If there should be more than one application for any
allotment, the right to purchase the same shall be deter-
mined by lot amongst the applicants. -
The purchaser of any lands described in the Schedule,
upon the full payment of the purchase-money, will be en-
titled to his Crown grant, to be issued in the usual way upon
payment of the fees prescribed by-law.

Regulations for fixing the Thames Drainage Area and
constituting the Thames Drainage Board.

ORDER IN COUNCIL.
At the Government House, at Wellington, this nineteenth
day of January, 1886.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN exercise and pursuance of the power and authority
conferred by "The Gold-mining Districts Act 1873
Amendment Act, 1885," His Excellency Sir William Francis
Drummond Jervois, the Governor of the Colony of New Zea-
land, acting by and with the advice and consent of the Exe-
cutive Council of the said colony, doth hereby make the
regulations contained in the Schedule hereto for the pur-
poses of fixing the Thames drainage area, and constituting
the Thames Drainage Board, more particularly mentioned
in the said regulations, and for prescribing the manner in
which drainage rates as contributions for drainage works
shall be assessed on lands within the said area, the making,
levying, collecting, and recovery of such rates, and for regu-
lating appeals against such assessments; and doth hereby
declare that such regulations shall come into force on the
day of the publication hereof in the New Zealand Gazette.
SCHEDULE.
REGULATIONS.

THERE shall be a Board, to be called "The Thames
Drainage Board" (hereinafter termed "the Board"), and
such Board shall have jurisdiction within the area herein-
after defined, which said area shall be known as "the
Thames drainage area." -
The Board shall consist of nine members, seven of
whom shall be elected by the contributors assessed for the
drainage rate, and, of the other two, one shall be elected by
the Thames Borough and the Thames County Council re-
spectively. Failing such election for the period of one
month by either the said Borough or County Council, or by
both, the elected members of the Board shall elect one or
two members as required to fill the vacancy.
Five members shall form a quorum.

The Board shall have a common seal, which shall be
kept and used in such manner as the Board may, by resolu-
tion, determine. -
A Chairman shall be elected by the Board at their first
meeting, and shall have a casting as well as a deliberative
vote. -
The election for the first Board shall be held on the
third Saturday in February, 1886, and thereafter the Board
shall be elected annually on the third Saturday in January
in each year. Members shall hold office until their suc-
cessors are elected. -
The qualification of an elector shall be one vote for every
£100 or portion of £100 of annual drainage rates paid by
such elector, the calculation of such rates being based upon
the preceding year's assessment up to £500. Every contri-
butor assessed for £500 and upwards shall be entitled to five
votes. -
The directors of any registered company, being owners
of licensed holdings and of registered claims assessed for
contribution as hereinafter provided, may appoint some
person to vote on their behalf at all elections. -
The first election of the Board shall be held at the
Courthouse at Grahamstown. The qualification of every
elector for the first election shall be one vote for every ten
acres held as a claim or licensed holding, and no person or
company shall have more than five votes. -
It shall be the duty of the Board during the month of
January in each year to make an estimate of the amount
required to defray all costs and charges for drainage purposes
during the ensuing twelve months. -
In making an assessment for the purpose of striking
such drainage rate the Board shall take into consideration—
(1.) Area of ground held;
(2.) Proportionate depth and extent of workings;
(3.) Amount of benefit derived either from yield of gold or
other minerals, or enhanced value given by such drain-
age works. -
The Board, after making allowance for any surplus or
deficiency in the previous year's revenue, shall proceed during
the said month of January in each year to raise an amount
sufficient to cover such estimated cost and charges, and the
necessary expenses of the Board for the year, by striking a
drainage rate upon all lands within the district area actually
benefited by such drainage works, and all occupiers or
owners of land so assessed shall be liable for the amount of
the rate so made.
Such rate shall be payable either in one sum or by instal-
ments, and at such time or times and place as the Board
may determine.

Seven days' notice of such rate, and the time, place,
and mode of payment, shall be given by advertisement in
some newspaper circulating in the district. -
The Board shall in such notice name a day on which
they will sit to hear appeals against the assessments. Such
day shall not be less than seven nor more than ten days from
the first publication of the notice. -
Any person feeling aggrieved by the assessment may
appeal against the same to the Board, who shall sit on the
day appointed to hear such appeals; and any person intend-
ing so to appeal shall give notice thereof in writing to the
Board not less than three clear days before the day fixed for
such sitting of the Board. The decision of the Board on all
appeals shall be final, except as hereinafter provided. -
Appeals against the rate as a whole may be made to
the Warden's Court by any person assessed for contribution
at any time within fourteen days from the publication of the
notice required by section 12 of these regulations. Such
appeal may be made on the following grounds:—
That any land held within the area is assessed too high
or too low, as the case may be, or is not benefited by
such drainage works:
That the total amount to be raised by such assessment
is in excess of the probable requirements of the year.
The decision of the Warden's Court upon such appeal to
be final and binding upon the Board and all parties in-
terested.
The Warden of such Court shall have power from time to
time to make regulations for the conduct of such appeal and
costs thereof.
- The Board may from time to time appoint and em-
ploy a Treasurer, Clerk, Surveyor, Valuers, Collectors, and
all such other officers to assist in the execution of these
regulations as they shall think proper and necessary, and
from time to time remove any such officers, and appoint
others in the room of such as shall be so removed, or as may
die, resign, or discontinue their offices; and may, out of the
fund at the disposal of the Board for that purpose, pay such
