mining, mineral, and agricultural lessees, within the county
may run cattle therein in excess of the number which they
are entitled to run free of assessment fees, on obtaining a
depasturing license under these regulations; and other
persons resident in such county, not being holders of miners'
rights or business licenses, or such lessees as aforesaid, may
run cattle within any district on obtaining a depasturing
license under these regulations.
Application to be made.
7. Persons desirous of obtaining a depasturing license must
lodge with the Clerk of the County Council an application
in writing in the form contained in the Second Schedule
hereto, and deposit therewith the assessment and registration
fees payable under these regulations. If such application is
refused the assessment and registration fees shall be repaid
to the applicant, but not otherwise.
Applications, how dealt with.
8. If the application shall be to depasture not more than
five head of great cattle, exclusive of cattle running free of
charge as hereinbefore provided, or of other cattle for which
a depasturing license has previously been granted to the
applicant, the Clerk of the County Council may, with the
consent and approval of the Chairman, forthwith issue a
depasturing license to the applicant; but if such application
shall be for the depasturing any larger number of great
cattle than aforesaid, or for derasturing small cattle, the
Clerk shall submit the same to the County Council at the
next ordinary meeting thereof, and the County Council shall
determine whether such application shall be granted or
refused.
Assessment Fees.
9. The assessment fees payable annually under these regu-
lations shall be,–
For every head of great cattle .. 5s.
For every head of small cattle .. 1s.
And when six months or more of the annual period shall
have expired, only one-half of the above-named fees shall be
charged.
Duration and Form of License.
10. Depasturing licenses granted under these regulations
shall be signed by the Chairman of the County Council, and
shall remain in force only until the 31st day of March next
following the date thereof; and such license shall be in the
form contained in the Third Schedule hereto.
Registration.
11. All cattle depastured in a district under these regula-
tions, whether running free of assessment or by virtue of a
depasturing license, must be branded, and the brands and a
description of the cattle must be registered with the Clerk
of the County Council. The fee for every such registration
shall be 1s., and a certificate of registration in the form of
the Fourth Schedule hereto shall be given to persons entitled
to run cattle free of assessment fees as aforesaid.
Register to be kept.
12. The Clerk of the County Council shall keep a register
of brands, and a list of depasturing licenses and registration
certificates issued, with the date of issue, and the names of
the licensees and certificate-holders, the qualification under
which any cattle are to be run free of assessment fees, and
the quantity and description of stock which each person is
authorized to depasture; and such register shall be kept in
the Council offices, and may be inspected at any time by the
public.
Brands previously registered.
13. If the brand described in any application has pre-
viously been registered by any other person, the applicant
shall amend his application by inserting therein some other
brand not previously registered.
Diseased Cattle, Pigs, and Goats prohibited.
14. No diseased cattle shall be depastured upon, nor shall
any pigs or goats be allowed at large within, any district; and
any person or persons who shall turn out or depasture any
diseased cattle or suffer any pig or goat to be at large within
any district shall be liable to a penalty not exceeding £10
for the first offence, and £20 for any second or subsequent
offence.
Licenses not to be issued to Minors.
15. Depasturing licenses shall not be issued to minors
under 18 years of age.
Penalty for non-Registration.
16. No person shall depasture cattle, great or small, in
any district unless the same be registered, and branded in the
manner provided by these regulations; and all cattle de-
pastured under these regulations shall be and be kept
branded with the registered brand of the person licensed to
depasture the same in the manner herein provided; and all
cattle found in any district unregistered or without such
brand shall be deemed and held to be illegally depastured,
and the owner or owners thereof shall, upon conviction, be
liable to a penalty not exceeding 10s. per head for each
offence for every head of cattle so depastured.
Charges payable for unregistered Cattle.
17. Any owner or person claiming any pig, goat, or un-
registered cattle at any muster or inspection of such cattle
shall pay the sum of 10s. per head as a fixed charge for the
cost and charges incident to the collecting and recovery of
the same respectively.
Penalty for illegally Depasturing.
18. Any person depasturing cattle in or upon a district
without a license authorizing him so to do, and any person
depasturing thereon a greater number of cattle than he is
entitled to depasture by virtue of such license or registration
certificate, shall upon conviction be liable to a penalty not
exceeding 10s. per head for each offence for every head of
cattle so depastured.
Mustering and Branding all Cattle.
19. It shall be lawful for any person appointed in this
behalf by the Vincent County Council, or the Chairman
thereof, with or without servants and others, to muster, as
often as may be deemed necessary, at any place or places
within the said depasturing districts respectively, and at such
musters or any of them to brand all cattle then found to be
registered under and by virtue of these regulations with a
pitch or tar brand of such form and shape as may be con-
sidered desirable or necessary.
FIRST SCHEDULE.
CROMWELL DEPASTURING DISTRICT.
ALL that area in the Provincial District of Otago, situated in
Vincent County, and bounded towards the West by a stream
which forms part of the eastern boundary of Run No. 340A
to a right line passing through Trig. G, and which forms
part of the south-east boundary of Runs Nos. 340A and 245D;
towards the North-west by that line; towards the North-east
by a right line forming part of the south-western boundary
of said Run No. 245D to Section No. 3 of Block IV., Wakefield
Survey District; towards the North by the northern boundary-
line of Section No. 3, and by Section No. 4 of said block and
its southern boundary-line produced to the Clutha River;
towards the East generally by that river; and towards the
South generally by the Kawarau River to the stream first-
mentioned; excepting from the above-described area the
Borough of Cromwell, and all lands sold, leased, or otherwise
disposed of as the same is delineated on the plans in the
Survey Office, Dunedin.
DUNSTAN DEPASTURING DISTRICT.
All that area in the Provincial District of Otago, situated
in Vincent County, and bounded towards the North by a due
East line drawn from the Clutha River through Trig B and
forming part of the southern boundary of Run No. 221D;
thence towards the West and again generally towards the
North by right lines forming part of the eastern and southern
boundaries of said Run No. 221D; towards the North-west
by Run No. 221c to the eastern boundary-line of Block II.,
Leaning Rock Survey District; towards the East generally
by that boundary-line and by Runs Nos. 221A and 221B to
the Manuherikia River; towards the South-east by that
river to the Clutha River; and towards the South-west and
again towards the West by the Clutha River to the due East
line first mentioned; excepting from the above-described
area the Borough of Alexandra, the Town of Clyde, and all
lands sold, leased, or otherwise disposed of as the same is
delineated on the plans in the Survey Office, Dunedin.
SECOND SCHEDULE.
Pursuant to the provisions of "The Mines Act, 1877," and
regulations made thereunder, I hereby apply for a license to
depasture [here insert number], head of [great or small]
cattle, in the [Dunstan or Cromwell] depasturing district,
Vincent County, such cattle being or to be forthwith branded
as follows, viz. [here insert description of stock, colour, sex,
and brand of each].
