Powers delegated to the Arrowtown Domain Board under “The Publin Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this fourteenth day of January, 1886.

Present:

His Excellency the Governor in Council.

IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-first day of August, one thousand eight hundred and eighty-two, making delegation of certain powers in manner as therein appears, and doth, with the like advice and consent, by this present order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Arrowtown Public Domain Board, namely,—

WILLIAM TILEY SMITH,
WILLIAM JENKINS,
WILLIAM SCOLES, and
HENRY DONALDSON, M.R.C.S.

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the first Monday in each month, at seven o’clock p.m., at the Arrowtown Athenæum, Arrowtown, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the first day of February, one thousand eight hundred and eighty-six.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting, and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the second Monday in December in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be Chairman of such meeting.

  6. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.


SCHEDULE.

ALL that area in the Provincial District of Otago, containing by admeasurement 6 acres, more or less, being Section No. 38, Block VII., Shotover District. Bounded towards the North by Block XXII., Arrowtown, 915 links; towards the North-east by Block X., Shotover District, 700 links; towards the South-east by Section No. 37, Block VII., 716 links; and towards the South-west by Section No. 61, Block VII., 995 links.

Village-settlement Land in Canterbury withdrawn from Sale.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fourteenth day of January, 1886.

Present:

His Excellency the Governor in Council.

WHEREAS by “The Public Reserves Sale Act, 1878,” the land specified in the Schedule hereto was declared open for sale under “The Land Act, 1877,” and Acts amending the same: And whereas by an Order in Council, issued on the fourteenth day of July, one thousand eight hundred and eighty-five, it was directed that the sections enumerated in the Schedule hereto should be disposed of as village-settlement small-farm allotments on deferred payments: And whereas it is expedient that the sections should be withdrawn from sale as village-settlement small-farm allotments on the deferred payment system, with a view to their being offered for lease as small areas with perpetual right of renewal under Part IV. of “The Land Act, 1885.”

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of every power and authority in anywise enabling me in that behalf, and by and with the advice of the Executive Council of the said colony, do hereby revoke the said Order in Council of the fourteenth day of July, one thousand eight hundred and eighty-five, and do declare that the said sections are hereby withdrawn from sale as village-settlement small-farm allotments, in order that they may be offered for lease, as small areas, with perpetual right of renewal, under Part IV. of “The Land Act, 1885.”

Terms and Conditions of Sale of the Village Settlement in the Mount Fyffe Survey District, Marlborough Land District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fourteenth day of January, 1886.

Present:

His Excellency the Governor in Council.

WHEREAS by the one hundred and sixty-seventh section of “The Land Act, 1885,” it is enacted that the Governor in Council may fix the terms and conditions upon which the lands comprised in any village settlement shall be disposed of, and the mode of payment for the same: And whereas His Excellency the Governor of the Colony of New Zealand has, by Proclamation, set apart the lands enumerated in the Schedule hereto for sale as a village settlement:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the hereinbefore in part recited Act, and by and with the advice of the Executive Council of the Colony of New Zealand, doth hereby fix the following terms and conditions upon which the said village settlement shall be disposed of, and the mode of payment for the same, that is to say,—

  1. The lands enumerated in the Schedule hereto shall be disposed of as village allotments for cash.

  2. The day upon which the lands shall be open for application shall be Wednesday, the twenty-fourth day of February, one thousand eight hundred and eighty-six, at the Land Office, Blenheim.

  3. The lands enumerated in the Schedule hereto shall be sold for cash immediately on purchase.

  4. No person shall be allowed to acquire more than one section.
