Extending Time for holding Elections of certain Road
Boards.
ONSLOW, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this second day
of July, 1889.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN exercise and pursuance of the powers and authorities
vested in him by "The Road Boards Act, 1882," His
Excellency the Governor of the Colony of New Zealand, by
and with the advice and consent of the Executive Council
of the said colony, doth hereby order and declare that the
time for holding the general elections of members of Road
Boards under the said Act is hereby extended in all districts
where there has been a failure to hold such elections, and
that such elections may take place not later than the last
day of the month of July, one thousand eight hundred and
eighty-nine.
ALEX. WILLIS,
Clerk of the Executive Council.
Validating Notices of Application for a License under "The
*Licensing Act, 1881."
ONSLOW, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this second day
of July, 1889.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section two hundred and twenty-seven
of "The Licensing Act, 1881" (hereinafter termed
"the said Act"), it is provided that if, through any acci-
dental or unavoidable impediment, misfeasance, or omis-
sion, anything required by the Act to be done is omitted
to be done, or is not done within the time fixed, the
Governor in Council may take all such measures as may
be necessary for removing such impediment or rectifying
such misfeasance or omission, and may validate any-
thing which may have been irregularly done in matter of
form, so that the intent and purpose of the Act may have
effect: And whereas the annual meeting of the Waipawa
Licensing Committee was fixed for the first day of June, one
thousand eight hundred and eighty-nine: And whereas it
appears that Henry Lewis Jull duly delivered, posted, and
published (except as hereinafter appears) the notices neces-
sary to entitle him to apply at the annual meeting of the
Waipawa Licensing Committee for a publican's license for a
house to be called "The Exchange Hotel:" And whereas,
after the delivery, posting, and publishing of the notices as
aforesaid, and before the holding of the annual meeting, the
building described in the said notices (together with the
notice posted on the front door thereof) was destroyed by
accidental fire: And whereas a building adjacent to such
house was not destroyed, and such building would be in-
cluded in the licensed premises within the meaning of "The
Licensing Act, 1881," by virtue of a license granted for the
house so destroyed as aforesaid, but reference to such build-
ing was unintentionally omitted from the notices delivered,
posted, and advertised as aforesaid: And whereas the Wai-
pawa Licensing Committee, being satisfied that that part
(not destroyed by fire) of the premises in respect of which
the license was sought contained sufficient accommodation
to justify the granting of a license in respect thereof, granted
a certificate for a publican's license, in pursuance of the ap-
plication of the said Henry Lewis Jull, in respect of such
premises, the applicant undertaking to make certain altera-
tions and additions thereto within three months from the
date of such meeting: And whereas it appears expedient to
validate the notices delivered, posted, and advertised as
aforesaid, and to remove any impediment to the granting of
a license, in pursuance of the said application, which the
destruction of the said house by fire might be considered to
have occasioned:
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in pursuance and exercise of the powers con-
ferred by the said Act and of all other powers enabling him in
this behalf, and by and with the advice and consent of the
Executive Council of the said colony, doth hereby order and
declare that the notices of application delivered, posted, and
advertised as aforesaid shall not be invalid with respect to the
certificate granted by the said Licensing Committee merely
because they did not specifically refer to that part of the
building on the premises not destroyed by fire, nor because
the said notice was not posted on the front of the principal
entrance-door of the said premises during the whole of the
time prescribed by the said Act, and that the certificate so
granted as aforesaid shall not be invalid merely because the
building specifically referred to in the said application was
destroyed by fire before the day appointed for the annual
meeting of the Waipawa Licensing Committee.

Clerk of the Executive Council.
