struction of such boom, and have deposited plans thereof
(marked M.D. 648 and 649) at the office of the Marine De-
partment, Wellington, in the manner prescribed by the one
hundred and fifty-sixth section of the said Act, and, it having
been made to appear to the Governor in Council that the
proposed work will not be or tend to the injury of navigation,
the Governor in Council hath this day approved of the said
deposited plans without any modification or addition, and
subject to the conditions set forth in this Order in Council:

Now, therefore, His Excellency the Governor of the
Colony of New Zealand, in pursuance and exercise
of the power and authority vested in him by the said Act,
and by and with the advice and consent of the Executive
Council of the said colony, doth hereby authorize the com-
panies to construct a boom across the Waiwawa River, in
accordance with the said plans marked M.D. 648 and 649,
and in the position shown on plan marked M.D. 632, and to
use and occupy such portion of the foreshore or of any tidal
land or tidal water as may be necessary for the construction
and use of such boom, subject to the following conditions,
namely:—

  1. That the rights, powers, and privileges conferred by this
    Order in Council shall continue in force for fourteen years,
    computed from the date of this Order in Council, unless in
    the meantime such rights, powers, and privileges shall be
    altered, modified, or revoked by competent authority.

  2. That the said rights, powers, and privileges may be at
    any time resumed by the Governor, and the companies may be
    required to remove the boom from the Waiwawa River and
    the bed thereof at their own cost, without payment of any
    compensation whatever, on giving to the companies six calen-
    dar months’ previous notice in writing. Any such notice
    shall be sufficient if given by the Minister, and delivered at
    the last known address of the companies.

  3. On the master or owner of any vessel or boat notifying
    to the companies, or their agent, manager, or representative
    at Mercury Bay, that he desires to take his vessel or boat
    past the boom, the companies shall forthwith provide, free of
    expense to the vessel or boat, a sufficient number of men to
    work the movable part of the boom, so that the vessel or
    boat may pass through without delay.

  4. Should it at any time become necessary for the con-
    venience of the traffic on the Waiwawa River that the
    opening in the boom should be wider than shown on the plans
    marked M.D. 648 and 649, the Minister may, by a notice in
    writing left at the last-known address of the companies,
    require the companies to provide an opening of the width
    specified in such notice, and the companies shall thereupon,
    with all convenient speed, cause such opening to be made.

  5. Nothing contained in this Order in Council shall be
    deemed to prevent its revocation at any time and without
    any notice in case the company shall—
    (1.) Commit or suffer a breach of the conditions herein-
    before set forth, or any of them;
    (2.) Cease to use or occupy the said boom; or,
    (3.) Be in any manner wound up or dissolved.

And publication in the New Zealand Gazette of an Order in
Council containing such revocation shall be sufficient notice
to the company, and to all persons concerned or interested in
the said boom, that this Order in Council and the rights and
privileges thereby conferred have been revoked and deter-
mined.

  1. In these conditions the term “Minister” means the
    Minister having charge of the Marine Department, as defined
    by “The Shipping and Seamen’s Act, 1877,” and includes
    any officer, person, or authority acting by or under the
    direction of such Minister.

Validating Election of Chairman of Waitara Harbour
Board.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-second
day of April, 1885.

Present:

His Excellency the Governor in Council.

WHEREAS it is provided by the two hundred and thirty-
third section of “The Harbours Act, 1878” (herein-
after termed “the said Act”), that in any case in which, by
any misadventure or accident, anything is at any time done
after the time required by the said Act, or is otherwise ir-
regularly done in matter of form, the Governor may, by Order
in Council duly gazetted, from time to time make provision
for any such case, or may extend the time within which any-
thing is required to be done, or may validate anything so
done after the time required or so irregularly done in matter
of form, so that the true intent and purpose of the said Act
may have effect: And whereas on Tuesday, the thirty-first
day of March ultimo, the Waitara Harbour Board elected a
Chairman, that is to say, Thomas Bayly, to be Chairman of
the said Board: And whereas such election should have
been held on Tuesday, the third day of February last, that
being the day on which the annual meeting for the election
of a Chairman should have been held as required by the
said Act: And whereas it is expedient to validate the said
election:

Now, therefore, His Excellency the Governor of the Colony
of New Zealand, by and with the advice of the Executive
Council of the said colony, and in exercise of the powers
conferred upon him by the said Act, doth hereby validate
the said election, and doth declare that Thomas Bayly, the
person elected on the said thirty-first day of March, one
thousand eight hundred and eighty-five, by the Waitara
Harbour Board, as Chairman of the said Board, shall con-
tinue to hold office as Chairman of the Waitara Harbour
Board in the same manner as if the irregularities hereinbe-
fore mentioned in connection with such election had not
taken place.

Operation of “The Arms Act, 1880,” suspended in the
Middle Island.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-second
day of April, 1885.

Present:

His Excellency the Governor in Council.

IN pursuance and exercise of the powers and authorities
vested in him by “The Arms Act, 1880,” His Excellency
the Governor of the Colony of New Zealand, by and with the
advice and consent of the Executive Council of the said
colony, doth hereby suspend, as from the date of the publica-
tion hereof in the New Zealand Gazette, the operation of all
the provisions of the said Act in so far as they relate to the
sale or purchase by any person or persons of arms, ammuni-
tion, gunpowder, lead, caps, or shot, for mining, sporting, or
any useful or harmless purpose, in the district contained
within the coast-line of the Middle Island, exclusive of any
islands lying adjacent or contiguous thereto.

Vesting a Reserve in the Waianiwa Public Hall.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-second
day of April, 1885.

Present:

His Excellency the Governor in Council.

WHEREAS the land mentioned in the Schedule hereto
was reserved for a site for a mechanics’ institute:
And whereas, in the opinion of the Governor, it is expe-
dient to vest the said land in the Waianiwa Public Hall
(Incorporated):

Now, therefore, His Excellency the Governor of the Colony
of New Zealand, by and with the advice and consent of the
Executive Council of the said colony, and in exercise of the
powers and authorities vested in him by the fourth section of
“The Public Reserves Act, 1881,” doth hereby declare that,
from and after the day of the date hereof, the said reserve
shall become vested in the said Waianiwa Public Hall (In-
corporated), in trust, for a site for a public hall and library.

SCHEDULE.

ALL that parcel of land situate in the Southland Division of
the Provincial District of Otago, containing 27·7 perches,
more or less, being Section No. 13, Block II., on the map of
Waianiwa Village. Bounded on the North by Section No. 11
of Block II. of said village, 166·6 links; on the East by
Section No. 12 of said block, 163·7 links; towards the South-
west by Bradford Street, 205 links; and on the West by
Section No. 14 of said block, 44·4 links.
