mineral lease within any district, shall be entitled to run one head of great cattle free of assessment fees on any Crown lands within a district which are not held under a lease or license for depasturing purposes: Provided that, if more than four persons hold or occupy land as a licensed holding or special claim, they shall not be entitled to run more than four head of great cattle in respect of every such licensed holding or special claim.
Agricultural Leases.
- Any holder of an agricultural lease within any district shall be entitled to run great cattle free of assessment fees in proportion to the acreage of the land held under such lease, as follows: For a lease of 50 acres, or any less quantity, one head; for any additional fifty acres, one head.
Depasturing License.
- Every holder of a miner's right, business license, licensed holding, special claim, agricultural lease, or mineral lease, may, subject to these regulations, run cattle upon any Crown lands, not held as aforesaid, within any district, in excess of the number which he is entitled to run free of assessment fees hereunder, on obtaining a depasturing license in the form contained in the First Schedule hereto; and any other person resident in a district may so run cattle within such district, on obtaining such a license as aforesaid.
Application to be made.
- Any person desirous of obtaining a depasturing license shall lodge with the Clerk of the County Council having jurisdiction over that portion of the district in which he desires the depasturing license to take effect an application in writing in the form of the Second Schedule hereto, and shall deposit therewith the assessment and registration fees payable under these regulations. If such application is refused, the assessment and registration fees will be repaid to the applicant, but not otherwise. No depasturing license will in any case be granted to any applicant under the age of eighteen years.
Application, how dealt with.
- If the application shall be to depasture not more than five head of great cattle, the Clerk of the County Council may, with the consent and approval of the Chairman, forthwith issue a depasturing license, in the form of the Third Schedule hereto annexed, to the applicant; but if such application shall be for depasturing any larger number of great cattle, or for depasturing small cattle, the Clerk shall submit the same to the County Council at the next ordinary meeting thereof, and the County Council shall determine how such application shall be dealt with.
Assessment Fees.
- The assessment fees to be paid annually in advance under these regulations shall be for every head of great cattle, 2s. 6d.; for every head of small cattle, 6d.
Registration.
- All cattle depastured upon lands under these regulations, whether running free of assessment or by virtue of a depasturing license, must be branded, and the brands and a description of the cattle must be registered with the Clerk of the Council of the county within which such lands are situated. The fee for every such registration shall be 1s.; and a certificate of registration in the form contained in the Fourth Schedule hereto shall be given by the said Clerk to all persons paying any such last-mentioned fee.
Register to be kept.
- The Clerk of the County Council within any district shall keep a register of brands and a list of depasturing licenses and registration certificates issued, with the date of issue and the names of the licensees and certificate-holders; and such register shall be kept in the Council offices, and may be inspected at any time by the public on payment of a fee of 1s.
Brands previously registered.
- If a brand described in any application has been previously registered by any other person, the applicant shall amend his application by inserting therein some other brand not previously registered.
Penalty for depasturing Cattle whose Brands are not registered or without a Depasturing License.
- Any person depasturing great or small cattle in any district which are not branded or whose brands are not registered, or without a certificate or license authorising the holder thereof in that behalf, and any person depasturing thereon a greater number of cattle than he is entitled to by virtue of such license or certificate, shall, upon conviction, for each offence be liable to a penalty not exceeding 40s. per head for every head of cattle so depastured or not registered or branded.
Diseased Cattle.
- No diseased cattle shall be depastured upon, nor shall any pigs or goats be allowed at large within, any district; and any person or persons who shall turn out or depasture any diseased cattle, or suffer any pig or goat to be allowed at large within any district, shall be liable to a penalty of not exceeding £10 for the first offence and £20 for every second or subsequent offence.
Depasturing of Bulls prohibited.
- No bull nor any entire horse above the age of twelve months shall be turned out or depastured or allowed to run at large upon any land subject to these regulations without the written authority of the County Council having jurisdiction over such lands; or its authorised officer; or if any person shall, without the written authority aforesaid, turn out or depasture upon any of the said lands any bull or entire horse, or shall suffer or allow any bull or entire horse belonging to him or in his care or custody to be at large upon any lands subject to these regulations, he shall be liable to a penalty of £10 for the first offence and a penalty of £20 for any second or subsequent offence.
Stock not to be unnecessarily disturbed.
- No person shall drive, harass, or unnecessarily disturb any cattle lawfully depasturing upon any land subject to these regulations; and if any person shall unlawfully drive, harass, or unnecessarily disturb any cattle so depasturing as aforesaid he shall be liable to a penalty not exceeding £5 for each offence.
Removal of Cattle.
- No person shall remove any cattle (excepting such are his own property) from any lands subject to these regulations without the written sanction of the owner of such cattle.
Any person desirous of removing cattle shall drive all the cattle collected by him into the nearest stock-yard, and there examine them carefully, and shall then separate from his own cattle any cattle he may have collected which do not belong to him, and he shall forthwith drive the latter back to the place from whence they were taken. Any person committing any breach of this regulation shall be liable to a penalty not exceeding £5.
Cattle not to be removed between the Hours of Sunset and Sunrise.
- No person shall muster or remove cattle upon or from any lands subject to these regulations between the hours of sunset and sunrise.
Any person committing a breach of this regulation shall be liable to a penalty not exceeding £5 for each offence.
Mustering Cattle.
- The Council of the county within which any lands subject to these regulations are situated may authorise any Ranger or any other person it may think fit to muster the cattle depasturing upon any such lands for the purpose of ascertaining whether there are among them any unbranded or unregistered cattle, or any cattle depasturing contrary to these regulations, and every depasturing license issued under these regulations shall be deemed to have contained therein the reservation of such a right as aforesaid.
Unbranded or Unregistered Cattle.
- If any unbranded or unregistered cattle shall at any time be found on any lands subject to these regulations, or if any cattle shall be found illegally depasturing upon such lands, the owner of such cattle shall, in addition to any penalty otherwise provided by these regulations, be liable to pay, and shall pay, to the county authorities having jurisdiction over such lands all cost and charges incident to the collecting and recovering of such cattle.
