"Westland and Nelson Coal Fields Administration Act, 1877."—Lands reserved for Tramway.

ORDER IN COUNCIL.
At the Government House, at Wellington, this eleventh day of November, 1890.
Present:
His Excellency the Governor in Council.
WHEREAS by the twentieth section of "The Westland and Nelson Coal Fields Administration Act, 1877," it is enacted that the Governor may, by Order in Council, from time to time reserve such portions of the lands described in the First, Second, Third, and Fourth Schedules to the said Act which, in his opinion, are required for the purposes in the said section mentioned:
And whereas the lands described in the Schedule hereto form part of the lands described in the Third Schedule to the said Act, and such lands are subject to be dealt with under the provisions of section twenty of the said Act, and in the opinion of the Governor it is expedient to reserve the same for the purposes therein and hereinafter set forth:
Now, therefore, His Excellency the Governor, in exercise and pursuance of the above-recited power, and by and with the advice and consent of the Executive Council of New Zealand, doth hereby set apart and reserve the lands described in the first division of the Schedule hereto; and doth hereby declare that the purpose of the said reserve shall be that specified in the second division of the said Schedule.

ORDER IN COUNCIL.
At the Government House, at Wellington, this eleventh day of November, 1890.

WHEREAS by the twenty-first section of "The Westland and Nelson Coal Fields Administration Act, 1877," it is enacted that the Governor may, by Order in Council, authorise any lessee under a lease granted for coal-mining purposes, and his servants and workmen, full and free liberty of making, and using when so made, any railways, tramways, bridges, inclines, staiths, or other means of transit over the lands described in the First, Second, and Third Schedules to the said Act, and whether the same shall be demised by any lease for coal-mining purposes or not, on the conditions mentioned in sections twenty-two and twenty-three of the said Act:
And whereas the Westport Coal Company (Limited) is a lessee of the Crown under a lease granted for coal-mining purposes, and has complied with the conditions set forth in sections twenty-two and twenty-three of the said Act, and is desirous of constructing a tramway, bridges, inclines, and staiths over the lands mentioned in the Schedule below, which said lands form part of the lands described in the Third Schedule to the said Act:
Now, therefore, His Excellency the Governor, in exercise and pursuance of the above-recited power, and by and with the advice and consent of the Executive Council of New Zealand, doth hereby authorise the Westport Coal Company (Limited), its servants and workmen, full and free liberty of making, and using when so made, a tramway, bridges, inclines, and staiths over the land described in the Schedule hereto: Provided, however, that the authority hereby given shall be concurrent with the coal-mining lease from the Queen to the said company, dated the thirtieth day of July, one thousand eight hundred and eight-eight, and being for a
SECOND DIVISION.
Purpose for which the Land is required to be reserved.
For the use of the Westport Coal Company (Limited), for its tramway, bridges, inclines, and staiths. The reserve hereby made shall continue only and be concurrent with the coal-mining lease from the Queen to the said company, dated the 30th day of July, 1888, for ninety-nine years from the 1st day of January, 1888. Provided, however, that the right is hereby reserved to the Government to construct a road, if necessary, upon any part of the area mentioned in the first division hereto that may not be actually occupied by the said tramway, bridges, inclines, and staiths; and provided also that the Government may permit the County Council or the Road Board to construct a road over the said land upon the like conditions.

term of ninety-nine years from the first day of January, one thousand eight hundred and eighty-eight; and such authority shall determine, without further notice, at the expiration of the said ninety-nine years, or at such prior time as the said lease may expire or be determined: Provided, further, that the right is hereby reserved to the Government to construct a road, if necessary, over any portion of the land mentioned in the Schedule below that is not occupied by the tramway, bridges, inclines, and staiths aforesaid; and also that the Government may permit the County Council or the Road Board to construct a road over such land upon the like condition.
