods 21 perches, more or less, being
portion of Rural Section No. 298, in Block III., Christchurch
Survey District, and being a strip of land 50 links wide.
Bounded towards the south-west by the Belfast Road, from
a point on the north-eastern side of said road distant 2393
links from the south-western corner of Rural Section No. 298,
for a distance of 505 links; towards the south-east by a
right line parallel to the railway reserve intersecting said
Section No. 298, 1262 links; towards the north-east by
Rural Section No. 373, 50
5 links; and towards the north-
west by a right line parallel to the railway reserve before-
mentioned, 1,262 links, to the Belfast Road at the point first
mentioned: be all the above linkages more or less.

Also, all that parcel of land in the Canterbury Land Dis-
trict, containing by admeasurement 18 perches, more or less,
being portion of Rural Section No. 373, in said Block III.
Bounded towards the south-west by Rural Section No. 298,
from a point on the south-western boundary of said Section
No. 373 distant 2557 links from the south-western corner
thereof for a distance of 111 links; towards the south-east
by a right line parallel to the railway reserve intersecting
the said Section No. 373, 101 links; towards the north-east

by a right line parallel to the south-west boundary-line of
said Section No. 373, 111 links; and towards the north-west
by a right line parallel to the railway reserve before-men-
tioned, 101 links, to the point first mentioned: be all the
aforesaid linkages more or less.

As the same are delineated on plan numbered S.G. 21871,
deposited in the Head Office of the Department of Lands
and Survey, at Wellington, in the Land District of Welling-
ton, and thereon coloured green.

Grand Cross of the Most Distinguished Order of
Saint Michael and Saint George; Governor and
Commander-in-Chief in and over Her Majesty's

vested in me by the one hundred and seventy-second
section of "The Land Act, 1892," and of every other power
and authority enabling me in that behalf, I, David, Earl of
Glasgow, the Governor of the Colony of New Zealand, do
hereby declare that the land mentioned in the Schedule
hereto shall be subject to the provisions of sections one
hundred and seventy-two to one hundred and eighty-six of
Part V. of "The Land Act, 1892," relating to small grazing-
runs.
