Vesting Reserves in Auckland.

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixteenth day of January, 1888.

Present:

His Excellency the Governor in Council.

IN pursuance and exercise of the powers and authorities vested in me by “The Special Powers and Contracts Act, 1886,” I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, do hereby declare that, from and after the fifteenth day of January, one thousand eight hundred and eighty-eight, the land described in the First Schedule hereto shall vest in Her Majesty the Queen as part of the Auckland Domain, subject to “The Public Domains Act, 1881;” and that the lands described in the Second Schedule shall vest, as from the date aforesaid, in the Auckland Hospital and Charitable Aid Board constituted under “The Hospitals and Charitable Institutions Act, 1885,” for the purposes of the Auckland Provincial Hospital, subject to the said Act.

FIRST SCHEDULE.

ALL that piece or parcel of land containing 1 acre 1 rood 8 perches, more or less, situate in the Provincial District of Auckland, and being the north-eastern portion of Allotment No. 41 of Section No. 3, in the Suburbs of Auckland, in the Parish of Waitemata, in the County of Eden. Bounded towards the north-east by the Auckland Domain, 245 and 794 links; towards the east by the Auckland Domain aforesaid, 203 links; towards the south and south-west by Allotment No. 41 of Section No. 3 aforesaid, 130 and 1010 links respectively; and towards the west by the Hospital Stream: as shown in the official plan of the locality, deposited in the Land Office, Auckland.

SECOND SCHEDULE.

ALL that piece or parcel of land containing 1 acre 1 rood 8 perches, more or less, situate in the Provincial District of Auckland, and being a portion of the Auckland Domain, in the Parish of Waitemata, in the County of Eden. Bounded towards the north by other portion of the Auckland Domain, 84 links; towards the east by other portion of the Auckland Domain, 174 and 524 links; towards the south-east by other portion of the said domain, 200 links; towards the south-west by the road known as Park Road, 375 links; and towards the north-west and west by Allotment No. 41 of Section No. 3 of the Suburbs of Auckland, 299 and 321 links respectively: as shown on the said official plan.

Powers delegated to the Kaiapoi Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixteenth day of January, 1888.

Present:

His Excellency the Governor in Council.

IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the fifteenth day of June, one thousand eight hundred and eighty-six, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Kaiapoi Public Domain Board, namely,—

ROBERT COUP,
EDWIN PARNHAM,
RICHARD MOORE, and
The MAYOR of KAIAPOI

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the first Monday in each month, at seven o’clock p.m., at the office of the Chairman, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the sixth day of February, one thousand eight hundred and eighty-eight.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting, and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Monday in December in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be Chairman of such meeting.

  6. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

SCHEDULE.

ALL that parcel of land situate in the Mandeville District, in the Provincial District of Canterbury, containing 15 acres and 32 perches, more or less, commencing at a point on the North Road, the same being the north-west corner of Section No. 338E, following along the said road in a northerly direction a distance of 19 chains, and running back easterly a distance of 8 chains in a rectangular block; and numbered 74 (in red) on the map of the Chief Surveyor of the Provincial District of Canterbury, setting out and describing the rural land in the Mandeville District aforesaid.

Extending Close Season for Rock-oysters in Hauraki Gulf, &c.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirteenth day of January, 1888.

Present:

His Excellency the Governor in Council.

WHEREAS by “The Fisheries Conservation Act, 1884” (hereinafter termed “the said Act”), it is, among other things, enacted that the Governor in Council may from time to time make, alter, and revoke regulations for the purposes therein mentioned, which said regulations shall have force and effect only in any waters or places specified therein:

And whereas by Order in Council dated the tenth day of January, one thousand eight hundred and eighty-eight, certain regulations were made, in exercise and pursuance of the powers conferred by the said Act, among other things, prescribing a close season for rock-oysters: And whereas it is expedient to extend such close season for rock-oysters in respect of the places hereinafter set forth:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers conferred upon him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulation:—

The close season for rock-oysters prescribed by Order in Council dated the tenth day of January, one thousand eight hundred and eighty-eight, is hereby extended until the thirty-first day of March, one thousand eight hundred and eighty-nine; and this regulation shall have force and effect in respect of the foreshore of the coast in Hauraki Gulf and Frith of Thames, within a line drawn from Point Rodney to the mouth of the Waikawhau River, situated on the west coast of the Coromandel Peninsula, and which river forms one of the boundaries of the County of Coromandel; and also in respect of the foreshore of all islands in that portion of the Hauraki Gulf and the Frith of Thames lying to the southward and westward of a line drawn from Point Rodney to Cape Colville; and also in respect of the foreshores of the coast and all islands adjacent thereto between Ngatoka Rarangui Point on the north and Bream Head on the south.
