thousand eight hundred and eighty-six, and in lieu thereof

do make the following regulation, to be applicable generally
to all State forests:—
No person shall trespass in any State forest; and any
person trespassing in a State forest shall be guilty of an
offence, and, on conviction thereof, shall be liable to a penalty
not exceeding £50 in respect of such offence.

Auckland University College to be subject to Section 9 of
"The Public Bodies' Powers Act, 1887."

ORDER IN COUNCIL.
At the Government House, at Wellington, this second day
of September, 1889.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section four of "The Public Bodies'
Powers Act, 1887" (hereinafter termed "the said
Act"), it is provided that the Governor, by Order in Council,
may from time to time declare that any leasing authority
shall be subject to the provisions of the said Act, or any
section of the same, but that no such order shall have any
effect unless it be issued at the request or upon the recom-
mendation of the leasing authority on whose behalf such
order is issued:

And whereas it has been made to appear that the Auck-
land University College Council is a leasing authority within
the meaning of the said Act, and has requested that it may
be brought under the provisions of the ninth section thereof:

Now, therefore, His Excellency William Hillier, Earl
of Onslow, the Governor of the Colony of New Zealand, by
and with the advice and consent of the Executive Council
thereof, and in pursuance and exercise of the powers and
authorities conferred on him by the said Act, doth hereby
order and declare that, from and after the date hereof, the
Auckland University College Council shall be subject to the
provisions of section nine of "The Public Bodies' Powers
Act, 1887."

Constituting Fitzherbert Road District and amending
Manawatu Road District, County of Oroua.

ONSLOW, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this second day
of September, 1889.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section twenty of "The Counties Act,
1886" (hereinafter termed "the said Act"), it is
provided that all the powers of a County Council relating to
the alteration of the boundaries of any road or town districts
within a county, or of amalgamating such districts, or of
merging any of them into the county, and all other powers
in relation to such districts exercisable by the Council by
special order or on petition, may be exercised by the Gover-
nor in Council in respect of any of the counties in which the
said Act is suspended: And whereas the said Act is sus-
pended in the County of Oroua: And whereas in pursuance
of "The Road Boards Act, 1882," a petition has been pre-
sented to His Excellency the Governor, signed by two-thirds
of the ratepayers in the Manawatu Road District, in the said
County of Oroua, praying him to constitute a new road dis-
trict:

Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in pursuance and exercise of the powers
and authorities vested in him by the said Act, and acting by
and with the advice and consent of the Executive Council of
the said colony, doth hereby order and declare that such
portion of the said Manawatu Road District, in the County
of Oroua, as is comprised within the boundaries described in
the First Schedule hereto shall constitute a new road district,
to be called the Fitzherbert Road District; and that the
number of the members of the Board of the said road dis-
trict shall be six; and that the said road district shall be
divided into three subdivisions, as the same are described in
the Schedule aforesaid; and doth apportion two members of
the said Board to each of such subdivisions.

And His Excellency doth further hereby declare that,
from and after the date hereof, the boundaries of the afore-
said Manawatu Road District shall be as the same are
described in the Second Schedule hereto.

And His Excellency, in pursuance of the powers and
authority aforesaid, doth hereby appoint James Stanley
Bruce to be Clerk to the Board of the road district so con-
stituted as aforesaid, to hold office until a Chairman or Clerk
is appointed by the said Board; and doth also appoint the
said James Stanley Bruce to be the Returning Officer to
hold the first election of six members of the said Board;
and Wednesday, the second day of October, one thousand
eight hundred and eighty-nine, to be the day, and the resi-
dence of Mr. Samuel Greer, Fitzherbert, to be the place, for
such first election. And His Excellency doth further appoint
Monday, the seventh day of October, one thousand eight
hundred and eighty-nine, at noon, to be the time, and the
said residence of Mr. Samuel Greer to be the place, for the
first meeting of the Board of the said road district.

FIRST SCHEDULE.
Fitzherbert Road District.

ALL that area in the County of Oroua bounded towards
the north-west generally by a line along the middle of the
Manawatu River, from the County of Horowhenua to a
point in line with a line drawn along the middle of the road
forming the north-eastern boundaries of Sections Nos. 254
and 253, Block XII., Kairanga Survey District; thence
towards the north-east by the latter line to a point in line
with the south-western boundary of Subdivision No. 34, Man-
chester Block, Gorge Survey District; thence again towards
the north-west by the said Subdivision No. 34, and Subdivi-
sions Nos. 33, 32, 30, 28, 26, 24, 20, 18, 16, 14, 12, 10, 8, 6, 4,
and 2 of the said Manchester Block, Ferry Reserve, and Sub-
divisions Nos. 50 and 49 to the Manawatu River; thence
again towards the north-east by a line along the middle of
that river; towards the south-east by the County of Pahia-
tua; and towards the south-west by the County of Horo-
whenua aforesaid.

Subdivision No. 1.

Bounded towards the north-west by a line along the middle
of the Manawatu River; towards the north-east by a line
along the middle of the road forming the north-eastern
boundaries of Sections Nos. 254 and 253, Block XII., Kai-
ranga Survey District; again towards the north-west by
Subdivisions Nos. 34, 33, 32, 30, 28, 26, 24, 20, 18, 16, 14, 12,
10, 8, 6, 4, and 2, Manchester Block, Gorge Survey District,
Ferry Reserve, and Subdivisions Nos. 50 and 49 to the
Manawatu River; again towards the north-east by a line
along the middle of that river; towards the south-east by the
County of Pahiatua to a point due east of the easternmost
corner of Section No. 274, Block IV., Arawaru Survey Dis-
trict; thence towards the south by a right line to the said
corner; and thence towards the south-west by Section No.
274 aforesaid to the road forming the south-eastern boun-
dary of Section No. 263, Block III., Arawaru Survey District;
and thence by that road and the road fronting Sections Nos.
261 and 259 of the said Block III., and 258, 238, 257, 255,
181, 182, 183, 184, and 185 to the western corner of Section
No. 212; thence by a right line to the easternmost corner of
Section No. 186; and thence by that section and Sections
Nos. 209, 208, 204, and 205, all of Block XV., Kairanga Sur-
vey District, to the Manawatu River.

Subdivision No. 2.

Bounded towards the north-east generally by Subdivision
No. 1, hereinbefore described; towards the south-east by the
County of Pahiatua; towards the south by a line due west
to the Kahuterawa Stream, at the easternmost corner of
Section No. 312, Block VII., Arawaru Survey District;
towards the south-west by the said Kahuterawa Stream to
the Manawatu River; and towards the north-west generally
by a line along the middle of the said Manawatu River.

Subdivision No. 3.

Bounded towards the north-east generally by Subdivision
No. 2, hereinbefore described; towards the south-east by the
County of Pahiatua; towards the south-west by the County
of Horowhenua; and towards the north-west generally by a
line along the middle of the Manawatu River.

SECOND SCHEDULE.
Manawatu Road District.—Amended Boundaries.

ALL that area in the County of Oroua bounded towards
the north-east by the Manchester Road District, as described
in the New Zealand Gazette No. 42, 18th May, 1883; towards
the south-east generally by a line along the middle of the
Manawatu River; towards the south-west and again towards
the south-east and north-east by the Borough of Palmerston
North; again towards the south-east by a line along the
middle of the Manawatu River aforesaid to the Oroua River;
and thence towards the west and north-west generally by the
County of Manawatu.
