Fixing Dues, Tolls, and Charges for Wharves in
Kaipara Harbour.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-
third day of November, 1891.
Present:
THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.
WHEREAS it is provided by section two hundred and
fifteen of "The Harbours Act, 1878" (hereinafter
termed "the said Act"), that every Harbour Board shall,
inter alia, have power, by by-laws, to fix scales of dues, tolls,
and charges to be paid for the use of wharves within the
limits of the harbour:
And whereas it is provided by the twelfth section of the
said Act that in harbours where there is no Harbour Board
the Governor in Council shall have all the powers, functions,
duties, and authorities by the said Act conferred upon Har-
bour Boards, and may exercise the same in accordance with
the said Act:
And whereas there is no Harbour Board in the Harbour of
Kaipara, and it is desirable that dues, tolls, and charges
should be fixed for the use of the county wharves at
Mount Wesley, Aratapu, Miti tai, Whakahara, and Tikinui,
in the said harbour:
Now, therefore, I, William Hillier, Earl of Onslow, the
Governor of the Colony of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
colony, and in pursuance of the hereinbefore-recited power
and authority, and of all other powers and authorities
enabling me in that behalf, do hereby make the by-law set
forth in the Schedule hereto, and do order that it shall apply
to the county wharves at Mount Wesley, Aratapu, Miti tai,
Whakahara, and Tikinui, in the Harbour of Kaipara.
SCHEDULE.
BY-LAW.
The following dues, tolls, and charges shall be paid for the
use of the county wharves at Mount Wesley, Aratapu, Miti-
tai, Whakahara, and Tikinui, in the Harbour of Kaipara,
viz.:
On every vessel under 20 tons register lying along-
side a wharf, for each day or part of a day .. £0 1 0
On every vessel under 20 tons register, for every
day or part of a day that such vessel lies along-
side a vessel lying at a wharf .. .. 0 0 6
On every vessel under 20 tons register undergoing
repairs or fitting out alongside a wharf, or lying
off a wharf with a line attached thereto, per
day or part of a day .. .. .. 0 0 6
On every vessel of 20 tons register and upwards
lying alongside a wharf, per ton, per day or part
of a day .. .. .. .. .. 0 0 0½
Minimum charge on every sailing-vessel of 20 tons
register and upwards lying alongside a wharf,
per day or part of a day .. .. .. 0 1 0
Minimum charge on every steamer of 20 tons
register and upwards lying alongside a wharf,

On every vessel of 20 tons register and upwards
lying alongside a vessel at a wharf, or lying
off a wharf with a line attached thereto, or
undergoing repairs, per ton, per day or part of a

On all stone or shingle ballast landed on a wharf,

Revoking Regulations for Netting Trout in the Lakes in
Mackenzie County.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-
third day of November, 1891.

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.
WHEREAS by Order in Council dated the sixth day of
March, one thousand eight hundred and ninety-one,
and published in the New Zealand Gazette No. 19, of the
nineteenth day of the same month, certain regulations were
made under "The Fisheries Conservation Act, 1884," pro-
viding for netting trout in the lakes in the Mackenzie
County: And whereas it is desirable to revoke the said
Order in Council and the regulations made thereby:
Now, therefore, His Excellency the Governor of the
Colony of New Zealand, acting by and with the advice and
consent of the Executive Council of the said colony, and in
pursuance and exercise of all the powers and authorities
enabling him in that behalf, doth hereby revoke the said
Order in Council of the sixth day of March, one thousand
eight hundred and ninety-one, and the regulations made
thereby.

Defining Limits of the Harbour of Wanganui.
ONSLOW, Governor.
IN pursuance of the power and authority in me vested by
the ninth section of "The Harbours Act, 1878," I,
William Hillier, Earl of Onslow, the Governor of the Colony
of New Zealand, do hereby define the limits of the Harbour
of Wanganui, in the said colony, to be those set out and
described in the Schedule hereto. All former warrants or
instruments defining the limits of the said harbour or port
are hereby revoked.
SCHEDULE.
All that area commencing at a point about 25 chains to
the south of Cliff Trig. Station where the line of ordinary
high-water mark is intersected by an arc of a circle having
a radius of two nautical miles from Knowles's Block No. 4,
near the pilot's flagstaff, and bounded towards the west and
south by the said arc of a circle to where it strikes the
main land at ordinary high water about 62 chains to the
south of Landguard Trig. Station; thence towards the
north-east by ordinary high-water mark along the shore of
Cook Strait to the mouth of the Wanganui River; thence
towards the south-east generally by ordinary high-water
mark along the left bank of the said river to a point where
a line bearing N. 46° W. will strike the southern corner
of the Raorikia Native Reserve; thence towards the north-
east by the said line to ordinary high-water mark on the
right bank of the said river; and thence towards the north-
west generally by ordinary high-water mark along the right
bank of the said river to its mouth; and thence again
towards the north-east by ordinary high-water mark along the
shore of Cook Strait to the commencing-point: the herein-
before mentioned line of high-water mark shall be deemed
to cross the mouths of any tributaries of the said Wanganui
River; as the same is delineated on the plan signed by the
Governor, marked M.D. 1699, and deposited in the office of
the Marine Department, at Wellington.
As witness the hand of His Excellency the Governor,
this twenty-seventh day of November, one thou-
sand eight hundred and ninety-one.
