Vesting a Reserve in Canterbury.

ORDER IN COUNCIL.

At the Government House, at Wellington, this first day of June, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto was reserved for river protection: And whereas, by an Order in Council issued on the eleventh day of May, one thousand eight hundred and eighty-seven, the said land was vested in error in the Board of Conservators of the Waimakariri District:

And whereas, in the opinion of the Governor, it is expedient to revoke the said Order in Council, and to vest the said land in the Waimakariri Harbour Board:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby revoke the said Order in Council of the eleventh day of May, one thousand eight hundred and eighty-seven, and doth declare that, from and after the day of the date hereof, the said reserve mentioned in the Schedule hereto shall become vested in the Waimakiriri Harbour Board, in trust, for the improvement and protection of the banks of the Waimakariri River.

SCHEDULE.

ALL that parcel of land in the Provincial District of Canterbury, containing by admeasurement 9 acres, more or less, being Section No. 1317 (in red), situate in the Rangiora Survey District. Bounded towards the South-east by the south branch of the River Waimakariri; towards the North by the road-line south of Section No. 364; and generally towards the North-west by the road-line south-east of Section No. 297: save and excepting thereout that portion of Section No. 391 which is included in the above-described boundaries; as the same is delineated on the plan deposited in the District Survey Office, Christchurch.

Validating Election of Native Assessor under Licensing Acts.

ORDER IN COUNCIL.

At the Government House, at Wellington, this first day of June, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section two hundred and twenty-seven of “The Licensing Act, 1881” (herein termed “the said Act”), it is provided that if, through any accidental or unavoidable impediment, misfeasance, or omission, anything required by the said Act to be done is omitted to be done, or is not done within the time fixed, the Governor in Council may take all such measures as may be necessary for removing such impediment or rectifying such misfeasance or omission, and may validate anything which may have been irregularly done in matter of form, so that the intent and purpose of the Act may have effect:

And whereas in the month of February last the Returning Officer omitted to hold an election of an Assessor for the Native Licensing District of Tologa, but such election was held on the sixth day of May last, and Hare Karawa was then duly elected: And whereas it is expedient to validate such election:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Act, and of all other powers enabling him in this behalf, and by and with the consent of the Executive Council of the said colony, doth hereby validate the said election of Hare Karawa as the Assessor for the Native Licensing District of Tologa.

Validating Local Option Poll.

At the Government House, at Wellington, this first day of June, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Act, and of all other powers enabling him in this behalf, and by and with the advice and consent of the Executive Council of the said colony, doth hereby validate the taking of the said poll within the said Licensing District of Dargaville.

Native Land proposed to be taken at Sentry Hill for the Purposes of the Foxton–New Plymouth Railway.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eleventh day of May, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work authorized to be constructed by the Government, to wit, the Foxton–New Plymouth Railway: And whereas the said land is held or occupied by Native owners:

Now, therefore, in pursuance and in exercise of the powers vested in him by “The Public Works Act, 1882,” and the amendments thereof, and of all other powers in anywise enabling him in this behalf, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the Government work known as the Foxton–New Plymouth Railway shall and may be constructed on or through the parcels of land more particularly mentioned in the Schedule hereto.
