Terms and Conditions of Sale or Selection of Village-settle-
ment Small-farm Allotments in the Canterbury Land
District.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-
sixth day of February, 1889.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by the one hundred and sixty-seventh sec-
tion of "The Land Act, 1885," it is enacted that the
Governor in Council may fix the terms and conditions upon
which the lands comprised in any village settlement shall be
disposed of, and the mode of payment for the same:
And whereas His Excellency the Governor of the Colony
of New Zealand has, by Proclamation issued under the
provisions of section one hundred and sixty-six of the said
Act and the fourteenth section of "The Land Acts Amend-
ment Act, 1888," set apart the lands enumerated in the
Schedule hereto as village settlements:
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in pursuance and exercise of the powers
and authorities conferred upon him by the hereinbefore in
part recited Act, and by and with the advice of the Executive
Council thereof, doth, by this present order, fix the follow-
ing as the terms and conditions upon which the village
settlements enumerated in the Schedule hereto shall be
disposed of, and the mode of payment for the same, that is
to say,-

The lands enumerated in the Schedule hereto shall be
open as small-farm allotments for sale or selection either
for cash, or on deferred payments, or on perpetual lease. -
The day upon which the lands shall be open for sale or
selection shall be Wednesday, the twenty-ninth day of May,
one thousand eight hundred and eighty-nine. -
No person shall be allowed to apply for or to select
more than one allotment. -
The purchaser for cash of any of the lands enumerated
in the Schedule hereto must deposit with the Receiver of
Land Revenue for the land district one-fifth of the purchase-
money at the time of application, and shall pay the whole
remainder of the purchase-money within thirty days of the
granting of his application; and if not paid within thirty
days his deposit shall be forfeited, and the lands shall be
again open for sale or occupation forthwith; and upon full
payment of the purchase-money he will be entitled to a
Crown grant, to be issued in the usual way. -
The purchaser for cash of any of the lands enumerated
in the Schedule hereto will be required to make the following
declaration :-

declare-

That I am the person who, subject to the provisions of
"The Land Act, 1885," am purchasing Section , Block
District. -
That I am purchasing such land solely for my own use
and benefit, and not directly or indirectly for the
use or benefit of any other person whomsoever. -
That I am not the owner, tenant, or occupier, directly
or indirectly, either by myself or jointly with any
other person or persons, of any lands anywhere in
the colony exceeding in the whole one acre.
And I make this solemn declaration conscientiously be-
lieving the same to be true, and by virtue of an
Act of the General Assembly of New Zealand
intituled "The Justices of the Peace Act, 1882."

If any of the lands enumerated in the Schedule hereto
are selected upon deferred payments, the selector shall be
subject to the provisions relating to Part III. of "The Land
Act, 1885." -
If any of the lands enumerated in the Schedule hereto
are selected under the perpetual-leasing system, the selector
shall be subject to the provisions of Part IV. of "The Land
Act, 1885." -
The prices stated in the Schedule hereto shall be the
prices at which the lands shall be open for sale for cash,
on deferred payment, or perpetual lease, as respectively
stated. -
If there shall be more than one application on the
same day for any allotment, the right to occupy the same
shall be determined by lot amongst the applicants. -
Each applicant for a deferred-payment section will be
required to make the declaration prescribed by section one
hundred and thirteen of "The Land Act, 1885," and shall at
the time of application deposit with the Receiver of Land
Revenue for the land district one-tenth of the value of the
land if the area is under twenty acres, and one-twenty-eighth
of the value of the land if it is over twenty acres. Such
payment shall be deemed to be a discharge of the license-
fee for the six months due on the next first day of January
or July following the date of the license, as the case may
be; and, upon fulfilment of the terms and conditions pre-
scribed by the said Act relating to land on deferred pay-
ments, will be entitled to the Crown grant, to be issued in
the usual way. A license-fee of twenty-one shillings will
also have to be deposited.
- Each applicant for any of the allotments on perpetual
leasing shall be required to make the declaration prescribed
by section one hundred and forty-three of "The Land Act,
1885," and shall deposit with the Receiver of Land Revenue
for the land district a sum equal to one half-year's rent of
the allotments included in the application, and such pay-
ments shall be in discharge of the half-year's rent due on
the first day of January or July which shall first ensue after
the commencement of the term, together with the sum of
thirty shillings for the lease and registration thereof.

WHEREAS the land mentioned in the Schedule hereto
was reserved for a site for a public library:
And whereas, in the opinion of the Governor, it is expedient
to vest the said land in the Te Awamutu Town Board:
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, by and with the advice and consent of the
Executive Council of the said colony, and in exercise of the
powers and authorities vested in him by the fourth section
of "The Public Reserves Act, 1881," doth hereby declare
that, from and after the day of the date hereof, the said
reserve shall become vested in the Te Awamutu Town Board,
in trust, for a site for a public library.
SCHEDULE.
ALL that parcel of land in the Provincial District of Auck-
land, containing by admeasurement 9 perches, more or less,
situate in the Parish of Mangapiko, in the Puniu Survey
District, and being Section No. 154 of the Town of Te Awa-
mutu. Bounded towards the north-east by Alexandra Road,
79.6 links; towards the south-east by Section No. 155, 148.8
links; towards the south-west by Section No. 166, 15 links;
and towards the north-west by Section No. 153, 126 links, to
the commencing-point: be all the aforesaid linkages more or
less; as the same is delineated on Map No. 1367, deposited
in the Survey Office, Auckland.
