Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority vested in me in this behalf, do hereby proclaim and declare that

THE WELLINGTON DISTRICT,

under “The District Courts Act, 1858,” as the same is described or referred to in the said Proclamations of the eighteenth day of June, one thousand eight hundred and seventy-eight, and the twelfth day of March, one thousand eight hundred and eighty-four, shall be and remain abolished from and after the twenty-third day of April instant.

Given under the hand of His Excellency Sir William Francis Drummond Jervois, Lieutenant-General in Her Majesty’s Army, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Companion of the Most Honourable Order of the Bath, Governor and Commander-in Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twenty-second day of April, in the year of our Lord one thousand eight hundred and eighty-five.

A PROCLAMATION.

WHEREAS the land described in the Schedule hereto is vested in certain aboriginal natives of New Zealand, subject to certain restrictions on the alienation of such land, and application has been made for the removal of such restrictions:

It is hereby notified that it is the intention of His Excellency the Governor, immediately after the expiration of sixty days from the publication of this notice in the Gazette and in the Kahiti, to remove the said restrictions on the alienation of the said land.

Portions of Waotu North No. 2B Block, Waikato, containing together about 28 acres, proposed to be acquired by the Crown for educational and telegraph purposes, as delineated on the plan of the said block, deposited in the Survey Office, Auckland.

Order to take Land for the North Island Main Trunk Railway. Length about 210 miles.

ORDER IN COUNCIL.

At the Government House, at Wellington, this second day of April, 1885.

His Excellency the Governor in Council.

IN pursuance and in exercise of the powers vested in me by “The Public Works Act, 1882,” and of all other powers enabling me in that behalf, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby, with the advice and consent of the Executive Council of the said colony, order that a railway, having an average width of three hundred links, extending from a point on the right bank of the Puniu River, in the Provincial District of Auckland, to a point at the intersection of the railway-line from Foxton to New Plymouth Railway, situated in Section seven, Block three, Rangitoto Survey District, Provincial District of Wellington, shall be constructed on or through all lands held or occupied by Native owners; the total length being two hundred and ten miles or thereabouts: as delineated upon the plan marked P.W.D. 12069, deposited in the office of the Minister for Public Works, at Wellington, in the Provincial District of Wellington.

Extending Time for preparing County Rolls, County of Inangahua.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-second day of April, 1885.

Present:

His Excellency the Governor in Council.

WHEREAS it has been made to appear that certain things required to be done by “The Counties Act, 1876,” in connection with the making and revision of the county roll of the County of Inangahua, cannot be done by or within the times required by the said Act:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in him by the said “Counties Act, 1876,” and by and with the advice and consent of the Executive Council of the said colony, doth hereby extend the times for doing the said things in connection with the county roll of the said County of Inangahua, and doth declare that the times for the doing of such several things shall be those which are specified in the Schedule hereto.

SCHEDULE.

  1. For the preparation of the county roll: On or before the 15th May, 1885.

  2. Rolls shall be open for inspection: From the 20th May, 1885, to the 15th June, 1885.

  3. Objections to rolls received: Until the 25th June, 1885.

  4. Day appointed for revision of roll: Some day on or after the 30th June, 1885, but Revision Court shall not sit after the 20th July, 1885.

  5. Roll shall come into force: On the 1st August, 1885.

Authorizing the Mercury Bay Timber Company (Limited) and Messrs. Schapp and Ansenne to construct a Boom across the Waiwawa River, Mercury Bay.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-second day of April, 1885.

His Excellency the Governor in Council.

WHEREAS by the sixteenth section of “The Harbours Act, 1878” (hereinafter called “the said Act”), it is enacted that, in any harbour where no Harbour Board is in existence, the Governor in Council may authorize any person to construct harbour works (other than the reclamation of land from the sea, or any harbour, or the construction of any graving-dock, dock, or breakwater in any harbour or in the sea), and to use and occupy such part of the foreshore, or of any tidal land or tidal waters, as may be necessary for the construction or use of such harbour works in any harbour where no Harbour Board is in existence: And whereas by section thirteen of “The Timber-floating Act, 1884,” it is enacted that the laying-down of booms in navigable waters for the security of timber or other substances or materials shall be deemed to be a harbour work within the meaning of the said Act: And whereas the requisite preliminary notices have been given under “The Timber-floating Act, 1884:” And whereas by the seventeenth section of the said Act it is also enacted that every such Order in Council shall be made upon such terms and conditions as the Governor in Council thinks fit, and the rights thereby conferred shall only be granted for a limited period not exceeding in any case fourteen years, and may at any time be altered, modified, or revoked:

And whereas the Mercury Bay Timber Company (Limited), of Auckland, and David Bruce, David Goldie, Archibald Smith, and Charles Sutton, trading under the name or style of “Schapp and Ansenne” (hereinafter called “the companies”), desire to construct a boom across the Waiwawa River, Mercury Bay, a place where no Harbour Board is in existence, and the companies have applied to the Governor in Council for the issue of an order to authorize the con-
