Notice of Contract having been entered into by Her Majesty the Queen and the Contractors for the East and West Coast (Middle Island) and Nelson Railway.

HIS Excellency the Governor in Council hereby directs it to be notified that, under the powers conferred upon the Governor in Council by "The Railways Construction and Land Act, 1881," and "The East and West Coast (Middle Island) and Nelson Railway and Railways Construction Act, 1884," a contract was, on the 17th day of January, 1885, made between Her Majesty the Queen, of the one part, and William Chrystall, John Tucker Ford, George Hart, John Thomas Matson, Thomas Shailer Weston, John Honeycomb Cock, Charles Yates Fell, Henry Douglas Jackson, Albert Pitt, and James Sclanders, of the other part, for the construction of a railway from Springfield, in the Provincial District of Canterbury, to Belgrove, in the Provincial District of Nelson, the general purport of the said contract being as follows:-

The Contractors shall, at their own cost, within ten years from date of contract, make a line of railway between Springfield and Brunnerton, and between Brunnerton and Belgrove, of an estimated length of two hundred and thirty-five miles, and thereafter maintain and work the same.

The plans of the railway shall be approved by an Engineer appointed by the Governor for that purpose.

The Contractors shall deposit five thousand pounds (£5,000) in the Public Account of the colony within twelve months from the date of the contract, and this sum shall be retained until they have done works on the railway to a value of not less than ten thousand pounds (£10,000).

The Contractors shall do works on the railway of a value of one hundred and fifty thousand pounds (£150,000) within two years from the date of the contract.

The Contractors shall not assign or dispose of the contract without first obtaining the consent of the Governor to such an assignment or disposal.

The Government shall grant any available Crown lands to the Contractors which may be required for the actual construction of the railway.

The railway is estimated to cost two million five hundred thousand pounds (£2,500,000), and sufficient Crown lands adjoining the line of railway are to be set apart to enable Government to grant to the Contractors lands of a value not exceeding fifty per centum of the cost of the railway, in terms of, and governed by, the conditions of the Acts above quoted.

All regulations made by the Contractors relative to the traffic on the railway shall be made subject to the Governor's approval.

The Governor may purchase the railway at any time on giving six months' notice of his intention to do so, and the value of the railway or portion of the railway shall then be ascertained in the manner provided by the "Railways Construction and Land Act, 1881," except that section 118 of the said Act shall not apply.

In the event of the General Assembly of New Zealand, at its present session, modifying, either partially or wholly, any provisions of the contract relating to the allocation of land, the Contractors shall not have thereby any claim on the Government by reason of such modification.
