ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this seventeenth day of January, 1887.

Present:

THE HONOURABLE THE MINISTER FOR PUBLIC WORKS PRESIDING IN COUNCIL.

WHEREAS a petition from the majority of the stock-owners in that part of the colony specified in the Schedule hereto has been presented to His Excellency the Governor, praying him to constitute such part of the colony a district for the purposes of Part II. of “The Rabbit Nuisance Act 1882 Amendment Act, 1886” (hereinafter termed “the said Act”), and it appears expedient to grant the prayer of the said petition:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth constitute all that part of the said colony described in the Schedule hereto a district for the purposes of Part II. of the said Act, and doth hereby declare that such district shall be known by the name of “The Hurunui Rabbit District.”

SCHEDULE.

All that area in the Provincial Districts of Canterbury and Nelson bounded towards the North-west by the Counties of Grey and Inangahua, from the Hurunui Pass to a point due north of the confluence of the Rivers Hope and Boyle; thence towards the East by a straight line to the said confluence; thence towards the North-east generally by the said River Hope and by the Waiau-ua River to the ocean; thence towards the South-east by the ocean to the Waipara River; thence towards the South-west by the said Waipara River and its south branch to its source; thence by a straight line to Block Hill; and thence by straight lines over Ashley Head, Seaward Head, and Esk Head to and along the summit of the watershed between the rivers Hurunui and Poulter to the Southern Alps; and thence again towards the North-west by the County of Westland to the place of commencement.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this seventeenth day of January, 1887.

Present:

THE HONOURABLE THE MINISTER FOR PUBLIC WORKS PRESIDING IN COUNCIL.

IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the thirty-first day of December, one thousand eight hundred and seventy-eight, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to

The Clyde Town Board,

which shall be known as the Clyde Domain Board (herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say, —

  1. The Board shall meet for the transaction of business on the second Wednesday in each month, at two o’clock p.m., at the Town Board Offices, Clyde, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Wednesday, the ninth day of February, one thousand eight hundred and eighty-seven.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting, and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the second Wednesday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be Chairman of such meeting.

  6. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

SCHEDULE.

All that parcel of land in the Provincial District of Hawke’s Bay, containing by admeasurement 8 acres and 32 perches, more or less, being Suburban Section No. 12, Class No. 2, in the Township of Clyde. Bounded towards the North by Lucknow Street, 1300 links; towards the North-east by Lahore Street, 400 links; towards the South-east by Suburban Section No. 11, Class No. 3, 1000 links; and towards the South-west by a public road, 1240 links: as the same is delineated on the map of the Township of Clyde, deposited in the Survey Office, at Napier.

Conditions for Farm Homestead Special Settlements on Perpetual Lease.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this seventeenth day of January, 1887.

Present:

THE HONOURABLE THE MINISTER FOR PUBLIC WORKS PRESIDING IN COUNCIL.

WHEREAS by the one hundred and sixty-third section of “The Land Act, 1885,” it is enacted that the Governor in Council may from time to time make, alter, and repeal regulations for fixing the terms and conditions upon which the lands in any special settlement shall be disposed of, and the mode of payment for the same:

And whereas it is deemed expedient to make regulations for the disposal of farm homestead special settlements on perpetual lease:

Now, therefore I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred upon me by the hereinbefore in part recited Act, and by and with the advice and consent of the Executive Council of the said colony, do hereby fix the following terms and conditions as those upon which farm homestead special settlement blocks shall be disposed of on perpetual leasing, and the mode of payment for the same.

REGULATIONS.

  1. Every lease under these regulations shall be for a fixed term so as to expire on the thirtieth day of June which shall first ensue after the expiration of thirty years from the date of commencement of the term, and shall be renewable from time to time for periods of twenty-one years, without any right of acquiring the freehold.

  2. The rental shall be based on the capital value of the land, which shall in no case be less than £1 an acre.

  3. No lease shall be issued, or any transfer of the interest of a settler allowed, except with the consent of the Commissioner of Crown Lands to be first obtained.

  4. Renewals of leases shall be subject in all respects to the provisions of sections 151 to 155 of Part IV. of “The Land Act, 1885.”

  5. No married woman shall be eligible as a selector under these regulations, but any other person of the age of 17 years or upwards shall be eligible, married men having the preference.
